AN ORDINANCE AMENDING TITLE 12, CHAPTER IB, SECTIONS 2 AND 6, AS
WELL AS CHAPTER ID, SECTIONS 4 AND 5, OF THE ENGLEWOOD
MUNI C IPAL CODE 1985 REGARDING MISCELLANEO US WATER SERVI CE
FEES .
WHEREAS , the prop osed amendm ents will res ult in increasing the charges fo r
miscellaneous water service fees in the City of Englewood; and
WHEREAS, the proposed fee increases will help the Utilities Department lower
the number of de linqu ent accounts and recover the actual costs of services
rend ered; and
WHEREAS , the Engl ewood Water and Sew er Board reviewed these amendments
at the ir January 9 , 1996 meeting and recommend adoption of the amendments;
NO W, THEREFORE, BE IT ORDAINED BY TIIB CITY COUNCIL OF THE CITY
OF ENGLEWOOD, COLORADO, AS FOLLOWS :

2 of the Englewood Municipal Code, 1985, which shall read as follow s :
12-IB-2: TAPPING AND C UTTING OFF MAINS:
A. The tappi ng of any main fo r the purpose of making a connection shall be don e
only by th e Vl11t:er E>i isien CITY and at th e expense of the applicant. The
corporati on valve inse ned in the main and the service pipe to be laid must be
of the size s pecified in th e permit.
B. The cutting off from mai ns may be pe rformed by ei ther a li ce nsed an d bo nded

AND PAYABLE FROM THE APPLICANT . IF AN ABANDONED WATER
SERVICE IS NOT DI SCONNECTED AT THE MAIN IN A TIMELY

6 of the Enctewcod Municipal Code, 1986, which ■hall read u follows :

Every owner of property using water shall provHe a curb st.op with ,...,,d ole,.,, "'
A BAIJ.. VALVE on the service pipe outside of his premises and protected by a st.op
box, by means of whi ch th e water may be turned on or off from the premises by any
employee9 of the Wale, Eli ioion CITY, and shall maintain the same in good
working order . The stop box shall be so maintained that al all times it will be
conveniently accessible in good order for turning water on and off with the cover at
the level of the adjacent ground. IF CITY PERSONNEL ARE REQUlRED TO
CLEAN OUT A PROPERTY OWNER'S STOP BOX, FOR WHATEVER REASON,
EITHER AT THE REQUEST OF THE PROPERTY OWNER, FOR AN
EMERGENCY OR FOR A DELINQUENT TURN-OFF; A FEE OF THIRTY
DOLLARS ($30.00) SHALL BE DUE AND PAYABLE BY THE PROPERTY
OWNER AND SHALL BE BILLED TO THE PROPERTY BY THE CITY WITHJN
TlflRTI" (30) DAYS AFTER THE SERVICE HAS BEEN PERFORMED .

Section 4 of U,e Englewood Municipal Code, 1985, which shall read as foli,w s:
12-lD-I: DELINQUENTWATERBILLS:

days .ifttt the uate of billing AND SHALL BE ASSESSED A TEN PERCENT (lu%)
L\TE FEE. Water is subject to turn-off without notice whenever a bill therefor has
becoml' delinquent: provided that the Weter E>i ,;.9ien-CITY shall give a five (5)
workinr day written notice before actuall y turning off water for nonpayment. Such
notice sLall be effected by personal service or certified mail or registered mail .
return receipt requested. to the owner or occupant of the premises for which the
charge is due. The obligati on to pay promptly for water service is not in any way
affected by failure of the owner or occupant of the premi1,es served to receive a bill
for the service.

REPRESENTATIVE VISITS A PREMISES TO TURN OFF THE WATER FOR
NON-PAYMENT. THE CITY IS AUTHORIZED TO CHARGE FIVE DOLLARS
($5 .00 ) FOR SERVICES RENDERED WHEN A CUSTOMER SERVICE
REPRESENTATIVE VISITS A PREMISES TO DELIVER A TURK -OFF NOTICE .
