In t.~e event the placing of t.~e centerline markers and the clearing and restoration of the crossing area is not completed wit.~in the t i me specified, the City may complete t.~e worx at the sole expense of the Licensee. 4. The City shall have the right to maintain, install, repair, remove or relocate the City Ditch or any other ot its tacililties c= installations within the City's rights- of-way, at any time and in such ma."'l?ler as the ~ity deems necessa..-y or convenient. All tre~ches or holes w~thin ti1e City 's rights-ot-way sha_l be backfilled and tamped to the original ground line in layers not to exceed six (6 ) inches loose measure to a compaction of ninety per cent (90%) Standard Proctor Maximum Density. • • • 10. Lice.,see, by acceptance of, this license, expressly assumes full and strict liability for any and all damages of every nature to person or property caused by water from the ditch leaking through the ditch banks or pipeline at tile point or points where the Licensee per!orms any work in connection with tbe crossing provided by this license. RECOMMENDED ACTION The Utilities Department recommends Council approval of a bill for an ordinance approving the License Agreement between the City of Englewood and The King C. and Evelyn Leigh Hudson Foundation BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED A request was made by the King C. Hudson Foundation for a License Agreement for a diversion gate structure and pipe to be placed on the City Ditch . The diversion gate is proposed to be installed on the C ity Ditch at the Duker Subdivision, bounded on the west by the Denver and Rio Grande Railroad rig ht-Of-way, on the north by Ridge Road and the east by the Columbine Vista Subdivision. · The Hudson Foundation purchased water rights on the Ditch from the Mill thaler Estate for the purpose of providing water for landscaping and a greenhouse. They are moving the headgate from the A llen Filter Plant to Ridge Road , on the C ity Ditch . FINANCIAL IMPACT None .
