SERIES OF 2008
A RESOLUTION APPROVING THE ACCEPTANCE OF EASEMENTS RELATED TO THE
BIG DRY CREEK BICYCLE AND PEDESTRIAN TRAIL LOCATED BETWEEN LE H OW
AVENUE AND BROADWAY .
WHEREAS , Ordinance No. 31 , Serfos of 2006 auth orized a Contra ct regarding desi!,'11 ,
easement acquisition and construction related to the Big Dry Creek Trail between the Cit y of
Englewood and South Suburban Parks Foundation ; and
WHEREAS, in I 994 Eng lewood , Linleton and So uth Suburban Parks Foundation cooperated
in the preparation of a plan to install a bike trail along Big Dry Creek from the South Platte River
to the Highlin e Canal ; and
WHEREAS, a master plan was developed wi th the proposed trail alignment ; and
WHEREAS , seven segments of construction have taken place, comp leting the trail system
from the Mary Carter Greenwa y at the South Platte River to Lebow Avenue (Phase I); and
WHEREAS , the segment from Lebow to Broadway (Phase ll) presented challeng es in
obtaining right-of-way easements; and
WHEREAS, the Englewood City Council authorized such acquisition of real propeny fo r the
purpo se of providing a multi-u se recreational trail through the utilization of the City 's power of
eminent dom•in with the passage of Reso lution No . 83, Series 2007; and
WHEREAS , the passage of this Reso lutio n authorizes the acceptance of the Phase D
easements :

RWC, Ltd [Leber] in which a Grant of Easement for a Bicycle and Pedestrian Trial
was obtained by negotiation; and
Liquor Control, Inc. pursuant to a sti pulated Rule and Ord er of th e Arapahoe
Co unty District Coun in an eminent doma in case .
WHEREAS, the South Suburban Parks Foundation has agreed to reimburse th e Cit y for th e
Ci ty 's cost in obtaining these easements .
NOW , THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD , COLORADO, THAT:
Sectio n I. The City Counci l of the City of Englewood, Co lorado, hereby approves the
acceptance of a Grant of Easement executed by RWC Limited [Roben C. Leber] fo r the
completion oi the Bicycle and Pedestrian Trail Pha se II from Lehow to Broadway and
acco mpanying Temporary Construction Easement, attached heret o as Exhi bit A.
Section 2. The Ci ty Cou ncil of the City of Englewood , Co lorado, hereby approves th e
accep tance of an Easement across pro perty owned by Liquor Co ntrol, Inc . [Mei ster] pursuant to
an Order of the Court fo r the comp letion of the Bicyc le and Pedestrian Trail Phase II from Lehow
to Broadwa y and accompanying Temporary Con stru ction Easement , att ac hed hereto as Ex hib it 8 .

2. Co nsiderati on. As co nsid era ti on for thi s Grant , Grant ee has paid Gr antor th e
sum of Fift y Th ousand Doll ars ($50 ,000 .00) and othe r good and va luab le con sid era ti on, the receip t
of whi ch is hereby acknow ledged by Grantor.
3. Gran t of Ea se ment. Gra ntor hereby gra nt s to Gran tee , it s successors and
assigns, a permanent nonexclusive easement (t he Eas ement Prope rt y) over, und er, across an~
thro ugh the Easeme nt Property for th e purp os e of constructing , op eratin g, maintainin g, repairi ng,
replacing and removing a bik e/pede strian trail.
4. Access . Gra nt ee shall have the permanent nonexclusive right of in gress and egress
in , ove r, thro ug~ and across th e Easemen t Properly ior any purpo se necessary or desirab le for
th e full enjoymen t of the rights gra nted lo Gran tee under th is Gra nt.
5. Restoration, Preservation and Maintenance . Grmot•e agrees , ot her th an as to the
spe cific trail improvem ents, th at afte r the constructio n, maintenance , repair, replacement , or
en largement, if any , for th e trail , Grantee shall restore the sur face of the Easement Property as nearly
as reaso nably po ss ible to th e grade and cond iti ons it was in immediately prior to said con struction,
maintenance , repair , replacement or enlargement. Grantee agrees use it s best efforts to patrol ,
preserve and maintain th e Ea sement Property on a regu lar ba sis and keep th e Easement Property
cl ear of trash, debri s , or other un sightl y or un safe co ndi ti ons .
6. No Im provements . Granto r cove nan ts and agrees not to construct, erect , place or
plan any improvements on the Easement Property wi th out obt aining the prior written con sent of
Gra nt ee . "Im proveme nt s" shall mean any sti:1 cture or bui lding. Gra ntee sh all have th e right to
remove, wi th ou t any li abi lity to Grant or , any imp rove ment s co nst ru ct ed, erected, pl aced or
planted on th e Eas emen t Propert y wit hou t Gran 1.ee's ha ving ob tain ed the pri o r writ:en con sen t of
Gran tor.

(IGA) with Urban Drainage and Fl ood Control District (UDFCD) regarding funding participation by
th e District.
Council approved Ordinance No. 31 , Series 2006 authorizing a con tract with the South Suburban
Pa rks Foundation (SSPF) reg ardi ng their commitment to provi de matching funds for the project.
Staff presented an update regarding the Ri gh t-of-Wa y status at the Decembe r 4, 2006 Study
Session.
Council app roved Resolution No. 83 , Seri es 2007 conce rni ng th e int ent of th e City to acquire
necessa ry easements for the Big Dry Creek Trail through the utilization of the City's po wer of
emi . 1ent domain.
RECOMMENDED ACTION
Staff recommends Council approve a Resolutios accepting easements for the Big Dry Cr~ek Teli l
between Leh ow and Broadway.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
Construction of the Big Dry Creek Trail through Englewood began in 1997. Seven segments of
cons truction have been completed. Th e only remainin g section wi thin the City of Englewood is
between Leh ow and Broa dway. Constru ctio n of this last segme nt will complete th e Big Dry Creek
Trail through the City of Englewood and provide a con tinu ous link to the Mary Ca ,1er Greenway
Trail at the Platte Ri ver (see attached aerial photo map).
The South Suburban Parks Foundation (S SPF) took the lea d ro le in acqu il'i nP, the nece ssary rigt.:-of-
way for the trail system. They successfull y negotiated the acquisition of nineteen parcels of land
between the Platte River and South Washi ngton Street; however, they we re not successful in
negotiating with two owners between Lehow and Broa dway.
The City received federal funding to a,;sist with the construction of this trai l system and we are
ob li gated to complete the missing link. In early 2005 , it appeared negotiations with th e two owners
w ere stall ed and no t likel)' to res ult in timel)' acquisi ti o n. Public Works staff, with City Co uncil •
concu rrence, ordered formal appraisa ls and th e services of a p rofessional nego tiating firm . Informal
negotia t ions were not successful and our negoti ato r, H.C. Pe ck and Associa tes , recommended
mov ing forward with the formal acq uisition process. In August, 2007, City Coun ci l approved a
Reso luti on au th o rizing th e use of Englewood's power of eminent domain, if necessary.
Negotia tions with the owner of the RWC parcel (Lehrer) p rocee d e~ successfully without the need
10 fil e a Petitio n in Condemnation. In Nove mber, 2007, th e City 's condemnation anorne)', Corey Y.
Hoffmann, Esq., recommended filing a Petition in Condemnati on against the owners o f the Liqu or
Control parc "I (Meiste r). Subseq uent to the filing. nego ti ati ons w ith th e Meister's, thro ugh th eir
atlorney, were successfu l. The negotia ti o ns were performed in good fai th, per Co lorado Rev ised
Sta tu e sec ti on 38-1-10 1, and have resu lted in mutually acceptable agreements w ith both owners.
The Sou th Suburban PJrks Fo undation w ill be re imbursin g Englewood fo r all cos ts associa ted with
the acq uisi tion, and th ey ha ve concurred with the fina l sen lemenl.
Th e acq uisition from the RWC Pared (Leh rer) consi sts of two permanent ease ments, one fo r the
ma in trail and one fo r a ramp up l o Br oadway, along with o ne temporary easement lo construct th e
ramp . Th e fai r market value establish ed fo r th ese three ease ments to tal $2 7,741. The final
se tll ement )greemen t is for $50,000 (see th e "Grant of Ease men t" contained in th e attac hrd
Reso luti on).
The ac quisi tion from the Liquor Control property (Meist er) consists ul 0 1oe permane r, t . '~~·.•,11 ,
the mai n trail. Th e update d appraisal es tablished a fa ir market va lu e of $54,36 1. Th e fina ,
settlement agreement is fo r $99,500 (see attached "Final Rule and Order" in th e Resolutior.1.
