SOUTH OALAPAOO STREET AND THE DEDICATION OF ADDITIONAL ALLEY
RlOHT·OF·WAY, LOCATED IN THE CITY OF ENGLEWOOD, COUNTY OF
ARAPAHOE, STATE OF COLORADO .
WHEREAS. the City of En,lewood bu N!Celved a reque1t from the Englewood Hlmrical
Society to vacate a portion of an alley in the 3000 block of South Fm Stnot and the South
Galapago Street Alley between Weot Cornell Avenue and Weal Dartmouth Avenue;
WHEREAS, the aubjecl aite ii localed in the area bounded by South GalaJtago Street on the
west; West Cornell Avenue on the north; South Foz Street on the eut, and Weal Dartmouth
Avenue on the south ; and
WHEREAS, with the passage of Ordinance No. 58, Series of 1993, the Englewood City
Council approved the requested rezoning from R·2, Medium Density Reeidence, to R-4 ,
Rcsidential/Profe&1ional, to facilitate the relocation of the old Englewood Depot; and
WHEREAS, the acljacent area i• composed of single-family and multi-family
residences ; and
WHEREAS, Cushing Park is located immediately south to the subject site; and
WHEREAS, the vacation was requested by the Englewood Hiltorical Society to facilitate
the redevelopment of the Eni.iewood Depot which was relocated in 1994; and
WHEREAS, the vacation request is only for the west leg of the T-lhaped alley in this
block; and
WHERE;.$, the Englewood Historical Society owns the property 011 both aides of the
prcposed vacation ; and
WHEREAS, the vacation of this portion uf the alley will allow for a more efficient
parking layout for the Depot as well as aliow the parcel to the north of the proposed vacation
to be utilized for off-street l'"'"'"c ::,J to prov;de a landscape buffer between the Depot and
adjacent residential use11; and
WHEREAS , the remaining east/west portion o.( the 'T" alley is only 12 .5 feet wide,
additional right-of-way will he required; and
WHEREAS, the Engl ewood Housing Authority owns this property and has agreed to
make the neces,ary dedication of 7.5 feet along U,e north side of Lots 25-30, Block 2,
Taylor's Addition to accomplish this; o.nd
WHEREAS , the vacation is only for a portion of the alley; end
WHEREAS , traffic circulation will n ot be impaired beca u se the east leg of the alley will
re main intact; and

WHEREAS, the Englewood Planning and Zoning Commiaaion reviewed the propooed
vacation at a meeting held on January 4, 1994; and
WHEREAS, the Englewood Planning and Zoning Commiuion recommends the
v acation request of the Englewood Hiatorical Society be approved with the condition that the
C,'ity retain a utility easement for the mating 8" sewer line in the vacated alley and lo
accept the dedication by the Englewood Houeing Authority of additional right,.of.way for
alley purposes;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, AS FOLLOWS:

Thal portion of an eut-west alley acljacent lo Lots 19 through 25, Block 2 Taylors
Addition , from the eul right-of-way of Galapago Street lo the west right-of-way line
extended of the north-10uth alley in said Block 2, City of Englewood, County of
Arapahoe, Colorado.
~-The City of Englewood will retain an eaaemenl for the existing 8" sewer line in
this portion of the alley, such easement will -over the entire portion of the "acaled alley.
~-The following d escribed portion is aa:epted as an additional right-of-way for
alley purposes:
A portion of Lots 25 through 30, Block 2, Taylor's Addition, City of Englewood,
County of Arapahoe, State of Colorado, more particularly described 01 follow s :

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
This bill for an ordinance would submit to the registered voters of the City of Englewood a ballot
questi on requestin g issuance of $8 ,850,000 of bonded debt to finance improvements to the City's
water system . Although water rates are planned to be used for debt service, the full faith and credit of
the C~y will be pledged for repayment of the general obligation debt. The Water and Sewer f\lJ ard
has discussed th is issue, as has Council at the June 10, 1996 study session.
RECOMMENDED ACTION
Staff recommends Council approve the attached bill for an ord in ance submitting to a vote of the
registered voters of the City of Englewood to issue debt. If the ballot initiative is successful it will
result in substantial savings to water users .
BACKGROUND, ANALYSIS , AND ALTERNATIVES IDENTIFIED
The C ity of Englewood Charter requires a majority affirmative vote of the registered electors to issue
general oblig<1 tion debt (Article X , Part Ill, Section 104). The passage of Amendment 1 (TABOR)
requ ire s the use of tightly constructed language in the ballot question .
City staff, Council, an d the Water and Sewer Board all agree that this is a much needed project . The
project will go forward regardless of the outcome of the vote-revenue bonds will be issued if this
ballot initiative is not successful. An affirmative vote on th is questio n and issuance of general
obligation debt may reduce or even el iminate the need for the final eight percent water rate increase.
An alternative fund ing mechanism is available-re ve nue bonds. The fu ll faith and credit of the City is
not pledged , but this a more complex and expensive alternative . If this ballot issue is not successful ,
the project will be funded in this manner.

Prevjous Planning Commission Action : On January 4, 1994, the Planning and Zoning
Co mmission considered the vacation request of the subject alley and voted to recommend to City
Coun cil that the proposed vacation be approved with the retentio n of a utili ty easement in the
vacated alley. In a separate , but related action , the Planning and Zoning Commission , on
December 2. 1993 , approved the rezoning on the property adjacent to this proposed all ey
vacation . The purpose of this rezoning, from R-2 , Medium Densi ty Resi denc e Distri ct to R-4 ,
Residential/Professional District. was to allow for the relocation of the Englewood Depot.
Previous Council Acti on: On December 4, I 995 , City Council ditccted Staff to amend the
proposed all ey dedication to provid e additional rig ht-o f-way fo r the remaining east leg of the
alle y. City Council acting on the recommendation of the Planning Commission, approved th e
rezoning of property to pennit the relocation of thr. Englewood Depot by Ordinance Number 53,
Se rie s of 1993.
RECOMMENDED ACTION:
City Counci l is requested to appro ve a Bill for Ordinance on first rs:ading to vacate a portion of
the alle y in th e 300 0 block of South Fox Street/South Galapago Street, retai n an easement on the
vacated portion for utilit y purpo ses and to acce pt the dedication of additional right-of-way for

The propoted vacation is being requested to faciliwe the redevelopment of the Englewood
Depot which was relocated in 1994 to property adjacent to the subject alley . The vacation
request is only for the west leg of the "T"-alley in this block . The Englewood Historical Society
owns the property to the south of the proposed vacation where the Depot building is located and
a SO foot wide parcel immediately north of the proposed vacation . The vacation of this portion
of the alley will allow for a more efficient parking layout for the Depot as well as allow the
parcel to the north of the proposed vacation to be utilized for off-street parking and to provide a
landscape buffer berween the Depot and adjacent residential uses.
Since the remaining cast/west portion of the "T' alley is only 12 .S feet wide, additional right-of-
way will be required to make it the same width as the north/south portion . To accomplish this , a
dedication of 7.5 fee t along the north side of Lots 2S-30, Block 2, Taylor 's Additio n will be
ne essary . This property is owned by the Englewood Housing Authority which has agreed to
make the necessary dedication.
FINANCIAL IMPACT;
The proposed alley vacation and right-of-way dedication will not have a direct financial impact
on the City . If however, the proposed action is not taken by the City, the viability of the depot
project could be impacted as a result of the loss of the required off-street parking space that is

proposed to be located in the area of the vacated alley. This would decrease the value of the •
development and result in reduced revenue to the Historical Society and ultimatel y to the City.
