Al responslbla Council members , you want and , Indeed , need to keep Englewood safe . To attract Englewood City Council November e, 2008 P■gt2 commerce and homeowners , citizens need lo know that they can enjoy walking the streets In peace . Part of providing this protection Involves animal control . We simply can't have dangerous dogs al large . Bui what Is a dangerous dog? A dangerous dog Is one that causes bodily hamn lo people or other an imals . Ate pit bull breeds more prone to such aggress ion? The evidence would say no . They are dogs , plain and simple . Just as In any othar population of dogs , a minority are dangerous . The vast majority kopl as pets are friendly companlc,ns . A just law , regarding dangerous dogs , must address behavior of a particular an lmal and not prejudlcia: stereotype . People who don't know these breeds might wonder why anyone would have a pit bull . Thay have bean vilified In sansallonallstlc media reports and portrayed as demonic, easily provoked and likely to turn at any minute . In my 14 years In veterinary practice, this simply has not been my experience. I would like to take e few moments lo address the many myths surrounding pit bull breeds and the facts regard ing dangerous dogs . Myth : Pit bulls are a danger to citizens and postal carriers . Fact: Dogs that run at-large, especially multiple dogs running together, can be dangerous . We need lo provide ani mal control with the necessary resources lo keep these dogs conta ined. Th is is true regardless of breed . Myth : Pit bulls have stronger bites than other breeds . Fact: Large dogs do more damage . An aggressive pit bull ls a problem , just as an aggressive Sa ini Bernard or Great Dane Is a problem . The size of a dog determines bile-pressure . Myth : Pit bulls have locking jaws. Fact: As a veter inarian, I can assure you that they have normal jaws , just like any other dog . Myth : Only drug dealers and other undes irables would own a pit bull. Fact: As a behaviorist , I can tell you that there are many gentle pit bulls that are stable , happy , well -socialized family pets . Counc il members are right to be concerned about guard dogs and dog fighting . Laws can be crafted that address these dangerous animals , but spare otherw ise innocent members of Iha same breed . Myth : Towns without Breed Specific Legislation become dump ing grounds for pit bulls from surrounding communities . Fac t: People are not dumping their pets . Pit bull owners are simply trying to live nomnal lives , just as golden retrieve r owners or lab owners do. They are moving to towns with fair , rational laws, because this Is the ir best housing option . The only dump ing I have seen is al area shelters , where otherw ise happy, healthy dogs have been surrendered for euthanasia , because people cannot afford to comply with BSL restrictions . Th is practice wastes an imal control resources, that could be baller spent address ing real problems . To personalize the Issue, I want to introduce you lo a couple of my pit bull patients, so you can understand why I am devoted lo this issue . I hope you can trust me when I say that these are typ ical pit bulls . A far cry from the myth ical image the media has created . II is essential that as Council members you understand that sanctions, includ ing death , placed upon gentle , wall - loved pets in unconscionable . You have a choice lo make ; you can make a reactionary law based on fear, or you can rati •,nally address the facts in order to keep Englewood safe for all citizens . (Dr . Dodd passed out pictures o! '.he pit bulls as she spoke about them .) She said the first dog that I would like you lo see is Moses . In one of them, he is dressed in his holiday finery. You can see from the picture that Moses has eye damage and fac ial paralysis on Iha right side of his face . He was brought lo an emergency hospital as a four month old puppy , by Iha housemale of a man who beat him into a slate of unconsciousness . The left side of his face is permanently paralyzed from the beating . He also had heal ing rib fracluras , as wall as fresh rib fractures, which were discovered by the emergency vets . Instead of becoming vicious, he Is gentle and trusting, with a goofy playful nature . He is so gentle ; I would let him play with my children . He now lives happily with two other pit bulls rescued by the same owner . Fortunately , his former owner got sevenleer . months in prison for felony animal cruelly . The next dog I would like to Introduce you lo is Crockett . She said Crockett 's mother is half pit bull and half whippet and his father Is Australian Shepherd . Crockett had his tail amputated with rose pruners, when he was just one day old . He was soon after rescued by my client , along with his mother Daisy . He was a gentleman , always appropriate , wall traveled and well loved . She sa id I treated him for many months for his arthritis and ha was always a day brightener, coming In with a smile on his face . When his owner first moved lo Denver, she reg istered him as a pit bull cross . The next day an imal control v'siled , preparing lo Impound Iha dog for euthanas ia. Due lo his gentle look and nature , he was given a pass . While I am dellghlrd th is gentleman of a dog was not killed , the fact that he could pass, despite known pit bull descent, Is unjust If he had e !arger head, v,ould he have been exterminated? This Is simply capricious . Denver's Breed Spec ific Leg islall~:r has no prov isions exempting dogs for good behavior . These are good dogs, with good families that love them very much . Please choose to protect them and others like them from hamn . Please choose not lo inflict undo violence against man 's best friend. Thank you for your lime . Council Member Moore said may I ask for a point of clarification? Ha said I don't nomnelly ask al th is lime , but I will lake advantage of your expertise . You slaled ... l could probably look It up In your spaach ... lhal the weight or size of the dog lo what matters . He asked what Is Iha average weight of a pit bull? Dr . Dodd r$plled that II depends on the individual dog. In pit bulls , II ls important to know that there are several different breeds that ere considered pit bull type dogs . Moore asked what Is another 55 pound dog that comes to mind? Dr. Dodd replied Au1trallan Shaphard ... Lab , although that 11 probably heavier . Mr . Moore said okay that Is good and era you really anartlng that those dogs are equivalent In the damage that they can do? Dr . Dodd replied It Is not my aaaartlon, but Iha finding of a large 1tudy dona by the Canter for Dlsaaaa Control that determined that the size of Iha dog, determines Iha damage that that dog can do . So , Saint Barnard 's have kllled ... Graat Danas have kllled ... Mr . Moore stated that was not what I had asked . He said you have two 55 pound dogs ... all of the other things that you have raised makes senaa, but to say that there Is not a difference, I just can't grasp that for the 55 pounds of dog, Iha muscle In the jaw region , the muscle In the head, exceeds that of other breeds of the same weight. Dr. Dodd said not necessarily . II depends upon the Individual dog and II depends If that dog Is aggressive or not. The damage any dog is going to do ... Mr. Moore asked why are they popular for fighting? I am beyond ... l will work with you after th:: ... just when you present myth and fact and Ignore what seems to be an obvious capability, II doesn't make sense. so if ii Is my lgnorance ... l'm trying to understand It, but that just flies in the face of obvious . All of the other Issues aside , to say ii Is just the size of the dog that makes a difference and therefore an 80 pound dog Is more dange rous ... Dr. Dodd staled that this Is a conclusion that was drawn by a panel of scientists from the Center for Dlseass Control , a national group of scientists , that looked at data. Mr. Moore responded that I'm questioning ... statistics are beautiful in that you can make them say anything . Thal is why I was curious about your professional opinion. I visibly think that when I look al a pit bull, I can sea more muscle In the jaw region and I don't understand how that could be Irrelevant to the dog's ability . And I need to get over that, to appreciate these counter arguments . But, I will talk to you outs ide of this. I just wanted to see if there was a clear answer for that. Dr . Dodd stated that it is important to recognize too that not every pit bull has a huge head or huge jaw . There Is a great deal of phenotypic variations and that my ma in point is that ii should be bohav lor specific legislation and no t just breed . Mr . Moore said I understand that , bu t I don 't like the complete dismissal of obvious differences, which is part of the problem In a lot of the malarial that we gel on this is It downplays ... some of the stats ignore and try to play down obvious physical capab illli es . I am trying to gal through all of that . I just needed that clarification . We have lots more discussion on this to go and this is part of the research that I am doing on my own, as well as probably every other Council member . So, thank you . (b) Sue Goodin said I am with the Progressive Health Center, which Is located on the Swedish campus . Our address is 701 East Hampden , Suite ~25 . Vvith her was Mary Coll ins who said I am the nurse and nutritionist al the Center. Ms. Goodin sa id we just want to address Council as we are a new business In Englewood . We are a non-profit. We have partnered with Swed ish Medical Canter and Craig Hospital to provide serv ices to people that are looking for complementary and holistic therapies; that are suffering from neurological disease, oncology, gastro-lntestlnal Imbalances with hormones and people who are looking for help that are facing chron ic conditions . We have been researching this project for the last year and half and we are finally opening on December 4, 2006 . We just wanted to come and tell you all about our new program and hopefully gel the support we can gel from Iha City of Englewood . Ms . Goodin said I nova more materials if you all are Interested. Mayor Wolosyn directed her to leave the materials with the City Clerk Mayor Wolosyn said thank you and welcome . (c) Nathan Ellnoff , a business owner in Englewood , said thanks for giving me the chance to speak tonight. As you know, my personal fr iend , the Pres ident of the United States, came to Mlle High Coffee shop Iha other day . We didn't gel a chance to talk very much ; mainly because I'm busy , but next lime he will do II at Funtastlc, because I know he likes cotton candy . He said that was funny . [There was laughter .] I have two rental homes that are completely falling apart and they are a terrible eyesore on South Acoma . I am trying to find a way lo teer them down end make a parking lot. I collect $650.00 for the large ona, which Is 1200 square feet and $550.00 for Iha small one, which Is only 600 square feel , Iha size of this box right here. And so, because of that, the type of cllenlele that these rental units attract are very low Income, or just basic troublemakers, who don 't pay their rent or utllltlas , they damage Iha property, and although I don't allow any dogs on Iha property, they seem to disobey the lease end I seem to call Larry Madina a lot. The vicious dogs that are on the property disturb the neighbors and scare my customers . Frankly, I don't blame the neighbors . Thay have a right to complain . I've looked to Investing $50,000.00 more per house lo Improve them ; however they will be over Improved and no one Is going to pay $1200.00 or $1500.00 for 600 square feet or 1200 square feet. So , I have a daal hara . I would forgive $14 ,000.00 a year In rental Income, every year, from these two houses , tt I don't have to deal with these problems. I would like the City to hire a consultant or appraiser of your choice and at my expenae , to prove that If the City would tear down these homes and repave the area Into a Englewood City Council November 8, 2008 Pege4 nice parking lol, with lre91 and proper landscaping, similar to the Kaiser Permanente building, that my property would not Increase In value whatsoevar ... only that I would lose $14,000.00 per year In rental Income . The neighborhood would benafll greatly from this transformation . Thera wouldn't ba any more crime, any more drugs or bad tenants and Iha problems would disappear . This would also help sell my property to a respeclabla developer In Iha very near future , which will generate sales tax revenue from Iha redevelopment, which la estimated to be $50,000 .00 a year . Presently , for the last 12 years , I haven't collected II , so that's $600 ,000.00 that the City has lost in revenue . Tha City of Llltlaton did Just this same thing for the Re inke Brothers on South Prince . Their parking lol was the same . II was an eyesore to the neighborhood . There were people parked thara ... tha litlar ... lha drugs ... and the City, basically, repaved II . II also allows other store owners to lal their customers' park in the parking lol, which kept Iha public from spilling Into the neighborhood streets, similar to my problems. So It Is a win/win situation for everybody . I'm asking for the same consideration, because It would help clean up the neighborhood , slop the problems com ing oul of these rental un its and help facilitate Iha sale and redeve lopment of my existing site, without adding value to my property , whatsoe .er . Thank you . Mayor Wolosyn said thank you . She said that we don't usually discuss these things during this time , but If you stay around du •ing Council 's Choice, someone might bring ii up . Mr. Ellnoff asked how do I go about...M ayor Wolosyn said it's a short meeting and we'll be at thet point of lhe meeting relatively soon . Mr . Elinoff said okay, Is this lhe proper forum for me to bring this up? Mayor Wolosyn said yes, for you lo present it and we may br ing it up for future action during our Council Choice, al lhe end of this agenda . Mr . Elinoff said right and If I apply for the money, is there a step process that I go lo? Mayor Wolosyn said you could slay here and llslen lo what we direct staff lo do, whenever that time comes In the meeting, okay? Sha said usually this is the lime where people present the Issues lo us and we don 't usually engage in a dialogue . She said then if you stay here for maybe 15 min utes, I am sure that there will be some action taken on this. Mr . El inoff said okay . Did you prov ide a copy or could you provide a copy lo the Clerk , for us , of what you just read off? Mr . Elinoff said sure. Do you want a copy of the parking lol, the redevelopment picture? Ms . Barrent ine responded whatever it is lhal you are proposing and I was just wondering if you had presented it lo somebody , so that we could gel lhal Information . She said I didn 't remember everyth ing that you said. 7. Recognition of Unscheduled Public Comment (a) Susan Flesher , a resident of Castle Rock , said I appreciate Council's lime th is even inn and I am the Regional Real Estate Manager for Panda Restaurant group . As you may know , we just opened ,. .atest store in the Colorado Front Range on Friday, at Broadway and Cornall in Englewood . I wanted to la k. a few minutes, because I talked to Bob and also Gary at our opening party, lhe night before, and wanted to let everyone know that I have been do ing development In the Colorado front range , from Pueblo lo Fort Collins, for about 25 years , and I have never , ever , had a staff that was so cooparalive , and so willing to help and so clear In their direction. We set a record at Panda and probably for about any development that I have ever done . We started lhis process with Community De velopment in March and we opened that store on Novemb~r 2"". II ls unheard of. And I wanted to take this opportunity to lel you know lhal from Community Developrr ent lo Utilities to Build ing and Planning , Public Safely, Fire , everybody ... l~ey could not have been more coopers .'• ,, could not have been more willing lo help . And when Englewood says thal they are open for business, this Is one of the few cities that I have ever dealt with that truly means ii. I lhuughl that was Important that you know that, publicly . He sa id the grant does requ ire local match ing funds and we have those local dollars In our existing Commun ity Development budget . For the last 11 years the Community Development Department has managed the Arapahoe County Enterprise Zone, wh ich cons ists of the cities of She ridan , Englewood and Littleton and to get •~me offset for the cost of administering and marketing th is program , we have applied for and rece ived State funding to ass ist us in doing so . The Enterprise ZoM is a critical part of our bus iness retention , business expans ion and bus iness attraction activities. We can po int to numerous examples of businesses that la ke advantage of the Enterpr ise Zone and In tt,e staff report there Is a current status of the tax credits that are be ing cla imed In Englewood . With that , we recommend approval of th is grant from the State of Colorado . I would be happy to answer any questions that you may have . Thank you .
