He sa id th is supplemental appropriation for your cons ideration Is due to training requ irements , ret iremen ts, injuries, surgeries and some vacancies in the Fire Divis ion , that were not known at the time that the 2006 budget was implemented . This is a request for $50 ,000 .00 for Safety Services, Fire Division , which will come from the General Fund Unreserved/Undesignated Fund Balance . He said, as you may recall from past years , we combl~9 ail three of these Into one contract to take care of the economy of scale and get us better pr icing . The 2006 Concreta Utility 1 ,iii repair concrete in front of approx imately 400 properties , the Conc rete Program will install handicapf)Eod ramps at 43 intersections around the City and the Sidewalk Missing Links location Is not finalized &I th is lime . We would lik e to attend a City Council Study Session and discuss the priori ty list for the Sidewalk Mhlslng Lin <s. The Publ ic Works recommendation Is to continue to extend our current contract with Thoutt Brothers Cor.crete contrar.tors . Thoutt Brothers provided excellent service in 2005 . We were pleased with the ir quality of work , their pric ing and their timeliness . Thoutt Brothers was flexible whenever we added work . Last year we added the Cushing Park Skate facllit)' and we added the traffic med ians that we Installed on West Oxford Avenue and they held their un it pricing and worked with us very well . You may recall that last year there was a rather severe cement shortage and that caused concrete prices to Increase as much as 25%. A lot of contractors couldn't even get co ncrete . Well, Thoutt Brothers did hold to their original bid pric ing and they did complete our projer.t on i ir,;;,, The lncreue th is year Is approximately 8% over 2005 . Staff feels like this Is fa ir, and justHied, based on the lncraue, In fuel coat and also the lncreues In concrete costs . So , we believe It Is In the beat Interest of the City to continua our relationship with Thoutt Brothers for the 2006 program and wa ask for Council's concurrence In awarding th l~ project In the amount of $474 ,720 .00. Englewood City Council Aprll 3, 2006 Pege8 Council Member Woodward said on the 8% Increase , Is that tor appro ximately the same amount of concrete and the second question la, do they perceive any shortages? I know right at the end of the season last year, with Hurricane Katr ina, It was a major problem tor the whole city and tor the country . Mr. Henderson sa id you know we were quite concerned and , In tact , when we did estimating tor th is year we went ahead and we estimated 25% higher . The tact that Thoutt Brothers was able to otter us 8% and put th is in writing and we 'll be able to sign a contract, which they will honor ... we don't really have to worry ii the pr ices go up . Though we don't think they will be allected as much as we teared at first. Mr. Woodward said okay. Mayor Wolosyn asked ii there were any other quest ions . There were none . COUNCIL MEMBER OAKLEY MOVED, AND IT WAS SECONDED , TO APPROVE AGENDA ITEM 11 (c) (II) • A NEGOTIATED EXTENSION OF THE 2003 CONSTRUCTION COtflRACT IN THE AMOUNT OF $474,720.00 FOR CONCRETE UTILITY 2006, CONCRETE PROGRAM 2006 , AND SIDEWALK MISSING LINKS 2006. (iii) Research and Technology Manager Everhart present ed a recommendation from the Safety Services Department that Council approve , by motion , the replacement of prev iously purcha :ed mob ile radios wit h the more rel iable Motorola 800 MHz model. The Motorola rad ios will be at the same costh which is $114 ,671 .04 . She said as you are aw are, we went live with the 800 MHz radio system on January 91 of this year and all went well with the except ion of our mobil e rad ios , which are installed in our pol ice and lire ve hicl es. They are EF Johnson radios . We discovered that they do have a serious issue with the radios ... that they drop partial or entire transm issions, thu s they are not reliable tor publ ic safety . We did purchase those originally through a Homeland Security UASI Grant . We are asking to replace those radios with City funds . We would then go forward with reirr,bc:,sement from EF Johnson , tor the rad ios that we currently have . They have been olllcially notified . Those letters were sent last week and they were not ified prior to that , of our intent. When we realized our issues with the radios, EF Johnson sent out several teams of engineers and between Safety Service s personnol and EF Johnson personnel, we have spent countless hours test in g, making changes and waiting tor EF Johnson to come up with a solution to this Iss ue . They hav e been unable to do that so tar . The Motorola radios currently do work on the State system and very well without this issue and that is why I'm respectfully asking tor permiss ion to replace the radios with the Motorola models and provide Safety Services personnel with reliable commun ic at ion in the ir vehicles . Mayor Wolosyn asked ii there were any quest ions tor Ms. Everhart . Counc il Member Oakley said Trina , do yo . consider this a software or a hardware prob le m? Ms . Everhart said It Is a little bit of both . What the radios are dolng ... ls they move about , they are not finding the right site and so It Is a little bit of both . One final soluti on that EF Johnson tried, was a tilter on the radio as an P.dditlonal part to the radio and that was unsuccessful as well. So even In talking with the State radio •:•stem enr,ineers , they actually feel , as well , that It Is a combin ation of a ha rdware and software problem within the radio . Mr. OaklB)' said is th ere any other EF Johnson radios In service In the State of Colorado that are working property? Ms . Ev'9rhart said there are radios In the Firestone Po llc e ::apartment and Franktown Fire and both of those agenc lc:. bre having the same Issues as we are . Everhart said absolutely . W:r . Woodw ard said okay and then just lollowing up on Wayne's question about financing . We are expectin\j and hoping for a total reimbursement lrom EF Johnson and any shortfall? Did we have this contract through tr .. State? Ms . Everhart said through the UASI Grant and th e fiscal agent was in Denver . I have been in touch with ,hem and they have advised rne that alter the grants, that any warranty issues lall back to the agenc ies that rece ived the radios . Counc il Member Barrent ine said I know the Homeland Security piece of it was so that everybody could keep in communication with each other and have similar equipment. Is that sti ll bein y accomplished with this? Ms . Everhart said yes it is and , actually, there are 428 agenc ies that are currently on the State System. Us ing the Motorolas , switching out that equipment , would definitely lacilitate reliable communication throughout the State . We do have Motorola portable hand-held radios and we have had no iss ues with those whatsoever since we have gone live . l,c uncil Member Woodward said we are still using our other system as backup rig ht now anyway , righ t? Ms. Everhart sa id the VHF is still in place as well . Counc il Member Mccaslin said my qu est ion , m.sybe ,n can answer, is what would prevent us from getting a lull refund? City Attorney Brc ,. ·.1an sa id tor us to get a lull relund .. the issue is the timing ol getting the relu nd. Mr. Mccaslin said okay. Mayor Woiosyn as ked it there were any more questions . General Dl1cu11lon (a) Mayor's Choice Englewood City Council April 3, 2006 Page& (I) Mayor Wolosyn sa id I would like to address Mark Swanson 's concerns . I would like the following read into the record: "Mr . Ma rk Swanson a~ked us to review the den ial of his perm it lor a fence . Council reviewed Mr . Swanson's case and agrees that the next steps fm Mr. Swanson include admin istrative review by Commun ity Development and If that Is not sat isfactory, appeal to the Board of Adjus lments . Th is conclusion Is based on sect ion 106.4.4 of our Un iform Build ing Code , where ii says no permit shall be extended more than once . Records show that Mr . Swanson received a perm it in 2004 and an extens ion In February 2005 . The fence is st ill not bu ilt, thsrelore , accord ing to our Code , he may not have an addit ional extens ion of the or iginal perm it." I would like to have th is statement also forwarded to relevant stall of Community Development and also members of the Board of Adjustmen t, ii it happens to come before them, so that they can fully understand Council's pos lll on ... just have that as bac kground . Thank you . (ii ) Mayor Wo losyn said I wou ld like to congratulate Gary Cond reay and Bill Young . They were honored al the Elks tor their community service . I had beon asked to attend that night , but my husband and I were out of town and I couldn 't. (b) Council Members ' Choice (i) Coun cil Memb er Barrent ine : 1. She sa id I just wan te d to co mm ent on the le ller we rece ived fr om th e Metro Commun ity Prov ider Net work thanking Officers Ross and Chr ist ensen for their professional ism in handl ing a situat ion over there . Apparently , the person rid ing was an ex-pol ic e oll icer and was ver y impressed by the way th ey handled a pat ient , who apparentl y had som e men tal ill ness issues . They were just very comp li mentary about them . • 2. She said I also wan ted to thank Chr is, and his soon to be new command er, for all of the ir work on th e fire alarm policy that we discu ssed in Stud y Session. I have been recei ving quite a few correspondenc es ove r • the la st co uple of months , regard ing th is issu e and I know that ii was of some concern and th ere were some legit imate issues . One ... which a wo man , in the foyer , just brough t up ... is commun icat ion between the Police and Fire Departments and the alarm compan ies . I th ink she tell some comfort , because the re is ob viously som e commun ication ... at lea st tor our part ol it...we can 't spea k tor them . So , I hope how this pol ic y will be implem ented , is commun ica ted tr ''1e m an d th ey can go ah ea d and move forward . Direc tor Olson sa id ii I could ju s· make a comment on that. At the end of the Study Session , we had so me very sign ificant discus sions with the Alarm Asso ciation and they are go ing to be work ing with us ... actuall y do ing qu ite a bit ol the work ... to get th is informat ion out to the , approximately , 400 alarm compani es that they have identified so tar . So , they are going to be do ing qu ite a bit ol that and we will work with them hand in glove on this to make sure that the Information gets out there in a ti mely mann er. Ms . Barrentine said in that part icular case, it was less of an issue with our pol icy , about what we ware go ing to change , then it was about how this part icular company had int erpret ed it...which, I don't believe , was accurate. Director Olson sa id that is correct. Ms . Barrentine sa id thank you very much . I'm glad you guys are following up on that. 3. She sa id I wanted to bring up an incident that happened at the Recreation Center. I was over there th is past week and a woman came in with a wallet fu ll of money, a cell phone and some equipment that looked li ke it had , pntentlally, just been dropped in th e parking lot. I thought the Recreation stall did an excellent job ... Susan did ar, ,,xceltent job ... in going out to make sure and check to see If ii had been taken out of a car, whether ii had beer •ken from somewhere . A11d the womnn ... Pat and her husband Mike Dryer are res idents here . but It was Pat .l :18r who brought that stuff In . I don't think citl zers ever want to miss an opportun ity when they hav• t chance to talk to somebody. But I wanted to thank her tor her honesty, but also lor just tak ing the time . She sa id I want to thank Commun ity Development...Trlc la. My neighbor was pouring a garage and alter submitting the ir plans, that had already been approved , and pouring this , they had somebody come out and they were surprised that there was a telephone pole there . The telephone pole was on the plan and they told them to Just go ahead and if there Is a problem with It, they would deal with it after they built the garage . Well , that didn 't make them fee l comfortable and I can understand that...nobody wants to go to that kind of expense , put the effort and time In and maybe not have It approved . She sa id I know Commun ity Development has been pretty busy, but I had given Darren a couple of requests from some Broadway businesses lhat were Interested In doing some things with the Enterpr ise Zone and their slgnage. I just wanted to get a follow-up on some ol those . One was the March Hare and the ta ttoo parlor , lhe update on the Liquor Barn sign and the aulo deale r farther down on South Broadway, Darren knows who that is, and the Cricket bus iness ne xt to them . Also , our thanks from the Bruce Cairns property . I had see n him this weekend and they are very happy. They are moving forward and they have somebody leasing that property . (ii) Council Member Mccaslin: 1. He said we had an Incident on my block lasl nigh t. There was cause for police and fire response . I was out there and so were my neighbors and you guys did an excellent job . I have to commend you . I was really happy with what I saw happening wilh a distraught man and he was handcuffed ... il went very well . Thank you for your help there . 2. He sa id I would like to thank Rick Kahm . I have had a couple ol issues come in lront of him and he has always been right on the money as far as return ing my phone ca ll s and gait ing th ings done ... so thank you . I have asked lhe City Allorney's office lo include two items in a future packet I would like some background on what EURAs are and what powers lhe 51ale gives a EURA and reasons Iha! Englewood formed a EURA. And second, I would like the information Iha! EURA requested al their February 15th mealing. They requested lnlormalion about the process from their Attorney Benedelli . In addition . before we dehberale on this issue of lransfwing land .
