what I said and thc,c wi ll be no embel li shm ent of what I said, because a I of that is true . I don't li e, I don·1 -.:heat, I
do n't steal, and I don·1 do dru gs or alcohol. As a matter of foci. I have been su bsta nce free for 12 years. as of th e
19th of thi s month . I 1old yo u last week I was born n drunk . I think the curlies t I remembe r dri nkin g booze I was
three years old . I know what alcoho l is and I'm rep ul sed by alcoholics and drunks. When Sergea nt Watson wa s
arresting me and manhandling me . after he leaned over and told me th at he was go in g to ge t me ... he got me thi s
time . Eve n another offi ce r was stand in g there loo king at hir. ::ke what are yo u doin g ... th e guy fully submincd .
Eve n nj uni or officer sa w that in his eyes. I want a writ ofre1,1 .:n on my furniture th at was stolen fr om my house
after thi s incident happened. I thin k that shou ld go to show tt.il , Divisio n Ch ief Vande rmcc didn't investigate this
case whatsoe ve r. My stuff was blatantly stolen. While I was s1• irig th ere , after I filed thi s investigation ... as I said. I
do n't know how much I was T3n ting at this time ... but Division ..:hief Vandermee made it very clear that he sicked
his dogs on me. to have me arres ted that day. Thal is exactly why I wasn't read my rights. th at is e:rnctly why I
wasn 't inves tigated . Not one wo rd wa s as ked of me oth er than to shu t my mo uth . They didn 't ask anot her person
that wa s standing right there . They wouldn't int ervi ew her and the gi rl that called in got th rown out of Stell a's Bar
on Broadway at 2 o'clock in the morning in a blackout...slonc-rage drunk . That is the gi rl th e po li ce took the re po rt
fr om. So, I gcess the botto m line is Th omas Vandermee th reatened me in hi s office and he threatened me in fro nt of
a Sergean t, he arrested me und er Probable Cause based on th e word of a drun~. I wa s th rea tened by a Divi sio n
Chief in fron t of a sergea nt . why isn't he unde : arres t under Probab le Cause? Do 1'1e laws onl y app ly to ce rtai n
ci tizens in thi s coun tr y? I think th at is a fob question to as k. Obvious ly, yo u know a lot of my attorneys. I am
almost done here, by the way. One of the attorneys ' on my case is Dunnt Davidson . I think so me o f you lawyers
probab ly know him, he serve d on the Fifth Circuit Cou rt fo r 26 years . I th ink his bar number starts at 12. I th ink he
went to sc hoo l wit h Thomas Jeffe rson or some th ing, as he has been around so lon g. I was tr yin g 10 make light of a
bad subject there, by th e way. When that fir st case was dis mi ssed by Richard Matsch in Federal Court, Durant's
co mment was like he was talki ng about hi s litt le broth er "Yeah, th at :: Ric h fo r you he just wo n't talk to anybody
that ai n'I got a million doll.J.Ts on his head ." At thnt poi nt 1 fig ured I had spen t $15 ,000.00 in liti gat ion agains t the
Cit y of Eng lewocxl . My lawye r advised me , as he was a co p for 26 years himse lf. that yo u ha ve ticked enough
poli ce off in Englewood , Mr. Ra ymond. yo u he ller move c ut of that town. I did move. I moved ove r to 4644 South
Li nco ln . That is where this last thi ng happe ned an d th ere was a year without po lice co n1 ac 1. I ha ve to tell you. until
th is incident hap pe ned . They definite ly re membered who I was . Mr . Fla hcny jusl gave me a copy of yo ur report.
Mr . Brotzman and in lh is you sa id th at you di smi ssed the charge aga inst Mr. Luker, becau se Jul ie Luker ~mid she
didn 't wa nt to prosec ut e. Julie Luker didn't make a case agains t the guy, I di d. She was n't there . I was and yo u
said 1 di dn't ha ve 11 wiiness , whic h I did. My neig hbor was stand ing there when he did this as well. I mean. are yo u
j ust covering up for th ese guys still? Is that s1ill what it is? I do not wis h liti ga tion agains1 1hc Cit y of
Englewood .. .! do not. I moved 73 miles away from thi s City, because I definitel y fo ar lor my life fr om poli ce

(i) Senior Planner Graham prese nted an Intergovernme nta l Agreement with Arapahoe
County to use Open Space ".Jrant Funding fo r co nstru cting impro ve ments 10 the Mary Caner Greenway . Mr .
Gra ►.am said this is one o f the two grants th at Ara pahoe C o unty has a pproved for the City of Englewood !Ind the
gr :,nt portion of the Arapahoe County Open Space Funding. Thi s proj ec t would construct a parallel po.th to the
CX\~ting concrete path, north and so uth of Dartmouth. The path so uth of Danmo uth wo uld be a crusher fine path
and nonh of Dartmouth . it becomes concrete, because we have less area to work with and there arc some
considerations. We identified a couple of Council outcomes that this supports ... those being ... providing a nd
mai ntaining quality infrastructure and also providing di verse recreation opponunitie s. The bike path is heavi ly used
and -NC are connecting Englewood to the portion tJ1 at South Suburban has constructed from 470 no nh, to our south
border. There a.re some missing segments. as we n fo r the Golf Course rcc o n.'itruction, but eventuall y thi s will go
all the way frr ..i n 470 to the Denver bcrd cr.

14. City Attorney's Report
(a) Cit y Attorney Brotzman said I do have the report on issues raised by Mr. Raymond dwi'i\A tt1c
August 1, 2005 Council meeting and I would again caution you that this is a report. It is not an invcstigatii • ~tis
simply contacts that the Police Department and the Prosecution Office have had with Mr . Raymond . An il ;tchial
investigation was done by the Police Dcpanmcnt that is referenced in Co mm1111dcr Wick's rc pon. That aga in was 16
police officers that were investigated by the Safety Services Department and there was a finding that there wasn 't a
problem with the offi cers. Now that is not a publi c doc ument. That is an internal inves tigation that is not available .
The other documents , th at Commander Wicks referenced, arc all available . Mr . Comer's comments arc anachcd
regarding the prosecution . There were three cases that Mr . Ra ymond has had in our Court ... one was dismi ssed for
refiling. I don't know if that has actually been refiled or not. Then there are actually two other cases ... one where
Mr. Raymond was a victi m and one in which he was the defend ant. Both of those had the same person as a witncS5
and it was more than a reluctance on the part of that woman, Ms . Luker, to testi fy . Mr . Comer felt , in his
profes sional judgment, that he didn 't ha ve enough to go forward wi th the case and dismi ssed both of those cases .
As Mr. Raymond indicated earlier, he did file a civil suit, which was dism issed against the City, with Jud ge Matsch
finding that the offi cer acted reasonab ly in the civil standb y .
