AN ORDINANCE AM'.:NDI NG THE WASTEWA1ER UTILITY ORDINANCE T ITLE 12,
CHAPTER 2, SECTION 2, SUBSECTION C; SECTION 3, SUBSECTIO N D AND SECTION 7,
OF THE ENGLEWOOD MUNICIPAL CODE 1985.
WHEREAS, the Englew City Council enacted the Wastewater Utility Ordinance No.
58, Se ries of 1991 and revi sions to th e Wastewater Utility Ordinance are necessary in order
to incorporate additional local enforcement a uthority; and
WHEREAS, the EPA requires the City to re-eval uate its di scharge limitation
requirem ents for Industri al Users every five years ; and
WHEREAS, loca l limits a re developed to co ntrol the level of pollutants which are
discharged from in dustries and wh ic h ente r into the sanitary sewer system and ultim ately
enter the Wa s tewate r Treatment Pl ant; an d
WHEREAS, the Wastewater Treatment Pl ant is regul ated by the Colorado Department of
Health and Environment and the EPA th rough the NPDES P< :mit; and
WHEREAS , the Wastewater Treatment Pl ant mu st meet s pecific standards which a re
outli ned in the N PDES permit; and
WHEREAS, improper imple mentation of the Pretreatm ent Program is a violation of the
Littleton/Englewood Wastewater Treatment Plant NPDES permit; and
WHEREAS, th e co n sequences of not impl ementi ng th e regulations could incl ude EPA
fi n ing the City up to $25,000 per day ; and
WHEREAS , setting local limits help s to protect worker h ealth an d safety, wa stewate r pl ant
processes, sludge and the receivi ng stream ; and
WHEREAS , th e EPA has revie wed and a pprove d the proposed amendments to the
Wastewater Utility Ordina n ce ;
NO W, THEREFORE , BE lT ORDAINED BY THE C ITY COUNC lL OF THE CITY OF
ENGLEWOOD , COLORADO , AS FOLLOWS :

Specific Pr ohibi tions.
I. lt is unlawful for any use r to co n tribute or cause to be contributea directly or
indirec tly , any pollu tant or wastewater which will interfere with th e ope ration or
performanc e of the t-C TW. These gen eral pro hibi tions apply to all such u sers of n
POTW , whether or not ,he u ser is subject t-0 National Categorical Pretreatment
St.r ndards or an y other ,ational 1 State or local pretreatment sta nd ards or
requirements. It is unlawful for any user to contribute the following substances to
any POTW:
a. Any hazardous waste as defined in 40 CFR 261 , UNLESS SPECIFICALLY
ALLOWED BY POTW.
b . Any liquids, solids, or gases which by reason of their nature or quantity are, or
may be, sufficient eith er al one or by interaction with other substances to cause
fire or ea:p losion or be injurious in any other way to the POTW or to the operation
of the POTW . At no tim e shall two (2) successive readings on any explosion
hnza rd meter, at the poi nt of discharge into the system (or at any point in the
system), be more th an fiv e percent (5%) nor any single reading ove r te n percent
(1 0%) of the Lawer Explosiv~ Limit (LEL) of the met.er . Fire or explosion hazard
may al so be determined using fla sh point co nce ntration, by closed cup method as
s pecified in 40 CFR 261.21. The flashpoin t sh all not be less than sixty dCb'l"ees
(60°) centigrade or one hundred forty degrees (140°) Fahrenheit . ~

WAIVERS MAY BE GRANT ED FOR CONTl l\'1.JOUS FLOW DISCHARGES
WHICH ARE MONITORED CONTI NUOUSLY BY AUTOMATIC
MONITORI NG EQUIPMENT. SUCH WAJVERS MAY BE APPLIED TO PH
EXCURS IO NS WHICH ARE ABOVE 10 PH UNITS AS SET FORTH IN THE
LITTLETON/ENGLEWOOD WASTEWATER TREATMENT PLA NT
POLICY FOR PH EFFLUENT LIMITATIONS UNDER CONTI NUOUS
MONITORING OR GRAB SAMPLE MO NITORI NG FOR CONT INUOUS
DISCHARGES . SUCH WAIVERS MUST ALSO BE IN COMPLIANCE WITH
ALL FEDERAL REGU LAT IONS AN D GUIDELINES.
e . Any wa stewater contain ing toxic pollutants in suffi cient qu antity , eithe r s ingly
or by in te ra ctio n with othe r poll utants, t.o injure or interfere wiLh any wastewa~r
treatm e nt process, co nsti tute a hazard to h uman s or an imals , crea te a tox ic e ffect
in the r eceiving waters of the POTW , to contaminot.e the sludge of any POTW
systems, or to ex ceed the lim itation set forth in a Categorical Pretreatment
Standard. A to xic pollu ta nt shall include, but not be limited to, any pollu tant
ide ntifi ed pursuant to section J07(a) of the Act.

f . Any noxious or malodorous liquids, gases, or solids whieh eit.her si ngly or by
interactfon with other wastes are sufficient to prevent entry into t.he sewers for
their mainte nance end re pair .
g. Any s ubstance which may cause the f-')TW,, effiuent or any other prod uct of the
POTW, s uch as r esid u es, sludge s, or scu ms, to be unsuitable for reclamation and
reuse or to tnte rfe-re with the reclam ation proc ess where the POTW is pursui ng a
rell!e a nd reclamation program . In no case shall a substance di scharged lo th e
POTW cause the POTW to be i n noncompliance with the sludge u se or disposal
cn te ri a, guidelines, or regul atio ns affecting sludge use or di sposa l.
h . Any s u bstance which "i ll ca u se the POTW to violat,, its NPDES permit or the
rec eiving wetu ~u.ality sta ndard s .
i. Any wastewater w 1th objectionable color not removable in th e treatment process,
s uch as, bu t not. limited to, dye wa stes and vegetable tanning solutions .
j . Any pollutants, incl ud inr oxyge n de manding po llutants (BO D, etc.) wh ich a
u ser kn ows or has reasfl,1 to know wi11 cause interference to the P~V. In no
ca se shall tJ slug lo ad 1,ave a flow rate or co ntain concentrations or quenLiti es of
pollutants that exceeJ for a ny ti me pe riod longer tha n fifteen (15) m inutes more
than five (5) times the average twenty-four (24) hour concentration , quantities, or
fl ow during normal operation .
k . Any wastewater co ntaining any radioactive wastes or isotopes of such ~al flife
concentration as may exceed limits establish ed by the Director in co mpliance
with applicable Stat,, Rul es and Regulations Pertaining to Radiological Co ntrol ,
published by the Colo rado Departmen t of Health, State of Colorado .
I. Any wastewater which causes a hazard to hu man life or creates a public nuisance
and is not contai ned in the wastewater system .
m . Any wasuowauor h avi ng a t,,mperatur e whi ch will cause the temperature of the
influent to the wastewater trea tment plant to exceed one hundred four degrees
(104 °) Fahrenheit or forty degrees (40°) centigrade and/o r inh ibit the biologi ca l
acti"ity in th e POTW.

solidify or become di scernibly viscous at temperatures between thirty.two degrees
(32°) F. (0 ' C.) and one hundr ed finy degrees (150°) F. (65.5° C.).

t. Any wastewater containing BOD, COD, total solids, or suspended solids of such
character and quantity that unusual attention or expense is req uired to handle
such materials at the wosttwater treatment plant; provided, however, th at a user
may be permitted by specific, written agreement with the POTW which
agreement to discharge such BOD , COD or TSS may provide for s pecial chnrges,
surcharges, payments or provi sions for treati ng and testing equipm e nt.
u . Ammonia nitrogen or substances readily converted thereto, in amounts that·
would cause the POTW to fail to comply with its NPUES pe rmit.
2. Any material or substance not specifically me ntioned in this Section wh ich in
it.self is corrosive, irritating, or noxious to human beings and animals, or which by
interaction with other water or waste in the public sewer syste m could produce
undesirable effects or crea te any other condition deleteriou s to struc tures, treatment
processes, and quantity of the receiving strea m, is ill ega l.
3 . Any material or substance entering in to the public sewer which in t erfe r es with the
Lreatment process even if h. is wilhin the concentration limitations stated in S ection
12-2-7 may be prohi bited upon written order by the Director.
Sfl:tilm..2 . The En glewood City Counci l hereby approv es the amen dm ent to Title 12 ,
Chapter 2, Section 3, Subsection D, of the Englewood Munic ipal Code which shall read as
fo llows :
12 -2-3-D . If any water or wastes are discharged, or a , e proposed to be discharll"ed to the
public sewers, which waters contain the substances or possess the
characteristics enumerated in subsectio n 12 ·2 ·2B abo \o·e and , in th e judgment of
the Director of Uti lities, may have a deleterious effect upon the sewage works,
procesne s, equipment or receivi ng waters , or which oth erw ise CTe ate a hazard to
life or constitute a public nu isanc e, the Director sh all also charge the following
fees and tak e such enfo rtem ent action in acco rdance with Section 12-2 -6 of this
Ch a pter as the Direc tor de ems advi sa ble .
Require payment to cover the added cost (SURC HARGE) of handling and
tr eating the wastes considered as "i nd ustrial wast.es", by imposi ng the
fo llowing formula :

The applica tion of the above formula provi des fo r a s urcharge for BOD, COD and
for SS. If the strength index of BOD, COD, or SS is less than the base number that
is being subtracted from it, then there shall be no surcharge for that particular
category, nor shall there be a credit given to the total surcharge.

BACKGROUND, ANALYSIS, AND ALTERNATIVES IDElmFIED
• The Environmental Protection Agency requires that the lr.dustrial Pretreatment Program be regulated by the
Wastewater utillty Ordinance. The City must re-evalu110 Its dls.:harge ilmltatlon requirements for Industrial
Users every five years . The new !imitations are required to be lncolJJO(llted Into the Wastewater Ordinance .

The local limlts are developed to control the level of pollutants which are discharged from Industries and enter
Imo the sanitary sewer system and ultim91ely enter the wastewater treatment plant. The wastewater treatment
plant is regulated by the Colorado Depar,ment of Health and Environment and the EPA by the NPDES permit.
The plant must maet specific standards which are outlined In the NPDES permit . Setting local llmlts helps to
protect 'NOrl<er heallil and safety , wastev,ater plant processes, sludge and the receiving stream .
The EPA has received a copy of the amendments proposed by the City of Englewood , public noticed the
changes , and approved t he proposed amendments. Improper Implementation of the Pretreatment Program is a
violation of the l1E 'NWTP NPDES permit. Consequences of not implementing the regulations could include
EPA fining the City up to $25 ,000 per day .
FINANCIAL IMPACT
There will be no direct financial impact on the City by adopting the proposed amendments to the Wastewater
Utility Ord ina nce .

The Linl eton amend ments reflect those already submined for your review in the form of the Englewood
ordinanc e. Toe only revisi on is the silver limit which bas not been redeveloped. As we discussed on the •
telep hon e on October 13 , your department is cll ow'.ng the Linleton/Englewood Pretreatment program to
keep the current silver limit. This limi1 will remain effective until the state makes a final rule concerning
the sil \'er chronic stream standard . At th at tim , we will again review the silver !imit .
The Cities will be publi c noticing the proposed ordinance amendments and local limits as they hav~ been
!11bmined to your department. Please contact me when the EPA public notice period is over so ,hat we
may submit our amendments to both City councils .
