AN ORDINANCE AMENDING TITLE 12, CHAPI'ER IA, SECTION 3, OF THE
ENGLEWOOD MUNICIPAL CODE RELATING TO THE MUNICIPAL WATIR SYSTEM.
WHEREAS, by runending Title 12-lA-3 of the Englewood Municipal Code the City of
Englewood's Utility Department will be able to charge back reasonable expenses for
distonnection when the property owner refuses to correct the situation and after notice baa
been given by the Englewood Utility Department; and
WHEREAS, the amendment will enable the Englewood Utility Department to bring the
item in question up to Code and recover the expense by adding the expense to the quarterly
water and sewer bill of the customer;
NOW, THEREFORE, BE IT ORDAINZD BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS :

Section 3, of the Englewood Municipal Code to read as follows .
12-lA-3: RIGHTS UNDER LICENSE: Neither the granting of such license nor any act,
circumstance or condition shall operate to create any vested or proprietary right whateoever
in the licensee, hut shall give the licensee the right to use water for the purposes specified in
the license, subject to termination of such license as herein provided. Every license to use
water shall be subject to revocation and sh ut-off'by the Director of Utilities AND SHALL BE
SUBJECT TO THE CHARGE OF REASONABLE EXPENSES AlTER WRITTEN NOTICE
FOR ITEMS REQUIRED BY TIDS TITLE PERTAINING TO USE OF WATER WHEN
THE PROPERTY OWNER REFUSES TO COMPLY WITH THE ENGLEWOOD
MUNICIPAL CODE, without obligation upon the City to refund or repay any consideration
which may have been given for the granting of such license, and without any obligatior, upon
the City whatsoever, for any one or more of the following reasons:
A . Failure to pay proper charges when due .
B. Failure to comply with this Chapter and applicable rule s and regulations of the
Water Division.
C Use of water for a purpose not authorized by license .
Waste of water. (1962 Code §8.6-2)

BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The proposed ordinance revision will enable the Utilities' Depl to charge bri expenses for items that
are required by Code when the property owner refuses to correct the situation after notice has been
given by the Utility . It would mainly apply to curt> stop repairs since other requirements are usually
handled routinely by discontinuation of service at the curt> stop . The ordinance revision enables the
Utility to bring the item in question up to Code and recover the ex.,ense by adding the expense to the
water bill of the customer.
FINAN~IAL IMPACT
The Utilities Department will fund the repair initially , with the owner/residP.ni b.in.; billed for the
expenses in the form of the quarter1y water and sewer bill .
