JS (NAVAJO ) IN THE CITY OF ENGLEWOOD, COLORADO; APPROVING AND CONFIRMING THE APPORTIONMENT OF T HE COST TO EACH LOT OR TRACT OF Lo.ND IN SAID DISTRICT; ASSESSING A SHARE OF THE COST AGAINST EACH LOT Ort TRACT OF LAND; AND PRESCRIBING THE MANNER FOR THE COLLECTION AND PAYMENT OF THE ASSESSMENTS . WHEREAS, by Ordinance No.17, Series of 1992, pa88ed on final reading and adopted on Apri l 20 , 1992, the City Council of the City of Englewood , Colorado, hu created Paving Di st rict No. 35 (Navaj o), within the City for the pur;,ose of conatructing and installing paV1 ng1 curb , gutter , and sidewalk improvements, together with necessary incidental, on a certain street within the Diatrict; and WHEREAS , the improvement.a authorized by said ordinance have been started and are anticipat to be completed in 1997 , and the total cost of such improvement.a have been reliably ascertained ; and WHEREAS . an assessment roll has been prepared and a statement showing the total cost of the improvements has been duly filed with the City Clerk; and WHEREAS , from the stau,ment made and filed , it appP.ars that the tot.al cost of the improvements t o be conatructed and ~ed within the District shall be $5,400,000.00, of which amount $506 ,297 .87 , is being asseased against the real property within the District; and WHEREAS, sA.i d assessments are based on actual assessment costs from construction in 1991 as published April 9, 1S~2 . in the Ordinance No . 17 , Series of 1992 fo rming the Di strict; a nd WHEREAS , the Gity Council has apportioned a share of the total co,ts to each lot or tract of land within the District, in accordance with the benefits to be derived ,y s aid property and in the propo rtions and amounts severally set forth in "Exhibit A" attached to this Ordinance; NOW , THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO , AS FOLLOWS · ~. !&Dfirmetion of Assessm ent Roll. The apportionment of the assessmen ts is hereby approved and confirmed . Said epportionment is hereby decl ared to be in accordance with the special benefits which the real property in the District will r eceive by reason of the cons truci:ion and in stallation of the improve ments . A share of said cost is hereby assessed to and upon each lot 01· tract of land within the District in the proportions and amoun ts as bet forth in th e assessment roll , attached hereto as "Exhibit A". f3 etlli2Jl..2.. fm1ent of Aasessmcnt s -The assessments shall be du e and payabl e at the offi ce of t1 1e Di rector of Finance of the City, on or before November 8 , 1996, in accordance with Secti on 11 ·2•7(C) ofth<· Engl ewood Municipal Cod e; provided that all such assessments may be paid . a t 1.h c e lecti on of t he property o\\'ller, in install ments , with inte rest as heTe inofter set -1- forth . An allowance of 5'll> ahall be made on all paymenta of uae11menta mada on or before October 21, 1996, but not thereafter. • • Failure to pay the whole &Yfflment on or before November 8, 1996, shall be concl1•sive ly considered and held an election on the part of all persona interested, whet.her under disability or otherwise, t,, pay in installments. Additionally, such election shall be conclusively considered to be a waiver of any right to question the power or jurudi:tion of the City to construct the improvements, the quality of the work, the regularity or sufficiency of the proceedings, the validity or the co!TI!Ctnees of the usesaments, or the validity of the lien thereof. In the event of an election to pay in installments, the auessments shall be payable at the office of the County Treasurer of Arapahoe County, Colorado, in ten (10) equal annual installments of principal, the first of such installments of principal shall be due and payable on or before the 1st day of January 1997 . The remainder of the installments shall be due and payable successively on or before the lit day of January in each year thereafter until paid in full . The tenth and last installment ■ball be due and payable on January l, 2006. interest on the unpaid principal amount s hall be at the rate of six and one-half percent (6.5'll>) per annum, commencing on the day following the fin,t installment due date, and payable each year at the time of paying instal lments of assessments. The owner of any property not in default as to any installment or payment may, at any time, pay the whole of the unpaid principal with accrued interest to the date of the next assessment installment payment date. ~-Penalty for Default or Nonpayment. Failure to pay an)' installment, whether of principal or int<!rest , when due shall cause the whole of the unpaid principal to beco me due and payable immediately. The whole amount of the unpaid principal and accru ed int<!rest shall thereall,,r draw interest at the rate established purauant ro Section 5-12· 106(2) and (3), C.R.S ., until the date oftu sal e, as provided by law. At any time prior to the • date of the tax sale, the owner may pay the amount of all unpaid installments with interest at the pe nalty rate ofone percent (l 'll>) per month or fraction of a month, and all penalties and costs of collection accrued , and shall thereupon be restored ro the right thereafter to pay in in stallm en ts in the same manner as if default had not been suffered . ,~. As~essmeot Lien · Recordotion . All assessments levied against the real prop arty in the District, together with all interest thereon and penalties for default in payme nt theceof, and all costs in collecting the same, shall constitute, from the d•te of the final p ublication of this Ordinance, a perpetual lien in the several amounts assess ed against each lot or tract of land . Such lien shall have priority over all other liens except general tax liens and s hall be enforced in accordance with the laws of the State of Colorado. Pursuant to Section 31-25-522, C.R.S., a copy of this Ordinance shall be filed with the Co unty Clerk and Recorder of the County wherein each lot or tract of land a88essed is located, for reco rd ing on the land recordd of such· lots or tracts of land , ond copies of thi.c, Ordinance shall also be filed with the County Treasurer and the County Assessor. Section 5 Assessments Aroinst Divided or Subdivided Tracts . If any tr ,ct of real property included within the District is hereafter divided or subdivided into two < r more s u ch tracts or parcel s, the Director of Finance, with the assistance of the Director of Public Work s, is hereby authorized and directed to divide the assessment against such tract in the same proporti on that the tract itself is subdivided into two or more such parce ls, and to ce rtify th e revised ass essments to the Co unty Tl:easurer . 5f.'1iAn....6 Se ve rability . RECOMMENDED ACTION Adept a bill for an ord inance establishing assessments fo r Pav ing District 35 (Navajo St). Approve property owner notification of assessments and dP'e for a public hearing on assessments . BACKGROUND, ANALYSIS , AND ALTERNATIVES IDENTIFIED • Reso.ubon No . 9, Se ries of 1992. declaring the intent to create Paving District No . 35 (Navajo St) and establi shing a public heari ng on the formation of Pav ing District No . 35 (Navajo St) was adopted and approve d on F· ,tiruary 3, 1992. The public hearing on formation of Paving District Ne 35 (Navajo St) was held on March 9 . 19~2. Ordinance No . 17 . 1992. creating Paving District No . 35 (Navajo St) was passed April 20 . 1992. • The purpose of this Improvement District was for the construction and in sta llation of street pav ing . and removal and replacement of curb , gutter . and sidewa lk to meet City standards . together with necessary incidentals. on certam streets and avenues within the City . Construction by the Colorado Departmen t of Tra nsportation has started and 1s anticipated to be co mpleted b·, late 199 FINANCIAL IMPACT COOT is the ma jor contrib uto r to the fund ing on this project with approximately $5,400 ,000. The City is responsible for appro ximately S600 ,000 , of which $511 ,221 .62 will be recovered th rough assessments to ad jacent property owners . The rema ining (approximately $89,000) 1s the City 's responsib ility and are ava ila ble in mon ies budgeted in the PIF . Due to co ntractual arrangements with COOT . tnv City 's $500 ,000 commitment to the Navajo project will be applied instead to the upcom ing Santa Fe landscape project . to which COOT had previou sly committed a S500.000 expe ndnure.
