Recognition of Scheduled Publlc Comment (a) City Council recognized the young people who were nominated for I~ • Metropolitan Mayors and Commissioners Youth Award. Mayor Wolosyn said this Is an annual award that recognizes young people who have overcome difllcult situations in their lives and risen to the challenges of adversity. The first year I was on Council, I had the honor of serving as a judge on this panel and I think anybody who does it feels humbled , because !he people who participate , and who are nominated, all do so much and are so deserving. It would be nice If everybody could get the award. I just wan! to congratulate all of you. I would like to thank everyone for coming to help us celebrate these very special young people, especially the nominators. Patr ick 's nominator says he has a posit ive and calming influence in his classroom, and he helps bring out the positive qualities in his ~ears . (d) Chris Hoagland , 3041 South Franklin Street , sa id I am really glad that I was able to sit In on the proceed ings this evening . I am proud to be a citizen of Englewood . I've worked In the alarm industry tor 18 1·ears and I recently had the opportunity to read the City's Internet posting about their new alarm policy and I have a couple of concerns about that. wh ich I was hop ing to present to you this even ing . Essenllally , the Internet posting describes two bas ic areas that the City Is go ing to change how II processes burglar alarm signals . The first hall of the posting, bas ically , discusses ver ification procedures that the City Is going to implement to try to reduce or eliminate human error and mechan ica l problems with alarm systems . In the first Instance , the City Is going to require the verilicE'lon by a call to the prem ises to see ii somebody Is on site that has got a password, so that a simple error by a user doesn 't resu lt In a dispatch . And. addll lonally , the City proposes three ,ypes of phys ical verif icat ion and !hat the alarm signal won 't be respondec to unless there are at least two dev ices that are Involved In causing the alarm or a video or aud io verification or. finally, corroboration by an una!liliated th ird party. And I th ink that thos e are all to the good . I think those can be effect ively implemented at no or very modest cost to alarm system users and they should dramat ically reduce the false alarm exper ience that the City has . My concern relates , primar ily, to the second part of the proposal. which is how the police will be dispatched in response to alarms both verified and unver ified . And my read ing of the in ternet posting , bas ically , Indicates that the City will no longer be dispatching a part icular ollicer to an alarm, but rather "broadca,ting the alarm " and at that po int in time , ii an ollicer is available and is inclined to respond to the alarm , then an Jllicer will respond . My content ion is that that, tor all practic al purposes, is a non -response pol icy . Ancl wt-al I would li ke lo try to encourage the City to do is , since they are implementing some very su t stant ial ve rification procedures , lo continu e with their current pract ice of dispat ching an ollicer to an address that has an ala.r m and wait and see if perhaps the stat istics don 't greatly improve, as a result of the verif ic at ion , before they go to what I would regard as be ing a rather draconian non-response . Now it Is poss ible that I have • simply mis read the internet posting and I am sure that that is not a comprehensive discuss ion of the po lice • polic y, but th at is how it reads to me and I would reall y be concerned if I were a citizen that really does rely on an alarm sys tem to protect the ir home while they are working during the day or a business that , you know , is unocc upi~d at night. You know, a lot of people really re ly on alarm systems to protect the ir property . I have been a long standing advocate of responsible al1rm uses and I work very hard with my customers to make sure that the ir equipment wor ks well and they are ec1ucated and informed on ho w to use it. I try to use the eas iest equipment that I can. I want to do everything I can to prevent false alarms and I th ink my results show ii. I thi nk I have excellen t fa lse alarm statist ics . They inev itably happen , in sp ite of everyone 's best efforts . I '.hink it really would create a si!uation that could be very dangerous to property owners , ii the City were to go ahead as th is proposal ind icates . Than k you very much. Mayor Wolosyn said thank you Mr . Hoagland . I would like to add that on April 3~ Council will rev isi t th is and that th is new pol icy will not be implemented until Coun ci l rev isits II. And all of the thing s that we are hear ing , such as your remarks , are apprec iat ed and will be addressed aga in on April 3''. Mr. Hoag land sa id I would certainly be happy to volunteer any lime that you might find useful . I have quite a bit of experience in th is field and if there is anything I cou ld ott er in terms of background or knowledge or whatever , plea se feel tree to call on me . Thank you . Mayor Wolosyn sa id thank you very much . 7 . Recognition of Un1chedufed Publfc Comment (a) Don Ramer , 3720 South Lipan , said we have four un its on Lipan down there. We have an automotive repair facility and remanulacturing business and also a fabrication facil ity . He said th is is my partner , Jim Murray of the same address. We started a bus iness here In Englewood In July of 2004. We bas ically have a very quiet bus iness . We do a tremendous am ount of repa ir work tor the federal government as tar as U.S. Marshals . We do Comcast Cable ... we do a lot of what we call municipality and fleet , government types of veh icle repa ir. Up to about the first 9 or 1 o months of our operat ion of bus iness , we ha'Je had an extremely ... ! would say ... very good ne ighborhood . Since that lime , we have had a large Increase In vandalism and destruction of property to our bus iness result ing in thell of art icles and automob iles ... random damage to them in exce ss of thousands of dollars . We have had no lalae alarms In our bu1lne11es . However, we are concerned about thla, because H thla w11 to go forward, that would )uat glv,; the crlmlnala more time to get Into the building and Inflict more damage before aomaone could get out :;,ere and do anyth ing. I think that needs to be addressed or looked at , probably a little bit more thoroughly, In our opinion . We have also had a tremendous amount ol activity at the and ol our street , which the ~nglawood Police Department Is doing their best to try to alleviate, but, apparently, we have had a business that moved Into the and ol Lipan and , from what we understand, thla buslnaas has been booted from the City ol Sh~ridan , because ol problems that Sheridan had with them . We are concerned, and all the area business owners on Lipan are also concemed, because since they have moved Into our neighborhood, our crime has just skyrocketed . What II appears to be is a chop-shop and we are real concerned and would like to have the City look into th is. There has been drag racing on the street , which Iha City ol Englewood has also triad to clamp down on . These people have bean so bold ... lhey are only about live blocks from the Englewood Police Department...and they have even had time lo set up lights on top ol the building , including a Christmas tree, to start drag racing with. We have done everything on our end to alleviate II and now we are trying to come to the City and say ... in order tor our businesses to stay down In that corridor, we are going to need some help . And II we can't get II addressed a little bit more formally and get it under control , we are going to be forced to move our businesses . There are already vacant buildings behind us now . That also is causing problems . People are not wanting to mo•1e into these businesses . Vacant bu ildings left tor long periods ol time are a haven tor people to sit in those parking lots and also become a little bit more criminal and this Is what we are see i;1g . So , we wanted just a tew minutes ol your time . We wanted to thank the Englewood Police Department lr,r what they are doing , but we are In hopes that maybe !he City Council will take a look into this and pos~ibly even the corr idor where the light ra il is .. have even had some issues with the light rail, where people have come from downtown . We had one gentleman who was literally almost beat to death and he crawled 01• of light rail, came Into our place ol business alter hours and had to be removed by the paramed ics, t ecause he was bleeding all over our floor . The reason I am telling you this is because we have a big problem down on Lipan and it needs to be looked at. .. and also Windermere . So , if you guys have any extra funds this year, we would like to open our business up and see ii there is something we can do to help . We want to stay and we want to see if we can make a big impact In that corridor , but we are going to need help. Mayor Wolosyn said thank you . Director Olson said we will do some more research on it. Obviously, as he indicated , we are doing extra patrols and other things down there right now, but this Is the first time that II actually has come up where this has been , as tar as I know , a significant problem that I am go ing to have to deal with . II is going to involve , obviously, some more targeted enforcement kinds ol situations and we will see ii we can work on that and we will work with them , as we have been doing . I have had two diflerenl alarm companies that I have worked with . I, as well as the two alarm companies I've worked with , have been very concerned about false alarms . T;1Jt Is my first concern , !rankly , ~ ,ving Englewood Pol ice respond lo false alarms , especially when I hear these horror stories about companies that don 't do verification . That really boggles my mind . I can't imagine a company not doing that. I, and the companies !hat I have worked with , have worked extensively to avoid false alarms . We have been vary responsible 11sers al the system. In tact, I wrote a letter ol apology to the Englewood Pollcf, Chief , some years ago, wh,in I actually did have a false alarm and the police had to come out. I was initially concerned about the kind ol tNo tr ig ger policy , or whatever you want to call it , where you actually havP to have a motion detector and a door alarm go all, or something like that. II seemed that was kind al like asking a crim inal to put on a show ... to wave at all the motion detectors or something, before they left. But having consulted with my alarm company ... they don't seem very concerned el> ,ut that particular thing ... ! will trust his judgment on that. False alarms are part of the deal , II you have an alarm system you really can't avoid having some false alarms and I have had a lot of them , but the percentage that actuallv went through to the police , Is actually very, vary small , because most ol them ... l trip the alarm , I walk in too late, I trip the motion detector , I get a call trom my alarm company, I give the password and the police are never Involved In the process . So , I mean I can 't Imagine ii all my false alarms had gone through to the police , that would be an amazing problem, but the tact that I have always had a responsible alarm company , that has never been the case . I will say In conclus ion, that I just hope that respons ibl~ alarm companies and responsible users of alarms are not penalized by kind of a knee -jerk, broad-brush policy that kind of presumes that we are all irresponsible, because I'm as bothered by false alarms as anyone, because when I see them happen, I know tha l I don't want to be the alarm owner who cried wolf . I take it very, very seriously. I hope that the Counc il, when they make their decis ions and the police when they construct policy , will take into consideration that there are a lot of us out here who really do wanl to be part of the solution and not the problem . My apartment laces out to Broadway. From 9 o'clock in the morning until bar-closing , all you hear all day is rmmm-rmmmm ... packs of them going up and down Broadway. Now they are so loud that they set ott car alarms of the cars parked In the lots nearby or those parked on the streets. So alter they go by , you • hear weoooo-weoooo -weoooo . I hate to give sound ellects, but from 9 o'clock in the morn ing until bar-clos ing , lhat is all we hear ... especially when the weather is good , there are about 40 ... they are all out . And , with the summer com ing they are going to be out every day ... almost." Some come up through the neighborhood and my windows shake . I represent the tenants at Simon Center and they complain too . So , are you working on more ordinances to get the no ise controlled from these Harleys? Mayor Wolosyn said this is one of those issues that I am going to ask Direc;tor Olson about. We do have no ise ordinances , right? Directo , Olson sa id yes , we do ... we have noise ord inances, that is correct . The dilliculty is in the enforcement side and it is literally having to determine the decibel level where the no ise ord inance would kick into play . I understand the ir concern . It is a problem . it is a problem throughout the melropolitan area. I know down in Loda and so forth , it is a major problem down there, but , literally , the ditticulty is of an officer being in proximity and .. it is go ing to have to be a pol ice ollicer ... not just a code enforcement ollicer . A police officer is going to have to be in some sort of prox imity to where these folks are , have a meter to determine the decibel level and then determine whether it violates the City's no ise ordinance , which in itself is a relatively minor violation and the City Attorney could probably confirm that. But we do have an ordinance in place , it literally is the enforceability side of it. Mr . Craft said okay, it is just very annoying , especially in the summer . But, after a little bit of time and pracllcality, they realized that they thought that it would be easy for one JI the providers to be able to provide the In -class training . That proved to be a lot more dif!lcult than we realized . So, the two reflexologists practicing in the community would have had to start, basically, over again with another course , which included classroom and hands-on. So we thought, most of these people have worked In the City for quite a bit of time, have much more hands-on experience than Is required in the license and what we are recommending Is that we, basically, waive that portion ... the hands -on portion of the educallonal requirement and allow thoso two people, that pract iced In the City on September 1, 2005, to go ahead and be licensed and then all others going forward would be raqulred to have that full in-class and practical experience that is In the license as passed in November 2005 . (b) Council Members' Choice (I) Council Member Barrentine said I am really sorry that Doug Cohn left , because I just had a resolution, after almost a year, of dealing with an identity theft. And, he is incorrect...identity theft is illegal. II is proving it that might be difficult. It was brought up at a ne ighborhood watch meeting , Sergeant Schellpfeffer did a beautiful job in pr;;,vid ing Information. And I also went to a meet ing ... the Arapahoe Count y Sheriff has a task force work ing on ,1 and they handed out informat ion on dea li ng with that as wel1. The unfortunate part ... and tha legislation just passed th is last year ... is that you hava to be able to prol'e it, while those instruments you need in order to prove it , don't necessarily come to you . They are going to someone else or a collection agency. I was able to work with the Distr ict Attorney, Carol Chamburs , who did a wondertul job wiIh the Judic ial 18th bad check writing organization, to try to turn these back over to the police , so that they can be invest igated. I had nothing but cooperat ion from everyor.e .. .from Vince Atenc io in talking to him about what was going on , because one of !he checks had been wrille n in Englewood and I was able to find that out...and Chris Olson has been very interested and been on top of it. And so I th ink that they gave a presentation at the Neighborhood Watch . I think they are very on top of whal is go ing on and they knew about the legislation right away and they told me what things I would need to collect in order to have that happen. Fortunately, f hope it has been taken care of, but it has nothing to do with my account or my name or my address , so quite honestly I wouldn't have bsen able to prove identity theft , because they never commilled a cr ime against me . But it is still illegal and I th in!< Englewood is doing a beautiful job . They were very up to date on it and they were culling edge a year ago when they did that presentation . I know that Jim Woodward was at that one as well and I th ink • they have done an excellent job. So , I'm sorry that he didn't slay , because an awful lot has already been done • and they have focused on that. I appreciate them in keeping up with me on wh at was going on with me too . Some additional leg islat ion is being looked at in order to try to help the people that fall into these categories , bet it is very difficult. All these people had to do was put my name on a check with some number . It wasn't even a real account. So , qu ite honestly, it is a matter of what the businesses are go ing to do and how they are go ing to crack down. It is kind of open ended, but it can really hapµen to anybody and you don't even need trash to go through or loose a purse to have it happen. But, I can 't speak highly eno ugh of the Arapahoe County Sheriff and our Poli ce Department and what they have done over the last year on th is. I just hope we keep up our standards and don 't allow a few of the citizens to co;~e in and allow us to have less standards than we really need. It is unfortunate that it is clear there is a problem , that we have laws to deal with the problem , but we jus: don 't have a practical way to deal with It. I remamber from one of the last reports we had on the Harley issue, that part of the problem is that the laws are ... if I am correct...how they come out of the factory is fine and II is the modification; that are done afterwards that are almost impossible to distinguish .
