WHEREAS, a l!tn!am Oow gage loc,rn➔ al Un,"n Avenue and the South Platte
River, is operated and maintained l,y the U .S . Geologir.al Survey and bu been in
operation since 1990; and
\V'""REAS , the data provided by thr l g'.r,g ■talion is requin,d by the State Water
Com mi•sioner in order to make reieascs from Chatfield Reservoir d uring low flow
situations in which insufficient wet.o r is available to meet pumping demands at
Union Avenue Pump Station; and
· ,LEAS , the Englewood Utilities Department shares in the annual cost of
operating and maintaining the station on a 50/50 baais, with the U .S .G.S.; and
WHEREAS, the City Council of the City of Englewood, Colorado authorized a Joint
F'rnding Ap-eement For Water reaourtea lnveatigations Arn,ement with the
r.aasage of Otdinance No. 20, Series of 1996; and
WHEREAS, •he Joint F'undmg Agreement For Water Resources Investigations
Agreement was for tl,• period oi October l. 1995 through September 30, 1996 in the
amount of $4 ,225 .00 fron. eeeh ;,arty; and

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF ENGLEWOOD, COLORADO, AS FOLLOWS:

governing NCI, party.
4. The field and analytical work penaining tu tM program sh.II be under tt,e ~ of or Slbject to periodic review by
an authorized repn,senlative of the party ol the !irst part.
5. The areas to be included in the program shall be delemined by mutual agreement between lhe rarties hereto or their
authorized representelives. The mett.,ds enl)k,yed in the field and office shall be those adopted by the party ol the
first part to insin the required standards cl accuracy 9Ubjlct to modification Ill' rruual agreement.
6. During the course of th is program, all field and analytical work of either party perlllining to this program shall be open
to the inspection of the other party. and I the work is not being carried on in a nuuaJly satisfactory manner, either party
may terminate this agreement upon 60 days written notice to the other party.
7. The original record s resulting lrom this pmgram will be deposited in the otlice of origin of those records. Upon request,
copies of the original rerords will t>, provided to the olfice of the other party.
8 . The maps, records or reports resulting from this program shall be 1'18de available to the public as promptly as poss~e.

9. Billin g for this agreement will be rendered annuall, . Payments ol t:ills are due within
60 days atter the billing date. If not paid by the CJe date. interest will be charged at the current Treasury rate for each

RECOMMENDED ACTION
Approval of the proposed Joint Funding Agreement between the City of Englewood and the
U.S. Geolcgical Survey for October 1, 1996 through September 30 , 1997.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
A stream flow gage, operated and maintained by the United States Geological Survey
(USGS), ha~ been in operation since 1990 at Union Avenue and the South Pia~-.~ Rive r. The
information from th e gage is critical during low flow periods to determine if water must be
re leased from Chatfield Reservoir.
The data provided by the gaging station is required by the State Water Commissioner in order
to ma ke releases from Chatfi eld Reservoir dur ing low flow situations in which insufficient water
1s avail able to meet pumping demands at Union Avenue Pump Station .
The Utili tie s Depa rtment shares in the annual cos t of opf'rat ing and maintaining the station on
a 50% basis , w ith the rema ining 50% contributed by the USGS .
FINANCIAL IMPACT
The cost of fund ing this agreemrmt will be approxim ately $20 ,000 to $25 ,000 over the nex:
five years . Th i s portion is for 1996-1997 and is $4 ,350.00 . The funds are included in the
1996 b;.idget.
