A RESOLUTION ESTAB LISHI NG ANNUAL ART GALLERY PERMIT FEES FOR TH E
CITY OF ENGLEWOOD.
WH EREA S, Co lorado House Bill No . 08-1 I 05. effecti ve Jul y I, 2008 , adds a new section to
Part 4 of Article 47 ofTitle 12 of the Co lorado Revi sed Statutes, Art Gallery Permit; and
WHEREAS , House Bill No . 08-110 pennits "A person opera ting an Art Gallery that offers
complimentary ma!:, vinous, or spirituous liquors for consumption only on the premi ses may be
issued an Art Gallery Pennit. ";
NOW , THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO , THAT:
Section l. The City Council of the City of Englewood, Colorado hereby authorizes the
establishment of annual Art Gallery pcnnit fees under the new Part 4 of Article 47 of Title 12 of
the Colorado Revi sed Statutes (Colorado House Bill No. 08-1105), as follows:

City Cou ncil approved Resolution 32, Series of 2008 o n i,,arch 3, 2008; the Resolution set va ri ous
fees for liquor li censes. The fee for Art Gallery Permits has no t been discu sse d by Council. The
proposed fee is se t by State Statute.
RECOMMENDED ACTION
City staff •ecommends City Council approve the attached resolution se tting th e fee for the issuance
of Art Ga ll ery Permits.
• BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
•
House Bill 08-1 1 OS , effective July· 1, 2008, adds a new se ction to Part 4 of Article 47 ofTitle 12 of
th e Colorado Revised Statutes, Art Gallery Permit. This legisla tion permits • A person operating an
art gallery that offers complimentary mal~ vinous, or spirituous liquors for consumption only on the
premises may be issued an art gallery permit." Key points of the p~rmit include:
• An Art Gallery permittee shall not sell alcohol directl y o r indirec tly
• An Art Gallery permittee shall not charge an entran ce fee or cover charge
• An Art Gallery p e rmittee shall no t intentionally allow more than 250 people on the li censed
premises at one tim e
• An Art Gallery permittee shall not se rv e alcoholic beverages fo r more than four hours in any
one day
• An Art Gallery permillee shall not serve alcoholi c beve rages more th a~ fifteen days per
permit yea r
• An Art Gall ery permittee sha ll list each day alcoholic beverage s w ill b e served

These fe es are used to offset th e tim e and effort re quired by staff to process permit applicati o ns
which includes mo nitoring, posti n g, copying, ir,vestigating, fingerprin tin g, costs associa ted wi th
hearin gs and often seve ral rev iews or writt en reminders. Thi s inc reJSt:! wil l help to reduce th e co sts •
associa ted with th e issuance of th e permit s.

Be it enacted by th e General Assembly of the State of Colorado:
SECTION 1. Part 4 of ru1icle 47 of title 12, Colorado Revised
Statutes, is amended BY THE ADDITION OF A NEW SECTION to read:
12-47-422. Art gallery permit -d efinition. (I} A PERSON
OPERATING AN ARTGALLERYTHATOFFERSCOMPLIMENTARY MALT, VINOUS,
OR SP IRITUOUS LIQUORS FOR CONSUMPTION ONLY ON THE PREMISES MAY BE
ISSUED AN ART GALLERY PERM IT, WHICH SHALL BE RENEWED ANNUALLY.
AN ART GALLERY PERMIITEE SHALL NOT, DIRECT.. Y OR !NDIRECTL Y, SELL
ALCOHOL BEVERAGES BY THE DRINK, SHALL NOT SERVE ALCOHOL
BEVE RAGES FOR MORE THAN FOUR HOURS IN ANY ONE DAY, AND SHA LL NOT

(2) (a) THe STATE OR LOCAL LI CENS ING AUTHORITY MAY REJECT THE
APPLICATION FOR AN ART GALLERY PERMIT IF THE AP PLI CANT FA ILS TO
ESTAB LI SH THA T THE APPLI CANT IS ABLE TO OFFER CO MPLIMENTARY
ALCOHOL BEVERAGES WITHOUT VIOLATING TH IS SECT ION OR CREATING A
PUBLI C SAFETY RJSK TO THE NEIGHBORHOOD.
(b) UPON INITIAL APPLICATION, AND FOR EAC H RENEWAL, THE
APPLICANT SHALL LIST EACH DA Y TIIAT ALCOHOL BEVERAG ES WILL BE
SERVED, WHI CH DAYS SHALL NOT BE CHANG ED WITHOUT A MINIMUM OF
FIFTEEN DAYS WRITI'EN NOT ICE TO THE STATE AND LOCAL LI CE NSING
AUTHORITY .
(3) ANARTG ALLERYSHALLNOTB EDEN IED ANARTGA LLERYPERMIT
BASED SOLELY ON THE ART GALLERV'S PROXIMITY TO ANY PUBLI C OR
PRIVATE SCHOOL OR THE PRINCIPAL CAMPUS OF A COLLEGE, UNIV ERS ITY , OR
SEMINARY.
(4) AN ART GALLERY SHALL NOT CHARG E AN ENTRANCE FEE OR A
COVER CHARGE IN CONNECTION WITH OFFERING COMPLIMENTARY MALT,
VINOUS, ORSPIRl11JOUS LIQUORS FOR CONSUMPTION ONLY ON THE PREMISES.
(5) AN ART GALLERY PERMIT MAY BE SUSPENDED OR REVOKED IN
ACCORDANCE WITH SECTION 12-47-601 IF THE PERMITTEE VIOLATES ANY
PROV ISI ON OF THIS ARTICLE OR ANY RULE ADOPTED PURSUANT TO THIS
ARTICLEORFAILSTOTRUTHFULLYFURNISHANYREQUIREDINFORMATIONIN
CONNECTION WITH A PERMIT APPLICATION.
(6) IT IS UNLAWFUL FOR ANY OWNER, PART OWNER, SHAREHOLD ER,
OR PERSON INTERESTED DIRECTLY OR INDIRECTLY IN AN ART GALLERY
PERMITTOCONDUCT,OWN EITHERINWH OLEORINPART,ORB E DIRECTLY OR
INDIRECTLY INTERESTED IN ANY OTHER BUSIN ESS LICENSED PURSUANT TO
THIS ARTICLE; EXCEPT THAT A PERSON REGULATED UNDER THIS SECTION
MAY HAVE AN INTEREST IN OTHER ART GALLERY PERMITS , IN A LICENSE
DESCRIBED IN SECTION 12-47-401 (1) 0) TO (J) (t), OR IN A f[NANCIAL
INSTITUTION REFERRED TO IN SECTION 12-47-308 (4).

ART GALLERY TO VIOLATE SECTION 12-47-901, INCLUDING, WITHOUT
LIMITATION , SERVINO A VIS IBLY INTOXICATED PERSON AND TAKING AN
ALCOHOL BEVERAGE OFF THE LICENSED PREMISES; OR TO VIOLA TE ANY
ZONING OR OCCUPANCY ORDINANCES OR LAWS.
SECTION 2. 12-47-501 (!), Colorado Revised Statutes, is amended
'.3Y THE ADDffiON OF A NEW PARAGRAPH to read:
12-47-501. State fees. (1) The following license fees shall be paid
to the department ofrevenue annually in advance:
(r) FOR EACH ART GALLERY PERMIT, FIFTY DOLLARS.
SECTION 3. 12-47-505 (1), Colorado Revised Statutes , is amended

12-47-505. Locallicense fees. (1) The following license fee s shall
be paid to the treasurer of the municipality, city and county, or county where
the li censed premises is lo cated annual!) in advance:
( o) FOR EACH ART GALLERY PERMIT, TWENTY-FIVE DOLLARS .
SECTION 4. 12-47-505 (4) (a), Colorado Revised Statutes, is
amend ed BY THE ADDITION OF A NEW SUBPARAGRAPH to read:
Ji-47-505. Local license fees . (4) (a) Each application for a
license provided for in this article and article 46 of this title fil ed with a
local l•.censing au thority shall be accompanied by an application fee in an

SECTION 5. 12-47-901 (!) (h), Co lorado Revi sed Statutes, is
amended BY THE ADDITION OF A NEW SUBPARAGRAPH to read:
12-47-901. Unlawful acts-exceptions. (!) Except as provid ed in
section 18 -13 -122, C.R.S., it is unl awfu l for any person :
(h) (IV) NOTWITIJ STANDING SUBPARAGRAPH en OFTiilS PARAGRA PH
(h), IT SHALL NOT BE UNLAWFUL FOR ADULT PATRONS OF AN ART GALLERY
PERMITEE TO CONSUME MALT, VINOUS, OR SP IRITUOUS LIQUOR ON THE
PREMI SES WHEN THE CONSU MPTION IS CONDUCTED WITHIN THE LIMITAT IONS
OF A VALID PERMIT GRANTED PURSUANT TO SECT ION 12-47-1 22.
SECTION 6. 12-48-103 (2) (a), Colorado Revised Statutes, is
amended to read:
12-48-103. Grounds for issuance of special permits. (2) (a) A
special event permit may be iss ued under thi s section notwithstanding the
fact that the special event is to be held on premi ses li cense d under th e
provisions of section 12-47-403, 12-47-403 .5, 12-47-416, or 12-47-417, OR
12-47-422 . The holder of a special event permit issued pursuant to thi s
subsection (2) shall be responsible for any violation of article 47 of this
title.
SECTION 7. Appropriation. (I) In addition to any other
appropriation, th ere is hereby appropriated, oul of any moneys in th e liqu or
enforce ment division and state li censing authority cash fu nd created in
secti on 24 -35-401, Colorado Rev ised Statutes, not otherwise appropriated,
to the department of rev enu e, for allocation to the liquor enforcement
division, personal services for the fiscal year beginning July 1, 2008, the
sum of one thousand six hundred sixty dollars ($1,660) cash funds, or so
much thereof as may be neces sary, for the implementation of this act.
(2) In addition lo any other appropriation , there is hereby
appropriated, out of any moneys in the liquor enforcement division and state
licensing authority cash fund created in section 24 -35-401, Colorado

Revised Statutes, not u,herw ise appropri ated, to the departmen t of revenue,
for all oca tion to the li quor enforcement divi sion, operating expenses, forlhe
fi sca l year beginning Ju ly I, 2008, th e sum of two hundred ninety-three
dollars ($293) cas h funds, or so mu ch the reof as may be ne cessary, for th e
implementation of this act.
SECTION 8. Effective date. Thi sactshalltakeeffecl July 1,2008.
SECTION 9. Sa fety clause. The general asse mb ly hereby finds ,
