AN ORDINANCE AMENDING TITLE 4, CHAPTER 7, SECTION 11 OF THE
ENGLEWOOD MUNICIPAL CODE 1985, TO EXTEND THE LIMITED WAIVER OF
WASTE TRANSFER SURCHARGE TO DECEMBER 31, 1998.
WHEREAS, with the passage of Ordinance No. 30, Series of 1993, the Englewood City
Council authorized a limited waiver of waste transfer surcharge until December 31, 1995 for
certain municipalities; and
WHEREAS, the City of Englewood has received requests for waiver of the surcharge from
Littleton and Sheridan for their annual clean.up programs; and
WHEREAS, this amendment will extend the limited waiver of waste transfer surcharge to
December 31 , 1998;
:-IOW , THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO , AS FOLLOWS :
~-The City Council of the City of Englewood , Co lorado he, eby approves amending
1'itle 4, Chapter 7, Section II of the Englewood Municipal Code to read as follows :
4-7-11: LIMITED WAIVER OF SURCHARGE: The requirements of this Chapter shall not
apply during the months of May, June, July, August and September to any Municipality
which meets the following criteria:
A . Incorporated with City Hall within the boundaries of Arapahoe County.
B . Does not provit > Municipal collection of household solid waste directly or
indirectly.
C . Offers to its cit.zens the collection of household t,·ash on a limited basis during the
months of May, June, July, August and September.
This Section s hall be effective only until December 31, Hl9e 1U98, after which time it shall iie
n ull and void witho ut further action of the City. (Ord. 30 Series 1993)

Series of 1993 auth orizing a limited waiver of waste tra nsfer surcharge until December
3 1.1995.
RECOMMENDED ACTlON
Staff recommends exte nding the waste :ransfer su rcharge until December 31 , 1998 (three
• summer seasons ).

BACKGROUND, ANALYSIS, AND ALTERNATIVES IDErlTIFIED
The City of Englewood passed Ordinance 25, Se ri es of 1987 on April 20, 1987 in sti tut ing the
W aste Transfer Surch3rge. The Surcharge imposes a twenty cent surcharge on each cubic
yard or portion thereof by each perso n disposing Jf trash at a wa ste transfer facility. The
defi niti on o' "person" in the o rdinance includes poli tical subdiv is ions of the State of Colorado.
The City of Englewood has recei ved requests for wai ver of the surch arge for public purposes.
Eng lewood, Littleton , and Sh erida n have requested waivers for th e ir annual "clean-up"
programs. The City Council of Englewood ap proved Ordinance 30, Series of 1993 to
app ro ve the waiver of th e surcharge. The wai ver sun sets on December 31 , 1995 so the
waiver must be extended at this time for th e 1996, 1997 , and 1998 annual cleanups.
FINANCIAL IMPACT
The w a iv er will reduce potenti al revenues by an estimated $1 ,000 ann ually.
