HomeMy WebLinkAbout1996 Ordinance No. 042• • • OP.DINA..~CE NO .~ SERIES OF 19:l& BY AUTHORITY COUN .;IL BILL NO. 45 INTRODUCED BY COUNCIL M!iMB ER HATHAWAY AN ORDINANCE AUTHORIZING AN INTERGOVER:'MENTAL MEMORA?JDUM OF AGREEMENT BETWEEN THE STATE OF COLORADO DEPARTMENT OF TRANSPORTATION AND THE CITY OF ENGLEWOOD , COLORADO FOR THE TRANSFER OF LAND FOR THE SOUTH WINDERMERE STREET IMPROVEMENTS. WHEREAS, as a part of the Santa Fe Improvement Project , Tufts Avenue and Quincy Avenue were closed ; and WHEREAS, Windermere is in the proceBB of being converted to a truck rou te , whi ch will run from Belleview north to Oxford Av e ue; and WHER/;:AS, the Colorado Department of Transportation is in the process of rebuilding \Vindermere since in its current condition it is not constructed to carry heavy truck traffic; and WHEREAS, it will be necess ary to widen and raise the grade on Windermere; and WHEREAS, a new bridge will be built ove r Big Dry Creek; and WHEREAS, th e easement will allow for a storm sewer which will drain runoff from the intersection of Windermere and Layton; and WHEREAS , the proposed construction will raise the west driveway at the Allen Filter Plant; and WHEREAS, this Mem orandum of Agreement contains temporary easements fo r con struction; permanent easements fo r storm sewer co ns truction and maintenan ce and a fee si mple transfer of land for permanent stree t right-of-way; NOW , THEREFORE, BE IT ORDAINED RY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO , AS FOLLOWS : ~-The Memorandum of Agreement between the City of Englewood and the Colorado Department ofTransportati m, attached hereto as Exhibit 1, is h ereby accepted and a pproved by the Englewood City Council. ~-Th e Ma yor is authorized to execute and the City Clerk to attest and seal these documenL, fo r and on behalf r~ the City of Englewood , Colorado . RECOMMENDED ACTION The Wate r and Sewer Board , at their August 13, 1996 meeting , recommended Council approval of the Memorandum of Agreement with the Colorado Department of Transportation (COOT) for the Wi ndermere/Belleview North Imp rovements. BACKGROUND, ANALY SIS , AND ALTERNATIVES IDENTIFIED A s part of the Santa Fe I,11pro w ment Project . Tuft:; Ave . and Quincy Ave . were dosed. Windermere is in the process of be ing conve1'ed to a truck route , which will run from Bell eview north to Oxford Ave . COOT is in the process of rebuild ng Win demere since in its current cond ition is not constructe d to carry hea vy truck traffic . It will be 1ecessary to widen and ra ise the grade o· Windermere , an d in the process , a new bridge will be bu ilt ,ver Big Dry Creek . The easement for the ston11 se wer will dra in runo ff from the intersection of W indermere and Layto n. Th e proposed construction v~II ra ise the west driveway at the Allen Fi lter Plant. The Memorandum of Agreemen t is comprised of the following : TE-412 , TE -411A and TE-411 are temporary easements for construction . (64 ,313 sq . ft.) PE -412 and PE-411 are permanent easemen ts for storm sewer construction maintenance . (705 sq . ft .) Par ce ls 412 and 411 will involve a fee simple transfer of land for permanent stree t rights-of-way . (11 ,585 ~q ft ) F,n al easement documents will be submn ted fo r final read ing . FINANCIAL IMPACT An appra isal was made in accordance with appl icable state laws and requirements , and Fa ir Mar11et V alue was determined to be $36 ,310.00 .. Th is is the amount being offered by COOT as total compensation for all interest in said parcels and includes damages , if any .
