MEMBER HATHAWAY AN ORDINANCE AMENDING TITLE 16, CHAPl'ER -', OF THE ENGLEWOOD MUNICIPAL CODE, 1985, ADDRESSING ACCESSORY STRUCTURES. WHEREAS, there exists within the accessory structure regulation• uncertainty of interpretation in terms of the number and type of structure• permitted in the residential diatricta; and WHEREAS, theae amendments clarify the regulation• aa well aa bro, .den the types of accessory 1tructure1 permitted; and WHEREAS, theae amendments help clarify p,nd make more efficient the overall administration and enforcement of the Comprehensive Zoning Ordinance; and WHEREAS, the Englewood Planning and Zoning Commiaaion held a Public Hearing on these proposed amendments on October 19, 1993, reviewed and nocommended the amendments; eUd WHEREAS, the Englewood Planniog and Zoning Commission reviewed tbia mat'.:er again at City Council's request and he• recommended the pn,posed amendments; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCll. OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: ~ The Englewood City Council hereby approves amending Title 16, Chapter 4, Section 2, Subsection A through M, of the Englewood Municipal Code which will read aa follows : 16-4-2: R-1-A SINGLE-FAMILY RF..sIDENCE DISTRICT This Di strict is compo aed of certain quiet, low-density residential areas of the City. GOAL AND PREVIOUS COUNCIL ACTION; Goal : Community Interaction . The proposed amendment to the Comprehensive Zoning Ordinance was referred to the City Cnuncil in early 1994. City Council scheduled study sessions on March 21, 1994; on May 16 , 1994; and a public forum on July 18 , 1994 . The prooosed amendment was remanded to the Planning Commission for consideration of a proposed amendment to the definition of "Garage" as sug gested at the Public Forum. RECOMMENDED ACTION; Schedule a date for Public Hearing to consider amendment of the Comprehensive Zoning Or- dinance regarding the number , size, and type of Accessory Structures to be permitted in all residential wne districts. One c,f the issues is tha t of • Accessory Structures•, which includes garages , car- pons , and sheds. There is no restriction on the "number" of garages permitted per "ownership", and no restriction on the "number" of sheds per "ownership", and the maximum size of sheds is, more often than not , appealed to the Board of Adjustment and Appeals , Also , there are individuals who want to construct "accessory" stru ctures that are not included in the list of uses in the ordinance --a gazebo or a free-standing deck, for instance . These requests also have 10 be taken before the Board 'of Adjustment and Appeals. This issue was discussed at the regular meeting of the Planning Commission on October 4, 1~'94 . The Commission members acknowledge Iha!. there are a few properties in the City that iack motor vehicle access to the nar yard . The definition of "garage• was also consideffi!, and the majority opinion of the Commission is to not change this definition. It is the funbcr ma- jority opinion of the Commission that the proper venue for relief from the strict application of the provisions of the O!dinance is through the Board of Adjustment and Appeals.
