WHEREAS , the Englewood City Council has fo ll owed the Co lorado State Statutes se tting fee s fo r the issuance of liquor li r.enscs and permits, whi ch fees have not been increased by th e State in ove r twe nt y yea rs: and WHEREAS , the Colo rado Se nate Bill 07-149 was a bi ll fo r an act co ncern ing an increase in the amo 11 of fe es local jurisdictions are pennitted 10 charge for alco hol beverage related applications whic h became effec ti ve August I, 2007; and WHEREAS , Sena te Bill 07-149 also raised the cap on app li ca ti on fees that may be charged by a local government to issue liquor li censes and pennit s; and WHEREAS, the fee s fo r a new license, the transfer of loca tio n or ownership , and a renewa l will be increased in a graduated time frame. but the specia l event permit fee would become effecti ve. in full , immediately ; and WHEREAS, th e passage of this proposed Reso lution, recommended by th e Eng lewood Liqu or Licensing Authority ; NOW. TH EREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENG LEWOO D, CO LORADO, THAT : Section I. l11e Ci ty Counci l of th e Ci ty of Eng lew ood, Co lorado hereb y authorizes the se ttin g of th e City's Annual Liquor Li cense Fees , as fo ll ows: Annual Liquor License Fees . A. Annual li cense fee s shall be paid to the Cit y as provided by Stat e law ; sha ll be paid in advance ; and sha ll not be rebated or discount ed on a proponionate basis for any license in existence or issued for less than a year. Said fees shall be in addition to any ann ual license fee s or registrntion fees requirc'<I to be paid to th e State . Liquor Licen se Fees. Th e fees have not inc reased in over 20 yea rs. City Co unci l discussed this iss ue at a Stu dy Sessio n held Fe b ruary 4, 2008 and directed staff to p repa re a Bill fo r an O rd inance that woul d all ow fo r fees fo r liquor license s and pe rm its l o be se t by reso lution. City Co uncil approve d Coun ci l Bill on firs t rea ding at the Fe bru ary 19, 2008 mee ti ng and is slated to consider the Bill on fi nal read in g Marc h 3, 2008. RKOMMENDED ACTION Ci ty staff reco mmends City Counci l app rove the attac hed Reso luti o n increasing fees for th e iss uance of liqu or licenses an d perm its . Specificall y th is ac tio n increases th e new lice nse ap pli catio n fees , the tra ns fe r of loca tion or owners hip fees, lice nse renewal fees and special event ap pl ication fees. This change affects the En glewood M un icipal Code 2000: 5-3 8-3, 5-3 8-5, and 5- 38-8. BACKGROUND , ANALYSIS, AND ALTERNATIVES IDENTIFIED Se nate Bil i 07-149 , effecti ve August 01 , 2007, was "a bill fo r an ac t co nce rn ing an increase in the amount of fees local ju risdicti o ns are permi tt ed to cha rge for alcohol beverage related app li ca ti on;." This bill ra ises th e cap on appli ca tion fees that are ch arged by a loca l govern m ent 10 issue li4uor licenses and pe rmi ts. The fees for a new li ce nse, the tra nsfer of loca tion or owners hip, and re newa ls will be in a gradua ted limeframe wh il e the spec ial even t perm it fee woul d become effective in fu ll immediately. The new fee schedule is as fo ll ows: New Li censes: (A) O n o r befo re Jul y 1, 2008, six h und red an d twenty-five dollars ($625 .00) (B) After July 1, 2008 and befo re l uly 2, 2009, seve n hun dred and fifty dollars ($750.00) (C) Afte r July 1, 2009 and before Ju ly 2, 20 10, eig ht hu ndred and seventy-five doll ars ($875.00) (D ) Afte r Ju ly 2. 2010, o ne th o usand doll ars ($1,000.00) Transfer of Location or Owner;hip : (A) On or before Jul y 1, 2008, six hundred and twenty.five doll ars (S625.00) (B) Afte r July I, 2008 , se ven hundred and fifty dollars ($750.00) Renewal of Lice nse: (A) On or befo re July 1, 2008, sev enty-five doll ars (S75.00) (B) After July I, 2008, one hundred dollars • (S 100.00) An expi red license renewal fee shall not excee d five hundred dolla rs ($5 00.00): Appl ication for a Special permit: Applications shall be accompanied by a fee of one hundred dollars (S1 00.00) for both investigati on and issuance of a permit. The in creases in fees will go to offse t th e time and effo rt required by staff to pro cess the license and perm it applications which includes constant monitoring, posting, co pying, in vestiga ting, fingerpr inting, costs associated wi th hearings and often several reviews or written reminders . This increase will help to reduce th e costs associated with the is suan ce of the lice nses and permi ts.
