Consideration of Mlnutas of Previous Session (a) COUNCIL MEMBER OAKLEY MOVED , AND IT WAS SECONDED, TO APPROVE THE MINUTES OF THE REGULAR CITY COUNCIL MEETING OF NOVEMBER 19, 2007 , Mayor Woodward asked If there was any discuss ion , correct ions or modificat ions . Recognition of Scheduled Public Comment Englewood City Council D1c1mb1r 3, 2007 P1g12 Mayor Woodward said we are making a little change lo the Agenda right here . I will turn ii over lo Council Member Mccaslin. (a) Council Member Mccaslin sa id Lee Salazar and Chief Pallaroui, would you please coma forward? Council Member Mccaslin said I'm going lo read my emails Iha! I received through !he County. II says : "!hank you for allending !he 100 year celebration of the Englewood Bible Church . I !hough! I would !ell you about someone who I think is a great asset to our City . Last Sunday , we had a gentleman pass out from heal exhaustion , and needed medical allention . One of the members Immediately recognized the problem and helped this man lo the stage . He cooled !he man down, checked his vital signs , and helped him upstairs to cooler surroundings . Thankful, he is doing belier and is scheduled for a full physical lo make sure nothing else is affecting him. Th is was no! !he only situation we have had . A man , named Bob Pickering, passed out on Wednesday night and he was helped by this same man . Bob had fallen backwards and cul open his head . He was bleeding badly and did not know where he was . Mr . Salazar slopped the bleeding and helped Bob regain consciousness . Mr. Pickering was then taken lo the hospital and was checked out there . I think in both cases , if not for the quick response on Mr . Salazar's part, both men would have come out with some kind of damage to the ir hearts or brains I am not a member of the church , bu! I am thankful for having people like Mr. Salazar in our community. I don 't know his first name, bu! maybe you can !hank him on behalf of the City of Englewood . I just wanted lo have him thanked in some way for be ing a good citizen ." Council Mem ber McCasl ln said I also want lo !hank him . I received !h is personally and I've known Mr . Salazar through softball and other community events . He's a great asset and , even !hough he doesn 't live in !he City of Englewood , he 's really helped our community. And !hank you Mr . Salazar . A round of applause followed . Fire Division Chief Pallarozzi sa id the Englewood Department of Safely Serv ices Cerlificale of Commendatio n is hereby presented to Lee Salazar . On two separate med ical emergenc ies , Mr . Sal azar intervened and • administered firs! aid lo !he patients , prior lo !he arrival of EM S personnel. His prompt actions contributed lo the • successful recovery of the patients . Mr . Salazar's w illingness to become involve d is hereby rAcognized and commended . Mr . Salazar, !hank you very much . (b) Calendar: City Council recognized the student artists whose artwork is included in the 2008 Englewood Mayor Woodard said tonight we have !he pleasure of ~,onorin g !he students whose artwork Is featured in !he 2008 Englewood Calendar. Each year , !he City holds an art con1ast Iha! is open lo all students who live or go lo school in Englewood . The lop 13 pieces from !he student art contust are showcased in the calendar. Thanks lo the art teachers and parents for the ir support of these talented young artists . I had !he pleasure of serving on !he Selection Panel , along with : former City Council Member Ray Tomasso, Cuilufai Arts Comm ission Members : Mary Lynn Baird , Heather Bartunek , Jennifer Enger, Kale Dulaney, Janel Moore, Donna Schnitzer, Jim Doty, Artist , Community Member, and husband of ihe late Mayor Olga Wolosyn and Lill i Scheslag , Project Manager from the Museum of Outdoor Arts . I would also like lo mention that !his year's calendar is ded icalen in the memory of Mayor Wolosyn . Olga was the inspirat ion behin d the anneal student art calendar project. So with !hat, I would also like to thank our generous spon sors : Jerry's Artarama, Englewood Arts , A & B Custom Framing , Frame de art , L & M Pressworks , !he Muse~m of Outdoor Aris , Englewood Cultural Arts Commission, Millennium Bank , Greater Englewood Chamber of Commerce dnd Cornerstone Books . Recognition of Unscheduled Public Comment (a) Jim Glasscock , from the Englewood Masonic Lodge , said I presently live in Denver , but my home is still here In Englewood . I am a graduate of E .glewooo High School, long before coach was involved. It's kind cf hard to follow an act like that. Englewood Masons likes to work with the kids. I don't know if the Council Is aware of what the Englewood Masons are doing for our Englewood kids . One is the project where we donate the school supplies to the elementary schools . Right now we've collected enough supplies to help all of the kids in the Englewood elementary school s, all five of them . And the other project that the Englewood Masons are do in g Is we 're giv in g dictionaries to all the third grade kids . And this year, I was able to get them Englewood City Council D,c,mber 3, 2007 P1g•4 oul early. Last year, I wasn't able lo gel them oul early, beceuse of some surgerlea lhal I had and I wasn't able lo gel them oul as early as I wanted . And we'd like lo think lhal the raise In lhe Englewood third grade reading project had lo do with our giving them lhe dlcllonarles, so they could learn lo spel 1• So that was one thing . The main reason that I came here tonight Is lo update you on lhe project. This weekend we had our first open house, al the old Masonic Building, for lhe sale of Iha condos and so on . And I have a picture here, If you want to pass It down through the Council , If they want to look at ii . It's Iha rendlllons of the property and if you'd Ilka lo see II, I'll pass II down to you . But the project Is moving forward . I was Informed this morning that we had one individual signed up for one of Iha penthouses, so that's first day out. And we had four appointments set up for this week for the sales of some of the other condo units . Our real estate agent has appointments with some doctors for Iha first fioor medical complex. So II was reel encouraging this weekend , for not having any "real" advertising , what I would call real advertising, so we're going lo gel out and start papering the , ,.,1 and gel an ad in Iha Englewood Herald and so on like \hat. I thought that was what I'd like lo do for you to11 nl, and since we have several new members on the Council and they didn't know when or where of what w2s c;·,ing on, at 3500 South Snerman Street. They have been with us for a few years now , have been with us during the construction ~rocess and have done a great job, offering qual ity G'Jest services and great food . and with a decrease in revenue . So here's a chance for them to make that back up when we reopen . He said the City of Englewood had joine d several olher ent ilies in opposing an aggress ive water rights application involving the Park County Sportsmen's Ranc h and Ih a Cily of Aurora . The suit was of a nature that the parties, after we won the lawsuit, sought damages t~ cover ovr legal cos ts . Th e costs were awarded and Englewood's share was $100 ,000 .00 . The applicants, in the case, had funde d their case through loans so no paymen t was received, just a record ed interest in a ra,1ch . We're seeking , poten lially , legal aclion to recover th e monies but at this point, we jus t simply want to net with the other parties and evalu ate our posilion, because it may not be that we can recover the monies awarelcd . Thi s just lnvolve s a confidentially agree ment with the other parties, that would then allow us to exchange informat ion and that wo uld help us in our determ inatio n as to whether we want to proceed with them in seeking the damage s. Council Member Mccaslin asked does lhis mean, if I'm gett ing this right, that even if we go after these people there mig ht not be the money there? Is that what you 're saying? Director Fonda said that is correct. Thal is because th ey funded the ir case with debt that wss lied lo lhe ranch and the ranch may have other liens that would supersede us . So we just want to get in and loo!< and see if there 's a chance of getting any money . If ii appears very slim , then we w0uld not proceed wit~ the case . Council Member Mccaslin asked lhen how did the Cily of Aurora a1so get lied into th is? II says first us and then the City of Aurora . Directo r Fonda responded tha t they woc:d have gotten the water, I thin k. Th e Sportsmen 's County Ranch would have sold the waler to Aurora . Council Member Penn asked if we have any money funded into th is yet, as far as fees? Ha ve we spent any mvney, like slaff time or anything , on this al all? • • Director <=onda replied no , jusl the original money in the original case. We won thal case, so It was very • posilive , because it would have been quite a water grab and it might have affected us . The case was bad enough that lhe judge then dete rmi ned damages should be awarded to those who had to fight It, like Englewood . ~-0 he awarded the damages . Dlreclor Fonda said In the lawsuit, yes. Director Fonda said bul we won lhe case and most often you can't then turn around and sue for damages . Bui in this case , the judge lei lhe parties make the lawsuit and did award the damages . So we would gel our legal fees back on a case that we won . Council Member Moore said a fa ir chunk of our water rates are used simply to defend ou r water rights . So this Is just another example . That's one or the things that I'v e enjoyed learning on Iha Water Board is that it's such a defensive thing ... protecling our rights is such a defensive step, that we have to take . It is unfortunate . But that is where some of our water rates go ... are cases like th is and maybe we have the opportunity to recoup ii, but maybe not. City Attorney Brotzman sa id the answer is that the water rights . t" · ,Iue for th e water rights , by far exceed the $100 ,000 .00 that we put Into it to protect them . COLORADO . Mayor Woodward asked if there was any discussion . Council Memb er Wilson sa id I do have a queslion . She since this money came because lhey didn't have a reason for any more rehabs or ... because th is Is rehab money , correct? And we had to loan it during a certa in time period? Direc lor Wh ite sa id you 're correct. The original allocat ion was to the Hous ing Rehabilita ti on Program and we have a certa in amount of time to spend those funds and we haven 't been able to allocate those to any housing rehab projects in the City. Council Members Penn, Mccaslin , Moore , Woodward , Jefferson , Wilson , Oakle y None (c) Resolu '.:ons and Molions (I) Director <=onda presented a recommendation from the Utilities Department to approve , by motion , the bid nward of the Clar kson Street 6 million gallon reservo ir tank roof repair . Staff recommends awa rding the contra ct to the lowest acceptable bidder, Restruction Corporation , in the amount of $102,605.00 . He said up in <::reenwood Village , just south of Be llev iew and Clarkson , southeast, we have three overhead storage reservo '·s that are our ma in storage for the Cily of Englewood . One is a 230 foot in diameter water tank that is 21 feet deep . It is a post-tens ion concrete roof slab, and the steel tendons that form the tensioning units ... there am a bunch of them ... but four of them snapped and came through the concrete and this Is a bid to repa ir those teno on s. They will pul l the tendons ... they will get new tendons and run new tendons through the sleeves that th.gy go in . They'll pull them out and tighten them down and then they'll put a concrete pa!ci ,lng and sealant all around It. Tonight that same IGA was approved on second reading . So the request before you now Is to app,ove , by motion , a professional services contract with Mundus Bishop Design for $23,070.00. Thal contract would do the following for I/'' Paseo Redevelopment Project: first ii would des ign the project; ii would provide construction and bid documents as well as other Irrigation, electrical , geotechnlcal , and engineering services that are required to complete the project. If you recall , the Paseo Redevelopment Project is a project that will improve the mid -block walkway that connects the businesses , on the west side of the 3400 block of Broadway , with the ~Jblic park ing lots on Acoma behind those businesses . The goal there is to transform that space into a much sa(,,r and inviting, well -lit and active public plaza . Mundus Bishop Design is a landscape architecture firm in Denver with proven experience in the des ign of these same types of urban public places , parks , etc . A proposal from another firm was cons :dered but for this project, staff found Mundus Bishop Design to be the preferred firm . If Cou11cil does authorize the professional services contract this evening, the consultant will begin work right away on the project. It's a pretty tight schedule for that project. So, if there are any questions on the scope of services "r tt,e project itself, I'd be happy to answer them . Mayor Woodward said I have a question . I'm not real clear ... is this agreement for the planning of both Phase 1 and 2? When I read the agreement, it sounds like it is covering both of them . Planner Bell replied It does . It does cover both phases . Right now we have the funding for Phase 1 in hand and there is an application that is also in for Phase 2. We will hear the disposition on that application in February , but the design Is for both . In order to complete Phase 1, we need to have a good idea of the design for bu ild out. So, we won 't need further design dollars for Phase 2. Mayor Woodv.ard said okay . Any other questions? But we will ~• bringing them Into the design process . So , they have expressed concerns about the Paseo 's and their current state, and that 's one of the main reasons we're pursuing this project. He said the ::ommunity Developmen t Department has brought forward a mot ion for an agreement on a contract to continue the art shuttle serv ices fo r the fourth quarter of 2007 . As yo u may be aware , the prior contracts with the Laidlaw Company were pa id for through a grant from the federal go vernme nt. That grant was completed in September and the agreement that was reached with RTD was to pro vi de for funding for the shuttl e, with Council's agreement , through the end of the year, and then , with an IGA with RTD , that was approved on November 5. This proposed contract will just co ver the fourth quarter of 2007 . We will be br in ging forward another IGA wi lh • RTD and a contract with Laidlaw for shuttle operations and services for 2008 . One of them is the Smart Cars . Is that the electric car, that's moving here? Director White said no , I don't believe that they are electric, but they are very small cars . Council Member Wilson sa id okay. They have a Smart Wheel, at 1395 South Broadway in Denver, which is an all electric cars . So t wasn't sure If this was similar. Director White said no , this is different franchise, a differen t type of automobile. Council Member WIison said is that all they will be selling are those cars or will It be other cars, or used cars or ... ? Director White responded my knowledge is just those cars, new and used .
