S INTRODUCED BY COUNCIL MEMBER WIGGINS AN ORDINANCE A.\iENDING TITLE 16, CHAPI'ER 4, SECTION 10, PARAGRAPH C, AND TITLE 16, CHAPTER 8, SECTION 1, OF THE ENGLEWOOD MUNlCIPAL CODE 1985 TO SPECIFICALLY ALLOW SMALL ANIMAL HOSPITAlS OR CLINlCS AS A PERMITTED USE IN THE B-1, BUSINESS DISTRICT IN THE CITY OF ENGLEWOOD. WHEREAS, the currently zoned B-1 Business District permits a variety of medical uses as well u pet stores; and WHEREAS, allowin1 small animal veterinary hospitals or clinics would not have a significantly different impact on the neighborhood or community; and WHEREAS, this matter was previously brought to the Planning and Zoning Commission as a modification to the R-3 Zone District; however, the veterinary clinic requesting this change was not able to close on the property in the R-3 District; and WHEREAS, this amendment to the Comprehensive Zoning Ordinance was considered by the City of Englewood Planning and Zoning Commission at a Public Hearing on December 5, 1995; and WHEREAS, after the Public Hearing, the Planning Commiaaion recommend approval of the amendment to the Comprehensive Zoning Ordinance to allow veterinary hospitals and clinics for treatment of small animals in the B-1, Business District ; NOW , THEREFORE, BE IT ORDAINED BY THE CITY COUKeIL OF THE CITY OF ENGLEWOOD, COLORADO, AS F0LLOWS: ~-The Englewood City Council hereby amends Title 16, Chapter 4, Section 10, Paragraph C, of the Englewood Municipal Code , 1985 to allow small animal hospitals or clinics BB a permitted use in the B-1 Business District in the City of Englewood, Colorado. The provisions found in thia Zone District ehall be subject to the requirement■ and standards found in Section 16-5, General Regulations of thia Title, unleeo otherwiae provided for in this Ordinance or an amendment hereto. B . Planned deve lopment compliance. Any lot having on e or more acres in thia district ehall comply with the Englewood Municipal Code Section 16-4-15 O'hnned Development Diatrict). C . No building, structun,, or lond shall be used and no building or structure shall be erected, structurally altered , enlarged or maintained ,mlees otherwise provided for in this Ordinance ei:cept for one or more of the following uses: 1. J.tECOMMENDEQ ACTION: Staff recommends City Council approve Bill for Ordinance on First Reading . BACKGROtTNJl; Dr. Tankersley owns and operates the Hampden Family Pet Hospital at 1220 East Hampden Avenue . Th e veterinary practice has outgrown the current location . To continue to serve his client b>.se , Dr . Tankersley wanted to find a site near the present loca tion. Dr. Tankersley has located a site in the B-1 Tone District which meets the needs of the veterinary practice . How - ever , the B-1 Zone District does not allow veterinary hospitals or clinics. Dr. Tankersley has requested that the B-1 Zone District be amended to allow veterinary hos pitals and clinics for treatment of small animals as a permitted prin cipal use . f]NANCIAL IMPACT: The Ordinance amcn<1ment, when approved, will allow the Hampden Family Pet Hospital to relocate to a sit.e within the general vicinity it now occupies, and facilitate expansion of the veterinary practice .
