ENGLEWOOD MUNICIPAL CODE 1985 PERTAINING TO LIFE-SAFETY
REQUIREMENTS FOR EXli,TING HIGH -RISE BUILDINGS .
WHEREAS, EngleWOO<I hae two bank building&, both ten etoriea in height,
which have concerned the Fire Prevention Bureau and the Building Division for
years ; and
W1iEREAS , neither building ie fully equipped with a sprinkler system and
both have eerioua life-eafety violation• while the bigh-riee buildinge that are
constructed today have standard• which meet these life-eafety iseuee; and
\VHER.EA.<;, the Uniform Building r;o~e (U .B.C.) ae well ae the National
Fire Protection As!,"C iation (N.F.P.A.) have performed numerou s s ~udies resulting
in the development o,' Appendix Chapter 34 of the U.B.C., which allow for certain
alterations to be penlit."'led ; and
WHEREAS, with U•e paseage of thie ordinance the City will be able to bring
the previously constructed high rise building& into a r easonable degree of
compliance with tho current U .B.C. with respect to sprinkler system retrofit, fire
alarm ByBlems , communication equipment, e:rit lighting and various other eafety
items;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ENGLEWOOD, COLORADO , AS FOLLOWS :

111-B , 111-C, IV -A, IV-B , V-A , VJ -A, VJ-B , VJ -C, VJ-D , VI -E, VJ-G published by the
International Fire Code Institute, 9300 Jollyville Road , Suite 105 , Austin, Texaa
78 759-7455 , subj e<:t to exceptions , modifications and amendments as set forth in
Se<:tion 8-2E-2 of this Article.

provision of the Code of the City ol Englewood t-y thiJI Ordinance ah.U not release,
extinguish, alter, modify, or change in whole or in part any penalty, forfeiture, or
liability, either civil or criminal, which shall have been incuned under 1uch
provision , and each provi1ion ahaJJ be treated and held aa still remaining in force
for the purpooea of s ustaining any and all proper actions, suits, proceedings, and
prosecutions for the enfon:ement of the pe~!tlty, forfeiture, or liability, as well as for
the purpose of sustaining any judgment, decre•, or order which can or may be
rendered, entered, or made in such actions, s uits, p roceedings , or prosecutions.

Dear Jim :
I'm in receipt of your letter dited May I 5, I 996 regarding the City adopling the 1994
Unifonn Building Code for Life -Safety . This will ie quire S1Jbstanti:,I work and rmofit
for 3333 So . Bannock St . to comply with the :-.It Alarm and Fin: Spnnkler System
requirements .
We wiU ccruinly comply with what= the Ciry of Englewood imp~ments and arc in
favor of upgrades to our life-safety system to mttt current code . We hope that the City
will work with us to help older buildings reasonably adopt and adapt to the proposed
rules . In many cases. the way the building was constructed and the existing
infrastructure of this configuration make confomtit,· complex . expensive and difficult ( on
the owner and tenants). We believe we can reasonabiy :id~ere to new regulations with
our mutual resolution and documenutlon of th'JSc challenging areas. For ownple. we
presently have ~ water riser supponed by a pressun, pump in a fire doset en every floor .
We believe and hope this infrastructure is of sufficient size and qualiry to be expanded
to meet the sprinkler requin:ments on ach individual floor. Similar situations will occur
concerning the elevators. fire stairs. elevator rooms , mtchani~ roums and the existing
fire panel , life-safety and security systems in place at the propcny.
We would welcome the opponunity to participate and add suppon to your proposal for
ado ption in your study sess ion with council and work toward mutually bendiaal new
regulations .

It was a pleasure to meet with you and the other representatives from the City of
Englewood on July 17 . 1996. I did receive your e-ma.il message of the same date and
it is my understanding that Mr. John Kikol w ill be wriling a letter to the City Manager
as described . •
From our meeting of July 17th, it was my understanding that Ms. Susan Stiffler with
Cleve Trust's Denver office , would meet with Mr. Ben Greene and/or Mr. Michael Stitt
at our buil din g to go over the 1994 Uniform Fire Code items.
For your review and comments, th e following is my understanding of the various code
,terns . My understand ing is based on prel imi nary information given to me by (1) Ms.
Susan Stiffle r . (2) CleveTrust's maintenance personn':!I , (3) a loca l contractor, and (4 )
based on our July 17th meeting.

upgrades We are in terested in improving the safety cond itions at the Englewood
Ban i-Bu il ding although we do fee l upgrades should be cons idered within the basic
framework of :he existing structure and reasonable econom ics need to be looked at.
When we are ai1 clea r on the scope of work required under the 1994 code , we can
then sit down with a general contractor for more specific estimates . As you
suggested , it would be helpful to have the City involved with our d i~ussions with the
contractor so that the contractor's estimates clearly cover what the City wculd like to
have don e . With these final cost estimates, we should be able to establish an

upgrade plan (i nclu ding timin g) which is acce ptable to t~e City of Englewood and •
Cle ve Trust

SECTION 3413 -SCOPE

SECTION 3414 -GENERAL
Existing high -ri se buildings as speci fied in Sec1ion 3413 shall be modifi ed to confonn wi th nor le ss
than the minimum provi sions specified in Table A-34-A and as funher enurn eraled within chis di vi-
sion .

SECTION 3415 -COMPLIANCE DATA
After ad option of thi s di"i sion . the building official shall duly notify the owners whose buildin gs
are subject to the provisi ons of this divi sion . Upon re ceipt of such notice . the owner shall. s ubject to
the fo llowing tim e lim i1s. take nec ess ary ac ti ons to co mp ly with th e pro"ision; of chi s div ision .
Plan s ancl specifications for the necessary alteration s shall be filed with the buildi ng offic ial wi th
in th e time period establi shed by 1he loca ljurisdic1ion aflerthe date of owner noti fica1ion . Work on
the required alterat ions to th e build ing shall commen ce within 30 mon 1hs of the date of owner no1i-

emerge ncy communica1ion between fire-suppression personnel.
3418.1.4 Si ngle-station smoke detector s. Sin gle-st ation smoke detectors shall be install ,
within all dwelling unit s or gue st room s in accordance wi th th e manufa ct urers installation i,
struc ti on s. In dwelli ng units. the detector shall be moun ted on the cei ling or wall at a poi nt ce,
trally loca ted in the corrid or or are a giv ing access to each separate slee ping area . Wh en sleep it
room s are located on an up pe r level. th e dete ctor shall be in stalled at the center of the ceili ng d

APPENDIX 1-B
LIFE-SAFETY REQUIREMENTS FOR EXISTING HIGH-RISE BUILDINGS
(See U.F.C. Sections 102, 1202.11nd 1303.1)
SECTION 1 -SCOPE
The se provisions apply to existing high-ri se building s constructed prior to the adoption of Appen -
di x 1-B and which house Group B Offices or Group R. Division I Occupancies, each havin ,~ floors
used for human occ upan cy located more than 75 feet (22 860 mm ) above the lowest level of fire
de panmem vehicle acc ess.
SECTION 2 --GENERAL
Existing high-ri se building s as specified in Section I shall be modified toconfo mi wi th not less than
the minimum pro visio ns specified in Table A-1 -8-1 and as funher cnum,nited wi~tin Appendix
1-B.
The provision s of Aprendi, I-B shall no t be construed to allow the elimination af f'.1t-protection
sys tem s or a redu ction in the le vel of fire sa fety provided in buildings constructed i,1 co nfonnance
with pre viously adopted codes.
SECTION 3 -COMPLIANCE DATA
After adoption of Appendix I-B. the chief shall duly notify th e owners whose buildings are subject
to the provis ions of Appendix 1-B . Upon neceipt of such notice. the owner shall. subject to the fol -
low in g time lim its. take necessary action s to comply with the pro visions of Appendix I-8.
Plan s and spe cificatio ns for the necessary alte ration s shall be filed with the chief within the time
period es tablished by tl,c iocaljurisdiction after the date of owner notification . Work on the rcquined
alterati ons to the building shall commence within 30 months of the date of owner notifi cation and
such work shall be completed within five years from the date of owner notification .
The chi ef shall grant necessary extension s of time when it can be sh own that the specified time
period s are not ph ysically practical or pose an undu e hard ship . The granting of an extension of tim e
fo r co mpli ance shall be based upon the showi ng of good cause and subjec t to the filing of an accept-
able sys temati c progre ssive plan of correction wi th th e chief.
SECTION 4 -AUTHORITY OF THE CHIEF
For the purpose of ap pl yi ng the provisions of Appendix 1-8 . th e chief shall have th e a,• ·1 ori1y 10
consider alternative approac hes and grant nece ssary devi ation s from Appendix I-B as follows:

SECTION 6-SPECIFIC PROVISIONS AND ALTERNATES

equipped with an approved automatic spri nkler system installed in accordance with the Building
Code (sec U.B.C. Standard 9-1).

18. Exit corridor door closers. Exit doors into corridors shall be equipped with self-closing de-

RECOMMENDED ACTION
Community Senices Division staff is requesting adoption of Appendix Chapter 34, Division II to the
currently adopted Uniform Building Code.
BACKGROUl'lo'D, ANALYSIS, AND ALTERNATIVES IDENTIFIED
The City of Englewood currently has two bank buildings, both ten stories in height, which have concerned
the Fire Prevention Bureau and the Building Division for years. Neither building is fully sprinklered
and both h ave serious life safety vio lations if the buildings were constructed today. The Uniform
Building Code (U.B .C .) as well as the National Fitt Protection Associati, 1 (N.F .P .A.) has performed
numerous studies which resulted in the development of Appendix Chapter 34 of the U.B .C .. This appendix
section all ows fo r certain alterations to be performed which will allow for reasonable life safety. A
sprinkler system retrofit is typically the largest issue due to expense which could range from
approximately $150,000 .00 to $300,000 .00 depending on the building. Other expenses will include lire
alarm systems , com munication equipment, exit lighting and various other items. Staff has held
m eetings "ith th e own ers of both buildings and have received letters of agreement to the proposed adoption
(see attachments).
Construction effec ting nearly 30% of the 3333 South Bannock structure is due to commence in the n ext
couple of months making timely adoption of this chapter critical.
