Call to Order The regular meeting of the Engle wood City Council was called to order by Mayor Wolosyn at 7:41 p.m. 2. Invocation The invocation was given by Council Member Barrentine . 3. (b) Mark Swanson , 2838 South Sherman, eald at the last City Council meeting I was here and I asked lor the City Council to Investigate my permit situation over the use ol utility poles . I got a letter back from Mr. Sears and I don't understand it. Mr. Sears says the City has done everything that they can do to look Into this matter , yet I spoke to Mr. Tomasso , my City Council representative . He came over to my house and talked to the person that worked with me on that le~ce , before that permit was expired and I would like to know why Mr. Sears cannot interview those people 1·1ho are aware that that fence had commenced before the time llmlt of 180 days was over with . I haven't seen that happen yet. Mr. Tomasso Is aware of It , so I don't know why Mr . Sears wouldn 't be aware ol it. The other part ol this ls ... just In order lor them to deliver this letter, I had to have an appointment with Chief Building Olllclal Lance Smith and the Director ol Safety Services ... to deliver a letter that could have been put in the mail lor 39 cents . What I don't understand is with all that ellort , two people, lik,, the Director ol Safety Services and the Chief l:lulldlng lnspector ... wouldn't it have been a little cheaper just to send It in the mall ... and use that manpower and go over there and talk to the people that were Involved in it, and see ii that was what happened? Like in your letter ol December 13'" you state that you are obligated to folio• the law as it Is written. So, II that is your position, whv ignore those two witnesses that knew that that work had commenced before that 180 day period was over? I don't understand why I get so much attention . I've never had two people deliver me a letter in my life. Yet, over this matter, you are going to send the Director ol Safety Services and a Building Inspector out. I have to have an appointment to get a letter . It is a first time ... most ol the time II comes In the mall . And three weeks before that, I was working on my property and Chief Building Inspector Lance Smith drove up the alley . So I said, well how are you doing Lance, so what are you up to? He said well I was sent down here to check you out...to check this, •c oerty out. I said , well who sent you? He sa id one ol my bosses . I said , well which boss? Mr . Smith sal ~ ,; I can 't divulge that to you , I'm here to look over things . He looked over things and never got out ol his car and left. Well, ii you can send • him over there to look over things, can't you send him two houses down and talk to some ol the people that • were Involved in it when ii happened ... and can verify my claim that I started that work before that period ol 180 days was over? I just don't understand why the City cannot look Into it. Ray Tomasso looked into it. He came over . 01 course , he didn't have much to sa y. He said , you should have written the man a check, so you would have a cancelled checl ; to prove your poin t. Bu i we are neighbors , we don't exchange checks . And as close to Mayberry as this place is ... ln my block wo don 't do that. In fact , I know everybody In the court house ... they know me by sight, my address, my problem about the fence . I just don't understand why the City Council cannot direct Mr . Sears to look into this issue without sending a letter . This letter that I got, the same one that you got, says nothing . He didn 't look into anything . He reviewed some papers and sent out the same letter that ha sent out before. So , I would like to petition the City Council to Interview the people that are aware ol the tlmeline ol the commence ment ol that work and ,!o, as Mr . Sears says, follow the law as it Is written. That Is all I've got to say and I hope that I can get somebody to look Into it, because Mr . Sears is not looking Into it. Thank you . Mayor Wolosyn said thank you . 7. Recognition of Unscheduled Public Comment (a) Frank DeHofl, 3160 South Delaware Street , said my lilt speech ton ight Is about the recreation vehicles that park ov er at Wal-Mart. I realize that Is a real nice thing , bu,, .. at is not Wal -Mart's business . And, I don't think that we should encourage them to have people come in and park free and say, hey, you know th is is a nice thing, but there are other people la our community that own mobile home parks and so on and they have put an awful lot of money Into them and that is their livelihood . I think that trying to look at business and trying to get people to come in, I think that Is something we ought to look at. And, another thing that I have noticed, I think some ol these guys are kind ol playing a game with this Wal-Mart free parking . II you drive by and watch the parking lot, you will see certain vehicles that are parked over there and they will be there for three, four, five or six days and then disappear for awhlle ... and then they come beck . I just kind of wonder If maybe what they are doing Is they are leaving the Wal -Mart parking lot here and going to another nearby Wal-Mart ... you know, • making the rounds. It sure saves the heck out of any lee they would have to pay to properly store their vehicle . So , It Is just another thought that I think we ought to look Into . II they come from out ol town, stay for a day or two , yes , maybe that would be one thing , but I don 't think e,at Is happening with some ol them . And that Is all I've got to say . (b) Allee Hanna, 4420 South Elatl Street, said I am the President of Englewood Unleashed and I've Just come to say hello . You are probably wondering where we have been . We have been qulet .•. and you are probably happy about that. But , I did want lu give each of you some Information . We have started the brick fundralaer and we have these wonderful brochures and wanted to give each of you a copy . Al th is time we have not signed the agreement with the Clty ... I1 la still being dratted. So, we are holding the checks until the City agreement Is finalized and then we will go ahead and depos it those and then proceed . May 1" Is our deadl ine for Phase l ••. so that we can have the bricks Installed by the time the park opens at the end of July or the beginning of August. And I also wanted to let you know that wa are having a Chill Cook-Off on April 29~ at the Malley Center and I brought some information on that. So , wa are really In the phase where we are trying to raise money. Our goal Is to raise $10 ,000 .00 . That , of course , Is a goal. I don 't knov, II Parks and Recreation has come and talked to you a little bit more about what our Intentions are wi',h the funds , but all the funds will go directly to the Park. We have already talked with Parks and Recreation about d;llerent Ideas of what we can do to sponsor, perhaps a port-a -potty cleanup in the area, and maybe some different amenities for lhJ park ... some dog agility courses or something like that. We haven't even come to that decislon ... we are just In the first phase . So , I Just want to drop th is Information off and ii anyone has any quest ions , you can gel a hold ol us . General Dlscu11lon Mayofs Choice (I) Mayor Wolosyn said I went to the NLC Conierence last week with Ma yor Pro Tem Woodward and City Ma nager Gary Sears . I will be subm itting a short report, but I will tell you that I did find It helpful. I haven 't attended one ol the litt le classes lor awh ile , the ones where you sign up, and there was a good one on parliamentary procedure and I found it very hel~lu l. I will pass along some ol the information to the rest ol Council. (Ii) Mayor Wolosyn sa id this weekend we had the opening ol Hampden Hall . It was a very successful open ing . I would like to thank everyone on the stall, which Is virtually •veryone , who part icipated and he lped . I would like to thank Council lor attending . We had pretty much lull capacity lor every event except lor the third one on Sunday, when the weather was sort ol moving In , and that was probably not a well scheduled event , considering Mother Nature that day . But , it was a great and prom ising waekend and I hope that we can build a structure to make that room very successful In the luture , to mirror th is weekend . (b) Council Members ' Cho ice (i) Council Member Barrentine : 1. She said I wanted to thank the Mayor . She did a very good Job at the opening ol Hampden Hall . II Is a nice facility and I thought It was a nice opening event and I'm glad my son and I attended. We had a good time . 2. She sa id then we were fortunate enough to go over to SteakHouse 10 and UnDlc l to celebrate my son getting his brown bell and I could not believe how packed they were and the kind ol cllentele that these • • businesses are bringing Into Englewood . So, I am very glad that they are successful. I mentioned earlier In the • Study Session that the strip mall that Is across from them ... they had commented that they were doing much better. And having that discussion, over the last coupl ~ ol waeka or maybe Into a month now, there Is a lot ol really pos,tlve energy, ever since the Economic Development started going out and talking to bus inesses. Especially where we are having a lot ol trouble on South Broadway, but a lot of really positive comments about • • • Englewood City Co~mcll March 20, 2008 P1ge5 our Community Development Department. And anybody who would ever read the minutes would know that that haa not always been my position . I have had some complaints and some concema over the last two years and I am glad to see there Is an energy developing . People talking to Darren and people having a lot better working relationsh ip and I wanted to say that It 11 greatly appreciated and will make a huge difference . We've got a lot of people coming In with some Ideas tor things ... the Merchants Aaaoclallon and Poalllvely Englewood are working on some . Just a lot of positive comments about hav ing a good working relallonah lp and ii makes a difference, b&cause It keeps that creativity going and people wanting to go a~ead and move forward Ins tead of feeling that they hav& a road block . I wanted to thank Bob tor that , It Is gre ~tl y apprec iated . (I i) Council Member Mccaslin sa id I atta nr.ad a Boy Scou t PancakG Breakfast. .. I think ii was two weeks ago . Very nice , they did a nice job , so I just wanted to commend the Boy Scouts tor that. (I ii) Council Member Tomasso : 1. And , I would like to see ii the Counci l would be willing to support him by issu ing a ~roclamallon at the Ap ril 3'' City Council meet1ng. Council Member Barrentine said I think that is an excellent idea. I saw that articl e I day on tne web site and It was very nlci and It highlights Englewood . And , I am glad he Is on tho L!b ;ary Bua rd, because that way they got to mentioe Englewood too ... so , I agree . Mayor Wolosyn said I would like to add that from 4:30 until 6:00 p.m., t~is Wedn esday , down at the Denver Public Library, Chris will receive th is award . I am go ing to make an attempt to be down there. [Clerk's note : The was listed on Iha Agenda as item 1 L (b) (I)] 2. He said I think the one th ing that happened at Hampden Hall on Sunday, was the excitement generat ed by the Englewood Arts programs, the school programs and the presentation of Str ings Attached and with the play presented by Cherrelyn School. .. a really moving presentation . II really brought the community together and ii showed what the room could do tor the commun it y and tor the schools. 3. He said, addressing Mr. Swanson, I did spend three hours with him standing on that piece of property , talking with him . I did look at the telephone pole and I did talk with his neighbor, who said that he had worked with him in August on placing the telephoee pole . I am no expert on telephone pole placement. All I can say was It was a lot stralyhter than most of the telephone po les the phone company puts In. But, other than that, I could not ascertain exactly as to a date or time when the pole was put in, but his neighbor did say that he helped him in August to Install the pole ... il that muddles the water or clarities the water ... l don't know. (Iv) Council Member Woodward : 1. He said I just wanted to mention that I think the grand opening of Hampden Hall was a real success and the Back to Bach concert was a sellout. As tar as I could tell, it was standing room only. I was really pleased, although I don't hear that we ll, the acoustics seamad to be great In there and worked really well . It is a~ exciting time and II Is a room that I think Is going to ba a great asset to our community. 2. He said I want to mention the National League of Cities Conference that I attended, with Mayor Wolosyn and City Manager Sears, was a real benefit and, In I!•, future, II any Council members have the opportunlly to go, I would reslly recommend It, because there Is ju11 a whole lot of networki ng going on and a lot of things you can learn through the different classes being offered . 3. He said, again, just going over the lnfom,atlon that has been provided by Mr. Sears regarding Mr. Swanson's lence ... l guess the things that really come to note to me are that this fence, as far as I can tell , started In January of 2003. It was reapplied for in J1Jne of 2004 , using telephone poles as lance posts . That Englewood City Council March 20, 2006 P1ge8 was prior to ma being on Council, but I remember being at a Council meeting when ii came up ... the whole question ebout telephone poles and the safety of utilizing telephone poles as fence posts . And, I know that It went back to the Planning and Zoning Commission and there was lots of discussion that went on with c ;1y Council and, I believe, with Planning and Zoning. And, it was decided through an ordinance that that was not a proper material tor tenc6 posts In a residential area. And you had already had your permits and those permits went through the 180 days and then the second 180 days, as I understand It, and than lapsed. And, like with other permits, you would reapply tor a new permit under whatever ordinance is in place at that time . That Is my understanding of It. So , I believe Mr . Sears has done what Is correct here and Mr . Smith In doing what Coun cil had wished them to do . Mayor Wolosyn said regard ing Wal-Mart, I understand that Is private property and that is their dec ision and it Is not a City issue . City Attorney Brotzman said that is correct. Mayor Wolosyn said I wanted to make that clea r. 13. City Manager '• Report (a) City Manager Sears said the Council is going to go inlo a Study Session . When you ge i there, there are a couple of items thal are there . One is the proposed agenda for lhis Friday tor the Tr i-Cities meet ing. We are hosllng that and we are going to conduct a tour of Hampden Hall . Then, next Monday night, there is a proposed agenda that you will receive . Basically, it Is the Parks and Recreation Master Plan Study and then Public Comment and then a tour of Hampden Hall . I would also like to say thanks to the stall. They worked • tirelessly to make Hampden Hall work. I lhlnk it has been great working with stall and with City Council. I think • it really was a success and I will pas~ the comments on to Council. (b) City Manager Sears said we rtid win, through Bo~·s ellons , the Denver Regional Council al Government's two awards tor the work the City nas done on the bus system and on the catalyst program . We have those letters there. There is a meeting on April 26th .. .it is in the letter ... with DRCOG .. .it is the dinner to recognize the award winners , so I encourage Council to attend that. 14 . City Attorney's Report (a) City Attorney Brotzman ,aid there also is a proposed Execufve Sess ion, but you can pick that up In the Study Session following th is meeting . 15. Ad)ournment MAYOR WOLOSYN MOVEO TO ADJOURN .
