Call to Omer ENGLEWOOD CITY COUNCIL ENGLEWOOD, ARAPAHOE COUNTY, COLORADO Regular Sea ■lon March &, 2008 The regular meeting of the Englewood City Council was called to order by Mayor Pro Tam Woodward at 7:37 p.m. 2. Invocation The Invocation was given by Council Member Barrenti" 3. Pledge ol 1,lleglance The Pledge ol Allegiance was led by Mayor Pro Tom Woodward . 4. Con ■lderallon ol Minute ■ of Prevlou■ Sea■lon (a) COUNCIL MEMBER TOMASSO MOVED, AND IT WAS SECONDED, TO APPROVE THE MINUTES OF THE REGULAR CITY COUNCIL MEETING OF FEBRUARY 21, 2008, Mayor Pro Tem Woodward asked 11 lhere was any discussion or corrections . Mayor Pro Tern Woodward said I do have one. On the last page under Council Members' Choice, for mysell, In that second line at the end ... the sentence that starts 'if they were to come In, In tears ... the delinquency' I think what I said was, II they were to come in and cure the delinquency. And two paragraphs down It comes agaln ... 'so H they did come In and cure." Mayor Pro Tern Woodward asked If there were any other corrections . There were none . The minutas were approved as amended . 6. Recognition ol Scheduled PJbllc Comm ent There were no schedulad visitors . 7. Recognition ol Unscheduled Public Comment (a) Marl : Swanson, 2836 South Sherman Street , said I am here lo ask the City Council for the City to in vestigate the termination of my permit. I was here in Novembsr and I am not satisfied with Mr . Sears ... the City Manager's response to that problem . In his rosponse, he says Iha\ the City has followed proper procedure and furthermore Is obligated by adopted ord inances and codes to adm inister and enforce these codes as wrillen. Well , the City has not done Iha! and I am not sat isfied with Iha! answer . Now , my City Councilman met me on Iha! property and spoke lo a man that had worked on Iha! fence property with me and Mr . Tomasso's response was well , you should have written the rran a check so Iha! you would have a cancelled check to prove what you are do ing here ... wllat you stated . The man who wo ,ked on that property with me has been an Englewood res ident si :1ce 1960. He operated a backhoe for me In mid August to set a post. I brought some pi ctures along with me . :~ow that permit , that I pa id money for , was a contract with this City to build that fence . Now , Mr. Tomasso al so told me that my problem was that I rubbed somebody the wrong way down here . Well , Mr. Sears should have put that in his explanation here to me, because it is not in here . That project was started within the allotted time , which is 180 days , on this permit. Mr. Sm ith, the Build ing Insp ector , look ii to the City Alto, ney and he said , well Mr . Swanson, what you neglected to do, is to read further down in that paragraph where ii slates there are other applicable City ordinances Iha! apply lo you r silualioo . Well, in Mr . Sears' , .. sponse to me , I see no explanation of • other City ordinances pertaining lo that perm it. So, I would like lo know why I'm not gelling a just investigation and • why this permit was terminated . Also, while this was happan iog, the lances that"'~ directly behind this property were both built without perm its . Now I still haven't gotten an ex(anatlQn for what is going on wi th them ... one of them is falling over. I paid my money, I went lo the Zon ing Comm ission hearing and was allowed lo use the material that I wanted to use on Iha! fence . Now , what does a guy have to do lo get a fair shake in this town? I played by the rules . The City is no' playing by Iha rules . If th is is true what Mr. Sears said ... thal you guys are obligated 10 follow these co des as tney are written, then there needs to be an investigalinn as to how this happened . If we need to take a polygraph test or inte,vi •iw some of the neighbors, that needs to be done , bul I'm not going to stand tor th is. I am in a lJ ad situation . I need the material that I re quested to use on that fence and that permit was unjustly pullen from me . So , I would like to knc,w what I can do about it. Mr . Smith says that I need to pull another permit. What am I doing? I've already pulled enough pemnits . The people behind me have no permits and they are allowed to do that and lhe properties have changed ~ands . One lady who bough! this property with the fence falling down, she is a cancer survivor, she Is 65 years old and she said please don't mention my property tu lhe City Council, because I cannot afford to fi x this fence. Well that fence should never have been like that if the City was doing its job , but they were too busy w1lh me . So, here we have a new property owner, these people haver'! paid any money ... the original property owners paid no money for building permits and the City ignored them . Joyce Pa rsons was at that property ... she said, we are not cc,ncerned with anybody but you ... well cbvlously not. I would like to pass these photographs up to you guys . Two of them ace fences thE t were built right be r,i nd that property and one is the property that I am trying to ~ut a fence on . Now I can ·• use s12.ndard materials on that property , because of the incline, there is a sleep embankm ent that goes from the ~lley down to the property. II drops off from 5 feel , over a 75 foot run, and er,ds up at about 3 feet. So, during th is public comment time, do you guys respond or do f have to wait for another letter from Mr . Sears? City Attorney Brot,rnar aaid it is Council 's procedure that they don 't respond at this lime . Mr. Swanson said okay . Mayor Pro Tern Woo, 1ard said if that Is all , I guess what I would ask Is if Mr. Sears could prov ide us with all of the correspondence . City Manager Sears said I think we have done that a couple of times ... given that to the Counc il . Thar€ has been seve ral contacts with Mr . Swanson ... there has been two applications, that I am aware o:, for • fenclny and then there was a change. So , we can provld~ Council with the history. Sears , In your letter here it says you guys are obligated to adm inister th is Code as they are written and this permit states that this work has to start with in 180 days from the date of Issuance and It had been . Mayor Pro Tam Woodward sa id Mr . Swanson your time is up and we need to move on and we wi!t look Into someth ing and somebody will be gett ing back to you . Mr . Swanson sa id okay, thank you . (b) Approval of Ord inances on Second Read ing (i) ORDINANCE NO . 4, SERIES OF 2006 (COUNCIL BILL NO . 4, INTRODUCED BY COUNCIL MEMBER WOODWARD) AN ORDINANCE AMENDING TITLE 2, OF THE ENGLEWOOD MUNICIPAL CODE 2000 BY THE ADDITION OF A NEW CHAPTER 11, REESTABLISHING THE ALLIANCE FOR COivlMEh CE IN ENGLEWOOD (ACE ) FOR THE CITY OF ENGLEWOOD , COLORADO . (c) Resolut ions and Motions (i) The purchase of a Ja cobsen HR5111 mower throuah the State Bid process , in the amo unt of $44 ,090 .00 . (ii ) The purchase of one new ten-yard dump truck trom Transwest Truc ks, Inc . in the amoun t of 582 .159 .00 . Ordinances, Resolution and Motion• (a) Approval of Ordinances on First Reading • There were no it ems submitted for approval on first read ing . (b) Approval of Ordinances en Socond Reading There were no additional Items subm ;tted for approval on second read ing . (See Agenda Item 9 -Consent Agenda .) Englewood City Council March I, 20CNS Page4 (c) Resolutions and Motions (I) Director Gryglewlcz presented a recommend&tlon from the Finance and Admh .. stratlve Services Department to adopt a resolution approving the appropriation of fu nds for the Conservation Trust and Open Space Funds and transferring funds from the Servlcenter and Capital Equipment Replacement Funds to th9 General Fund . He said this resolution Is for the Conservation Trust Fund and the Open Space Fund. It Is Just re- approprtatlng funds that were budgeted In the previous year, were not expended and are being re-appropriated. And those transfers to the General Fund were Included In the budget ordinance, but they were not Included In the ordinance of the Servicenter Fund and the Capital Equ ipment Replacement Fund . COUNCIL MEMBER BARRENTINE MOVED, AND IT WAS SECONDED, TO APPROVE AGENDA ITEM 11 (c) (I) • RESOLUTION NO. 37, SERIES OF 2006. RESOLUTION NO. 37, SERIES OF 2006 A RESOLUTION APPROVING SUPPLEMENTAL APPROPRIATIONS TO THE 2006 BUDGET FOR OPEN s·•, \CE AND CONSERVATION FUND PROJECTS THAT WERE STARTED IN 2005 BUT NOT COMPLETED IN 2( J5 AND TRANSFERS FROM THE CAPITAL EQUIPMENT REPLACEMENT AND SERVICENTER FUNDS . General Dl1cu11lon (a) Mayor's Choice Council Members Barrentine, Mr.Caslin, Moore , Woodward, Tomasso, Oakley None Mayor Wolosyn (I) Mayor Pro Tom Woodward seld I attended the Arapahoe County Metro Mayors Youth Awards ceremonies last Wednesday, where we were quite well represented, with a number of our youth rece ivi ng awards . Also, the selection to determine the metro-level recipients was last Friday. That Is quite the program and I am really lmprnssed and happy to be a part of that. (ii) Mayor Pro Tom Woodward said I would like to request , Gary and Chris, If mayt,e we could schedule a meeting . Bob McCas lln and myself met with Dan Stocking from Colorado Burglar and Fire Alarm Association , and some other Individuals , Friday afternoon and suggested that perhaps , a few of us could get together befora the information comes In from Safet;· Services for our April 3•• meeting and maybe we ~ould come up with something that might work with regard to our response . (b) Cou ncil Members' Choice (I) Council Member Barrentine said I wanted to th a~k Community Development for the Economic Development meeting that we had . I thought It was one ot 1i 13 more positive ate~• that we have made In the last couple of years. There waa a lot of g,1od discussion that went on !n that vein. I went ahead and talked to Darren Holllngsworth . There are a tremendoud amount of properties openln] up on Broadway, 10 It looks Ilka there • • should be development going In . He Is going to go ahead and talk to several bu1ine11ea along there that are • Interested In the Enterprtse Zone money for slgnege and redoing some of their frontage . One of the concerns was the property, an d I talked to Lou Ellis about this ... was the March Hare property and what was going on with that. They He going to be splitting that up and they havo a Publ ic :~eertng coming up pretty soon on a liquor hea r Ing and I woulc' like to know whet is going on with that. Farther down on Broadway , there haa been some , at least In their • • Englewood City Council March e, 2008 Pages perception ... some Increased criminal activity. I have talked to some of those businesses down there. Darren is also going to talk to th~m about trying to do some redevelopment and some remodeling plans they have . I heard from a couple of peop 1o, from the Kimberly Woods area, that we 've got some people moving out of that area . It has come to my attention that that apartment complex has come under new management...lhat there Is no longer night security there , that they don 't have someone patrolling that property, that some cars have been broken into and some other problems ... that there are some questionable people moving In to where some of these people have lived for quite some lime. They are lea•1lng ... considerlng that they are leaving a bad area . And, n,y concern, of course, Is that they are consider ing and that can happen quite qulckly ... to have that perception ... they are leaving a bad area , where less than half a mile away we are going to be bu il ding million dollar town homes and I would kind of like for that perception not lo happen . So , if II Is possi ble , if we could get an update on what is going on in that area ... maybe it is just their perception . If it is just a few people involving st'•Tie incidents that have happened or whether there Is a down hill progression going on because they are not pr.yin g attention to things ... l just would be interested to lind out what your thoughts are on it. I appreciate Commum ·1 Development's support and willingness to go out and talk to these busir,esses to try to get this South Broadway s1ulf turned around ... get some activity go ing on down there. (ii) Council Member Mccaslin said I would just like to thank Joyce Parsons and Sergeant Condreay . I had a couple of issues with some residents and they are checking into it and so far they are doing the job . Thank you . (iii) Council Member Tomasso sa id I would like to make sure everybody remembers the Englewood Schools Art Show Thursday night in the Library and also the book sale in the Library that same evening and it continues Friday and Saturday . 13 . City Manager's Report (a) CilX Manager Sears said just to remind Council of the upcom ing schedule . We did list, tentatively, •he date of May 201 as a Budget Retreat. Thal is another Saturday, unfortunately, but it really does help set us a direction for the budget for th is year . So, if you will take a look at your calendars an:l we will get back to you . (b) City Manager Sears sa id there is a Tri-C ity meeting ... there is a proposed agenda for the Tr i-City meeting on the 24'" and we are hosting that. Mike is kind of pulling that together and we forwarded that Information to the other cities. (c) City Manager Sears said Jim, Olga and I will be al the Nat ional League of Cities Conference from about Friday afternoon until next Wednesday afternoon . 14 . City Attomey'a Report City Attorney Brotzman did not hav e any mailers to bring before Council. 15. Adjournment EM WOODWARD MOVED TO ADJOURN . The meeting adjourned at 7:56 p.m.
