AN CRDINANCE AUTHORIZING AN EXTENSION OF THE CURRENT TELEVISION
SYSTDI PERMIT.
WHEREAS, the Englew ood City Co un cil a pproved Ordinance No . 4, Series of 1980
a uthorizing the current Cable Television System Perm it which expired April 6 , 1995; and
WHEREAS , Coun cil approved Ordinance No . 38, Series of 1992 whi cl, authorized entering
into an intergovernmental agreement for Greater Metro Cable Consortium to negotiate a
ne w agreement; and
\VHEREAS, the authorization of this Ordinance shall approve exte:n s ion of the f"Urrent
Cable Televi sion System Perm it on a month -to-mo nth basi~ until th e new agre ement is
fi na lized :
NOW . THEREFORE , BE IT ORDAINED llY THE CITY COUNC IL OF THE CITY OF
ENGLEWO OD, COLORADO , AS FOLLOWS :

of the current Cable Television System Permit on a month-to-month basis until the new
agr eemen t is finalized.

RECOMMENDED ACTION
Staff seeks Council Adoption , by ord inance, for extension of the current Cable Television
System Permit on a month-to-month bas is.
BACKGROUND, ANALYSIS, AND AL TERNi ~ TIVES IDENTIFIED
Th e City 's current Cable Television System Permit e){pired on A pri l 6th , 19 95.
In 19 92 the City entered into an intergovernmental agreement , the Greater Metro Cable
Co nsortium . During 1992, the Consortium began negotiating w;th TCI on a "Model Franchise
Agreement." The Model Agreement wou ld then be used by all the meniber cities as a sta ning
point in the ir own negotiations with TCI.
While the Model Agreement is close to completion, it still not al a point where Staff
recommends entering into negoti'itions with TCI. Staff recommends extending the current
Permit on a month-to-month basis until such time that a new Franchise Agreement is
completed .
FINANCIAL IMPACT
There are no significant changes anticipated in revenue between our current Permit and the
new Franch ise Agreement.
Without extending the current Perm it, TCI could be forced to cease operations . This would
eli m inate cable services to those citize ns who subsc ri be and in tum would stop Franch:~e
Fees from being collected by the City .
