Recognttlon of Scheduled Public Comment (a) Mayor Wc;losyn said we have Cathie Nicholson and Gabrielle Allen from the American Cancer Society to address City Council regarding the 2006 Relay for Life Event scheduled for June 16 and 17, 2006 at the Englewood High School. Englewood City Council January 9, 2006 Page2 Gabrielle Al ien inlroduced Judy Scott . Ms . Scott sa id some of you may remember me from last year. We c,.me to talk obout the Relay for Lile ..• the fl rat one we did In Englewood , which was In August and It was very successful. We raised over $18 ,000 .00 wh ich Is a great amount for a firsl year event. Relay for Life Is the Amer ican Cancer Society's signature fund ra lser ... ra lslng funds for cancer research and awareness and also tor programs for cancer patients. They like for commun ities to take up the fight togelher and so we are looking forward to a really successful second year. This year's event will be held June 16th and 17th and it will be at Englewood High School. II is an overn ight event, because cancer never sleeps . I am sure that all of you havr probably been tou~hed by cancer in some way, whether It Is yourself, a family member , a friend or neighbor . So , it Is something that does attect probably every single citizen In Englewood ... wil~ one In three Americans being diagnosed. The overnight is so that you will remember that. We do have a loi of enterta inmen t, we have lood , we have different lh ings go ing on for the teams to keep lhem motivated and walk ing the track . Tha idea is to ha ve one pe rson on your team on the track at all times during the event...6 at night untll 9 In the morn ing. There Is a lum inaria ceremony where we recogn ize those people that are fighting cancer er who havo lost the fight of cancer. It is a very moving ceremony. Lum inaries usually light the track and it Is a very nice time to think about those people and support those people as well as th e caregivers. We also recognize survivors . We are trying to get the word out to find all the can cer survivors in Englewood that we can , so that they are at the event and wo do have some things to recognize them . We start off the event with a Survivors Lap , where the survivors do make that walk around there because that is what it is all about. .. is the survivors and cancer awareness . So , I wou ld like to challenge the Ci ty to have a team and maybe even to have Council support a team ... to sponsor a team . Team s are usually eight to ten peop le. There is a reg istrat ion fee of $100 .00 . You can sponsor a team for $500 ,000.00 and on up of covse, but we would be willing to talk to you about that. We do have a short video , bu t I th ink it is probably going to take too long and you got started late . But, If you are interested in seeing that we could cert ainly come back maybe to a Study Session or something and share that with you, or I would be willing to como back and answer questions . I would like to turn it over to Cathie Nicholson, who is one of the team captains already working with the Fire Department ol Englewood . Cathie i :;choison said I am representing the Englewood Fire Department. Mysell , along with Chief Pattarozzi are working together to get a majority of Ih a firelighters and their families out and lorm a very present team at the Relay for Lif e. As Judy sa id, I would bet most everybod y in this room has been touched by cancer, either you know someone personally or you have heard of somebody . If you are one of those people you know about that...there is a vory big feel ing ol helplessn ess . The Relay lor Life is someth ing that you can actually , phys ically do to show your support to those that h~ve lost the ir t stile, that are still in their batt le or that have survived . The lumin aria ceremony is another way you can contribute in memory or in honor ol those people . II just brings the community together and , &gain , it mak es you feel you ca n ac!u ally do something . And so , I aga in challenge everybody in this room to gath or eight to tan lriends up , ge l a team together and get the City ol Eng lewood out overnight camping. Mayor Woiosyn said I would lik e to say th at I know it was a big success last tim e ... more than just fund ra ising . think it worked , meshed really well with the community around it and I tru st that you are working with tho High School again and with our statt . Ms. Scott sa id rlnht. There was conce rn about the ne ighbors , since it was an overnight event and we did actually go and knock on doors In the area around there and we plan to do that this year, even though it Is at the High School., .to let them know what is happening and what It Is for . We do tell them that we have a iol of lun ... we make a lot of noise In the beginning , but you know , come 10 o'clock we turn the noise down . I know there was a concern about some citizens that usually complain. I th ink I could ioqntify those two just from knocking on the doors and talking to people and we gol no complaints from them . So, I think It was successful and people had a lot of fun . A lot ol bus inesses that supported us felt like they got the word out aboU1 their businesses too and they were very appreciative of that and I bel ieve they are on board for this yea~s events . Mayor Wolosyn said I commend you on your good work and I th ink some of us will try to partic ipate th is year. Tnank you. Ms . II It is B short presentation, I would re~lly enjoy knowing what kind ol problems you ran up against last year. I know it was your lirst year and I was wondering ahout your concerns . I think It would be worthwhile If we could have a small presentatl~ about what worked for you and what didn't and how the event went for your lirst time. I would appreciate doing that . Mayo r Wolos yn said I will go ahead and schedule th&: sometime, maybe two months out...sometime between now and June. Does thal sound good? Ms. Scott said that would be line. (b) Mayor Wolosyn said Jill Wilson is here lo address Council regarding the Department of Safety Services' Intrusion Alarm Polley. Ms . Wilson , 3061 South G·anl Street , said I am here to address my concerns about the polirv changes for responding to Security Sys lem Alarms . I want to know if the following have ceen reviewed . The demographics of Englewood , specifically single and th e elderly . The increased risk, now that everyone will be aware of the two tier verification response . The feeling of being violated when your home has been broken into. Insurance rates , how that will be affected, because you are given a discount if you have a secur ity system . Home sales ... the affect of sales when 1he public knows pol ice won't respond to alarms . Especially, at the Kent Place project. My home did no1 cost $500,000 .00 to $1 .5 million and I want to be safe. How will new homoowners feel when they won 't have the protection that they can get across the street in Denver and Cherry HIiis? The police staff I spoke with said it was not a money issue. I honestly find that hard to believe . National Burglar Alarm and Security Association told me that other areas , such as Denver and Colorado Springs , have Implemented a perm it fee . Donver's is $25.00 per year. That generates one million dollars a year for Denver. Other areas have false alarm fees . I understand that some municipalities don't have the administrative help needed to process payments . I have a solution . I manage federal grant funds for the University of Colorado Health Sciences Center. I would be happy to donate my time for this project. Whether it be receiving funds or filing, so someone else could rece ive th,, •unds . I understand there are 1600 calls per year, 98% are false alarms . What if the one call , no one responded to , was fatal? I think that would rip a community apart . It would be helpful for me to know wha t r ,ces s is used to produce these statistics . If this policy moves forward, that same process must be used 10 cu,npare apples to apples ... therefore, not to skew lhe results . I would like to thank City Council for letting me speak . I also wantad to go over this Safety Services Mission statement: "The Englewood Department of Safety Services Mission Is to provide a safe , secure environment and improve the quality of life for the community by minimizing the impact of crime , disaster, lire, hazardous conditions and other personal emergencies . Through efforts directed toward (1) seeking and forming community problem solving partnerships, emphasizing mutual respect and interaction . (2) responding to community ne&js and desires, (3) providing public education and Information focused on personal safely and voluntary compliance with the law , and (4) providing quality serv ice through professional, effic ient utilization of resources ." ,;sc, have an e-mail from Kathleen Schraufnagel from Brink's and she sent various models that aro used acrc3s \ne c~untry. If you like, I can go ahead and give you those, if you want to look at them . I also have some othar information . So, If you want that, I will leave ii for you . (c) Mayor Wotosyn said Doug Cohn Is here to discuss the Englewood Municipal Code 15·9-1 and 15-9-2, lhe Off-Road Vehicle Ordinances . Mr . Cohn said you all have probably s&en this bumper sticker on the back of some cars : U.S. govemment phllosophy ... lf It ain't broke , lix It until It Is . At the start her~. I want to say thank you for listening to some o! the Issues I brought up that I ran Into on the campaign trail . This Is the last Issue and Is on6 of the easiest ones to fix . In the Interest of full disclosure, I don't have a toat or RV or off-road trailer, or a motorcycle or any of those Englewood City Council January 9, 2006 Page4 kinds of things, so I am Just a person Interested In the Issue . You guys have creat!ld a monster with 15·9·1 and 15·9·2. For the first 100 years, we have oot1en along pretty well without these types of oppreulve rules . In our system It works because we voluntarily comply with the laws ... the laws that are reasonable and nece11ary . Almost everybody In to •,n wants to follow the rules and wants to keep their property up . Some do It better than others. People like their olf-road toys . They want to have them nearby and you all created a hordshlp for many by making them put them Into storage and paying rent lor storage . You have created a hardsh ip by telling people they can only have their AV's out in fro nt of their house for eight hours a day. There are some bad actors that are slobs, whose properties look bad and they have the potential for Impacting property vaiuP~. The .,e are the people who reluse to cooperate with the old set ol rules and are not going to cooperate with the new :lei of rules you put into elfect in 2003. I ran into a lot of Irritated people during the campaign ... people who are law abiding citizens , who Just don 't like these new set of rules . They want to be left alone . I don't know all the details , but you all asked the Code Enforcement Advisory Committee to come up with these rules and they said no. They said the rules were not necessary. They believe 11 ,~ ~x lsting rules were good enough ... they Just had to be enforced. And then, lrom what I hear, you scolded them _, ,d ordered them to come up with a set of rules . I may not have all the details exactly right here, but pretty close though. Attar some protest, they olfered what berame the ordinances. And then at the Study Session on December 14, 2005, the meeting about putting together an appeals process for the people who can't comply with the new rules that you all have put on folks, the CEAC again said they disagreed with the ordinances and that the ordinances should be repealed. As near as I can tell, you have ignored their urg ings . How many bad actors do we have In town? Ten? Twenty? Thirty? I am not exactly sure, but I bet each one of you could name the bad actors in your part of town. I didn't see hardly any on the campaign trail . The people that I'm talking about are the bad actors, not the complainers . That Is a different group, lor a dilferent discussion. And the bad actors are not going to follow the new rules anymore than the old ones . Maybe they need to be invited to leave town or an investor neads to buy them out. The rules that you put into place punish those people who are trying to be good citizens, but people who don 't want to be hassled by the government. I heard several times ... Englewood Is not Highlands Ranch . We have our own stylo, our own ambience, and our own panache. Englewood has a history in traditions. It is unique. A bit of a maverick kind of town and that is okay. Actually, I think that is good . People move here because they like that. With these rules, you all have damaged our history and you have started a groundswell of resentment towards you all and towards the City stall that could become a really serious problem. If Code Enforcement ever really starts enforcing these rules, there is going to be hell to pay . I guess in conclusion, if you want the citizens to help on Boards and Commissions , you need to pay al1ention to their recommendations . You say yru want their Ideas and lnput...then trust their decisions. If one of the Boards or Comm issions tells you ii Is a re2.lly bad idea , believe them . I urge you to ,epeal these two ordinances , to reinstate the old one and enforce it. I appreciate your time . Thank you . 7. Recognition of Unscheduled Public Commen1 (a) Frank Lawrence said I am the Sec,etary of the Colorado Burglar and Fire Alarm Association. You received a letter from the President of the Association. I am speaking to you somewhat reluctantly tonight because as yet, neither I nor the Industry has seen a copy ol the proposed policy that the Police Department is plann ing to implement. So, I am not sure exactly what ii contains . We have some ideas of what we imagine that it contains . We made three points in our letter to you and I would like you to consider very carelully the possibility of addressing , exploring carefully, option number three , which is a cost recovery model. We have some axcallenl statistics coming out of Olympia, Wa shington . Granted, they have only been in their program six months . Olympia , Washington is a clly of 43,000 people ... more or less the same size as Englewood . It reduced the responses by 70%. Thoy are getting 100% cost recovery . That Is to say that the cost of providing those response services are being pa le , for 1,y the citizens expecting those services . Services are being provided, reasonably, across the board to all the citizens, as opposed to a policy that provides special response to certain classes of customers or certain classes of citizens and restricting response services to other classes of citizens . So , we are thinking now that the Olympia model may be the ideal sort of model for a city like Englewood to address . In the past, a city like Denver could use a cost recovery model, because of Its large • • customer base they could )ustlfy the Infrastructure costs . Englewood presumably does not have that • opportunity . And the Olympia model uses a cost recovery model, uses third party administration, so the city does not havr, Iha cost of administering that pollcy ... ln-house, at hay rate. So, I will leave it at thal and ask you to serlou&,y consider that option before Implementing any new policy. I am the County Court Judge in the City and County of Broomfie l•1. First of all I bring greetings to you from Mayor Karen Stuart and the members of the Broomfield City Council an J best wishes for tt,e New Year. It Is my pleasure l o be here this evening to be able to swear In Judge Vlnc',nl Atencio to now his third term as your Presiding Munic ipal Court Judge . Judge Atencio and I have known ea.::t-other for many years ... more than we probably care to admit to ... but certainly dating back to at least 25 and purhaps as many as 30 years , when we were first practicing attorneys back then . That is so long ago that we probably both had hair on top of our heads at that juncture . Our careers have tracked similarly. Nineteen years ago both of us were appointed as part-time municipal court judges . I in Wheat Ridge at that time and Judge Atencio, of course , here in Englewood . Then during the 90's both of us became 1ull time judges in our jurisdictions. I am delighted to be able to be here tonight. Ono ol the unique characteristics of Englewood is a unique provision of your Ci,arter ... Judge Atencio is the only popularly elected judge in the enti re Stale of Colorado ... either at the local, state or federal level, for that matter . That Is a unique provision of your Charter that allows lor the popular election of a judge. Judge Atencio Is kind of a folk hero amongst us In the Munic ipal Judges Association for that reason, which is the distinction that he has . As a State Court Judge, I stand for a retent ion elect ion every four years . I was very pleased last year when I received BO% retention recommendation from the voters of Broomfield and was quite pleased with that. Imag ine how impres sed I was then when I loo~eu up Judge Atencio's election results in November and ,~und that he had received 100% of the vote during the last election . Now, adm ittedly, that accomplishment might be diminished by the recognition that he was the only candidate 011 Iha ballot at that time. By my l'IBY of thinking , that actually was the second election that he 'ad won last year . I looked up today and found th at there are over 500 attorneys that list their professional addr~ss as being in the City of Englewood at the present time and many of those, I suspect or believe , also probably live In Englewood and many other attorns . •, live in Englewood , but perhaps N actice other places . And out of those hundreds of attorneys last fall , when it came time to lake out petitions iv, the elaction ... non e of those attorneys elected to take out a pet ition to run in opposition to Judge Atencio. I think that that is more than just a tacit acknowledgement. I think that is an obvious recognition of the jo b that Judge Ate ncio has done as your Presid ing Judge ... that the legal community of Englewood thinks so highly of him, that none ol th e attorneys who live in the City folt it necessary or appropriate to run against Judge Atencio . They recognize what an exemplary ju dge he is and how well respected he is within the legal community . So again, by my way of thinking, Judge Atencio actually won two elections last year unanlmously ... flrst from the attorneys last fall who elected not to run aga inst him and now through the vote of the populous that occurred in November . With those comments, it is certainly my privilege and my honor to be able to swear in Judge At encio to yet another term as your Presiding Judge . Englewood Municipal Court Judge Vincent Atencio was sworn in by Judge Randall Davis . There was a round of applause . Judge Atencio said I would like to thank everyone for giving me thi s opportunity and I consider ii a privilege and an honor lo be able to serve the citizens of Englewood ... the community where I've grown up and lived my entire Ill e. Thia project has been discussed • tor a number of years, but really Just hu started to take off, so these are really funds that wlll eam Investment and should be returned to the City In the next few years, hopefully . I did Ital some of the uaes ot the funds, which Includes civil engineering , also development and legal brokerage tees . Theae wlll all be expended over the next few years, but as I said , It rents or revenues are reallzed from the project, the Ctty will be reimbursed . • • Englewood City Council January I, 2008 Page7 Mayor Wolosyn asked II there were any questions for Mr. Gryglew lcz . Council Member Woodward said yes , I have a couple ... just clarification things . Civil eng ineering Is currently estimated at $27,760 .00, but the estimated total Nill be $40,000 .00 . Is the dlfferential. .. d,d we have estimates in the past? Mr . Gryg lewlcz said the $27 ,760 .00 Is really just the prelim inary work, but we feel as the site develops there will be additional expenditures . Mr . Woodward sa id okay . Mr . Woodward said and the $45 ,000 .00 available for marketing , broke rage and legal expenses ... dldn 't we discuss, at one time , some funds for some possible grading happen ing? Wasn't that something that Di rector Fonda had mentioned that we may be wanting lo do? Mayor Wolosyn sa id isn 't that the civil eng ineering cos ts? Director Gryglewlcz sa id that is part of those expenditures , as well, so we are look ing al do ing some grad ing work and poss ibly moving some of the dirt from that project around and poss ibly use it al the project in Sheridan if that were to go forward ... and sell some of that dirt . So , that Is part of those costs , yes . Council Member Woodward said then these funds will be re imbu rsed from funds received if the property develops? WIii those be the first funds that will be rei mbursed or Is there money that should be re imbursed to the Water Board or the Waler Fund first? Mr . Gryglew icz said ... jusl my opinion ... is that the Waler Fund did front some of those funds, so ii wou ld probably be either shared or the Waler Fund would come first, but we expect that those funds wou ld be fa irly substantial and could re imburse pretty rap idly . Mr . Wood wArd said okay , that 's all the questions I had . Mayor Wolosyn asked If anyone else had questions . Mayor Wolosyn said I would just like lo add ... l guess it is a question . I ass.ume that Plan West , who will be exploring various development possib ilities, will be using the gu ide li nes fro .11 several Counc il s ago ... l lh ink ii was in 1999 ... put out there, the th ings that Coun cil wants lo see ... environmenlal and also j~st the type of development that will influence the ir work . Mr . Gryglew icz sa id abso lutely . The number one go al is to protect the water resource and the ecologi cal area around there an d one ol th e ways we can do that is by c.·,ntrolling the development and that is why the Foundat ion wa s to•mad in the first place . (II) Mayor Wolosyn said next week or In the coming weeks, I will be asking Sue Bradshaw to put together a package for me to uo to NLC, wh ich Is the National League of Cities, and I will ask Council for approval . I went there In the pa o\, but because of budget IBBues, we haven't gone for the last two years. We felt confident putting some travel money back Into the budget and I feel , mysett , that It Is Important for us to go to these gatherings . NLC giv es us an opportunity to see what other cities across the country are doing . Many of them similar to us and the most Important thing , I think , NLC does, is that we go and visit our representati ves on the hill and they sea us and they know that, even though they are In Washington , they still are beholden to the dialogues and the concerns of our community and it is always a real honor to do that. Then nex t week we can bring that forward to you for approval. (b) Council Members· C~oice (i) Council Member Barrsntine : 1. She said I want to say Happy New Year to everybody too . I hope everybody had a nice holiday . We have a lot of wo rk to tackle this next year and I hope it goes well. 2. She said I wanted to say a couple ol thank you 's. Several weeks ago, in the middle of December, but I hadn't had a chance at Council to thank the State Treasurer, Mark Hillman, for intervening on behalf of a • constituent of mine 10 help them get the cost recovery program that the Stale Treasurer does every year . She • was in a nurs ing home and unable to access documentation lhal lhal department was request ing and he intervened. Tha l department went down lo where she was that Monday morn ing, the very next day and was able lo gel her, her $75.00 in a much more timely manner and I appreciate when people make that kind of effort . Ms. Barrentine sa id I also want to thank County Assessor Ed Bosier. Another constituent called and had a problem . One of the few people who still has a sep tic system , had a problern and was going through an appeals process and he agreed with ti1em and went ahea d and went to the hearing for them . He saved them a lot of time and aggravation. I appreciate that kind of re sponse . The y set a good example for the kind of things elected offic ials ought to do. (ii) Council Member Oakley : 1. He sa id I attended a DRCOG orientation session last Friday and even though I've had some interaction with DRCOG during my years of employment, this was looking at it from a different angle . One th ing that was kind of an eye opener was when you looked at the pie chart that showed the grow1h and development in other cities and the amount of jobs and stuff that they wore creating , ii kind of lets us know that we are landlocked and that we have to keep stirring the pot to kee p things going and stay on an even keel with them . 2. He sa id the letter that Counc il received from David Miller requesting a meeting with Council about water plann lng ... were we going to take that up or Is someone go ing to answer him'/ Or should we bring it up at the Water Board tomorrow? Director Fonda s. we sent him a letter Indicating that he could address Council during the 1 O minute period and at that point he could request the longer presentation, so we just wa it and see II he wants to . I was wondering tt the Clly ... if we could Investigate whether the City could ofter a health po/Icy, based on what the City employees have, to the citizens that reside In the City , so that when we went out to market our medical plans , we had a bigger pot to draw from ... we had a larger resource to say we had this many people that were involved In the plan and what that cost would be to us and the admin istration , or how we would administrate that...and if it were poss ible or feasible to do It. City Manager Sears said we have been involved with some other city consMiums and I need to find out where we are with t~,ose other consortlums . They have fallen apart , but we will come back to Council ... you are more interested in public participation? Mr. Tomasso said if we cou ld bring the citizens into that plan, maybe they could reduce our costs for our employees , if we had more Involvement. City Manager Sears sai d okay, we wilt come ba ck to Counc il. (iv) Counc il Member Woodward : 1. He said actually these are a couple of items that I wanted to bring up in Study Session as a Council Request. One was ... could we get a description again of how to read the Fire Div is ion weekly staffing report? think that might be helpful ... it is kind of confus ing at times going over f' ,at, so maybe at a Study Sess ion that we could take five minutes . Mr . Sears said okay , it is a good idea . 2. He said I have had a citizen complaint that belween 1 1 o'clock and 1:30 there seems to be a number of dogs off-leash at Belleview Park and the citizen was requesting that maybe Code Enforcement could patrol Iha, area in the late morning , early afternoon and inform people . 3. He said I would like to compliment Leigh Ann Hoffhines and Mike Flahe rty on the format and the new Citizen . I thought it was great and I was very pleased with what I saw. I was glad to see that we were able to redo that and come out with a nice paper . 4. He said I wanted to mention I kind of fell into the opportunity to be Santa for the Crusade for Kids at Christmas time. They were short one Santa and I happened to be eat,,,g at Country Buffet and was enlisted to be an elf and then to become • J ania. It was quite an experience meeting some of these kids. Some of the kids that are "needy kids" that wouldn't have experien cea any type of Christmas and other kids that have had experlence~ ... maybe negative type of experien ces ... with police or fire ... where possibly a father or mother or friend of something like that was taken away and this was a positive type of action ... where here comes Santa bringing glfls ... representing the Police and Fire Department. It was a real experience that I realty valued and I want to thank Nancy Peterson and Chris and the res: of the partic ipants fvr that opportunity . 13. City Manager'• Report (a) City Manager Sears said we didn 't get a chance at the Study Sess ion to talk about the vacant parcels . I had put , In Council's packet , the letter we had received on December 29'", regard ing five parcels. I have a map that ,,ur Public Works Departm ent put together for you. Bob has been working on this and we wanted to bring ',his to ,·ou r dttention this evening . We plan to really get Into more discussion about this next Tuesday ever'.ng . Bob might want to Just say a coup le words about where we are with this . There Is a short timeframe . RTD had in interest in these for the last several years. And now RTD has stepped back and, again, they have given us a short timeframe to respond back to them . With that brief introduction Bob, would you Just comment on where we want to go next week . Director Simpson said thank you ... we will be back to Council and talking more about these as I get more information . But , generally, these are Colorado Department of Transportation properties . They are generally , Englewood City Co~ncll January t, 200I Page 10 as you can note on your map , located at the northwest corner of Santa Fe and 285. One parcel Is located In the City of She ridan . The remainder are located within Englewood . The parcels that are located with in Englewood , lota l approx imately 90,000 square feet , or a little over 2 acres of ground . The asking price , under the 2002 appraisal Is noted at $642,500.00 or $7 .11 per square loot. They are from an ownersh ip and disposal standpoint , owned by the Colorado Department of Transportation . As you will note In that letter, there are a couple of things that are ava ilable . One Is that the Department of Transportation has a policy of diaposlng of surplus properties from time to time . These are considered surplus by the Department of Transportation and they are looking to , ultimately , dispose of these properties . Their first method of disposal Is to give the llrat right of refusal to the adjacent Jurisdictions to purchase . For example , the parcel thP' ;, located in Sheridan will be able to be purchased by the Cit y ot Sher idan and the parc&ls th at are located , ' .. o City of Englewood will be able to be purchased by the Cit y of Englewood . II either, or both Jur is dictions , choose to decline that first right , then those parcels are ava il able to go on the open market. Why we are even exploring this is because you may ha ve an interest In explor ing whether or no t you have an interest in ownersh ip or a part ial ownership of these parcels . Obviously, your alternat ives are you can do noth ing , y-1 u can opt ion the properties lo maintain som e poss ible ownersh ip over a short per iod of time , or outright purch ase . Ideally, as you know from that letter, one of my Is sues Is that we have a very short timetrame, we all have a very short timetrame. The State has requested that we respond by January 23'', which Is why we aro here talking to you . It is rather interesting that attar live plus years of not having any activity , that all of a sudden they have given us three weeks to get them an answer . Anyway , that background on this parcel , as Gary noted, it is zoned Industria l, it was previously co ns idered an area , by the Regional Transportation District , tor use in park ing . That lnte,~st has gone away from ATC because the Bates Stat ion owners ... .Win slow's ... have taken an interest in prov iding park ing at that location and it is actually more cost ellective at that location . So , ATC has done away with that particular alternative . There has been interest from a property owner on that side, who owns the properties kind of intermingled with those parcels , in develop ing. They have contacted me and have been working with me for about two months . They have been working with some pretty reliable developers and brokers that I teal are • very credible . They have actually kind of done some prelim inary design, looking at about a 3.7 acre site, that • has good visibility, but I would also note t',1at it would have poor access. Just as additional background , so you can think about this before next week, ;s that Embry is continu ing to move forward with Iha redevelopment of Cinderella City Tw in. I have been in co ntact with them today and they still have a lease with the theatre to cont inue to operate one more summer . Pot entially, they aro look ing to brea k groun d on that site by November of 2006 . That dev elopment would be about 360 residential units , for lease , similar in type , quantity and styl e to the Alexr,n here at CityCenter . The site probably has some reta il potential, if ii were to be aggregated and developed ... some potential tor retail development , obviously there is pot entia l tor light industria l development. So anyw ay we are continuing to expl ore. Ideally , I would love to see ii the State would give us a little more time to consider this . I don 't know whether that will be possible, but I have left messages and hopefully I will get a message back befo re next week.
