(a) City Council recog nized the yo ung people who were nominated for the Metropolitan
Mayors and Commi ss ioners Youth Award :
Mayor Garren said this is always an CJ.Citing night. We have the opportunity to recognize nineteen
nominees for the 2004 Metropolitan Ma yors and Commissioners Youth Award s. We thank everyone for
con .. 1g tonight. I do want to make note that we invited the School Board to come. bu: unfortunately they
have 11 meeting conflict. Each nominee will receive a certificate , as well as a backpack gift bag as a token
of admiration from the City Council . At this time I would like to invite the members of the City Co uncil to
come doW"'l tO form a recei ving line. to shake their hands as they co me forward. Also, after the awards, we
arc going lu have a brief reception in the Com munity Room .
Mayor Garren sai d at this time 1 would like to introduce Council Member Be v Brad shaw who. besides
being on the Board for the Mctroi><>litan Mayors and Commissioners Youth Awards. was instrumental in

Counci l Member Bradshaw sa id thank you. Before I start, I think we need to recognize 1hc lady on our
staff who puts this whole program together and that is Le ig h Ann Ho ffhine s. I wou ld lik e 10 give her a big
round of applause , she sa id . There wa s applause .
Ms. Bradshaw sai d we arc hon oring th ese norninecs, not because of the hard ships they have faced, but
because they ha\'c persevered a nd have taken control of their li ve s How many of us at th e age of so me of
these fo lks, can say we took control o f our li ves? Each o ne of th e m has made a d iffere nce in their own life,
as well as the lives of those arou nd th em. Special thanks to the nominators fo r recognizi ng the
accomplishments of these young people and fo r helping us honor them. Will th e nominators please stand at
th is time? They were given a round o f applause .
The nominees arc :
(i) Michael Anaya Jr .• a Senior nt C'olorndo's Finest Alternative High School.
Michael's no minator describes him as bright, motiva1ed, and a lways there 10 lend a helping hand.
Michael 's resi li ence is remarkable.
(ii) Elizabeth Bridge, ans• Grader at Sinclair Middle Sc hool. Eli zabeth 's teachers
describe her as 2. "ray of sunshine" who always secs the brighl side o f every situation.
(ii i) Joseph Gallegos, a Junior al Colorado's Finest Alternative High School.
According to hi s nominator, Joseph exemplifies hard work, cc,mmitment, dedication, and tenacily.
(iv) Brianna Hand, a Junior at Colorado's Fi nest Altemafr ·e High School. Briann a's
nominator describes her as positive and optimistic -her tenaci ty and commitment deserve recognition.
(v) Caroline Jepse n, a Senior al Hu mane x Academy. According to her nominator,
Caroline ha s made significant gai ns in her life • she has become a leader at the school and has strong goals
for her future .
(v1) Rachel Lawson, a Senior at Humanex Academy. Rac hel 's nominator says she
pushe s herself 10 do we ll an d has strong ambitions as she gets ready to graduate in May.
(vi i) Miche lle Lee. an 8th Grader at Flood Middle School. Her nominator desc ribes
Mi chelle as a role model , leader. and an in spiration.
(viii} Crista Lcll , a Senior at Colorado's Fin es t Alh:rnati ve Hi gh School. Her
no minator says Cri sta maintai ns a positive outl ook on life. and has stron g goa ls a nd nspira1ions fo r the
fulure .

volunteer chairman of their vo lumccr board . I wa nt 10 thank the Mayor and Counci l for letti ng me speak
1onig ht. The St Vince nt de Paul Thrifl Store s arc a 50l(c}3, reg islcrcd wilh th e Sia 1e of Co lorado. We
were formed fo r the expre ss purpose of pro viding low cost c loth ing, furni ture and oth er househ old goods to
lhe needy. The reaso n I am here to address 1hc Counci l is becau se we have had to d ose two of our
stores ... one on Hampden and the one on South Broadway . We ha,·e los t 1housand s o i aoll ars every month
th at this store has been open. and now we are comp letely out of cas h. We arc in the process of crying 10 ge l
a rel ease from our remainin ~ 11:.. .. ·c paymen1s. We hove until April of 2006 remaining on ou r lease. Th e
landlord has been very rcspv nsi\'e in working with us and has agreed to release us. Unfortunately, when he
leased 1he property 10 1hr ~t. Vincent de Paul stores, he relinqui shed hi s right 10 automotive use. That
make s it very difficul ·r for him to recoup his losses. We 've alread y had a number of vandali sm cases , since
we put up the liquida1ion signs. We believe it is in the best interest of the City to let thi s property revert
back to it 's original or pre vious use . which was automotive . and allow the landl ord to lease the propeny
qui ck ly and rel ease us from our remaining lea se obligation . Without thi s relea se. we will be forced to go
in to bankruptcy. Again, he !l aid, 1he purpose was to provide low co st house hold goods aud clothing for the
needy . If we go into bankruptcy. that will eliminate that opportunity for us. We have l>nt remaini ng store
on Eas t Colfax . So. I wou ld ask the Ci ty Counci l to please, not extend the mora torium o• rnr dealerships
and all ow thi s property owner and other property owners to lease their propcrty ... parti cularl y in this
case ... to car dealers . So we could have our release and he could recoup 1he loss that he is going to face. I
would be glad lo answer an question th at you might have.
Mayor Garrett said !hank you very much . We usuall y listen during this phase of the Council meeting and
then we may di scuss the issue under Cou ncil Member's Choice. Mr. Ruybal said thank you very much .
7. Unscheduled Visitors
(a) Paula Sparacino said Mayor Garrett and members of the City Council. thank you for
allowing me to speak to you regarding the e:"'.tension of the auto use moratorium , which is Council Bill No.
2. She said 1 am the owner of Ric hards Motors . I nm also a member of the Auto Use Committee
es tablished !iy your Council. I ~~med to speak 10 the Council ton ight and let yo u know I oppose the
extension of this auto use moratori um . While 1 app redatc the intent of th e City to work wi th the auto use
community, thi s moratorium is a detrimeni to th e South 9roadway Corridor as a whole. It is currently
affecting other business owners in a negative way ... St. Vince nt de Pa ul for examp le. There is, however, a
posit ive example of progress on South Broadway. It is the Eckerd Drug development proposal lhal is
currently in finalization. This will remove three dea lers and an AAMCO Tran smi ss ion from South
Broadway . This is the way Sou1h Broadway should be deve loped . Let free enlerprise and 1he market drive
the revitalization . Thi s wo n't happen by forcing a mora torium on existing businesses. Who's to say th at in
six months th e City Council would decide that lawyers. doctors, acc ountants. e1 c. are next on the
morat orium train '! We , as a commi ttee , ha ve offe red severa l suggesti ons and have asked for informati on 10
make informed decisions regarding these sugges ti ons . I want 10 go on reco rd and stat e that 1hc previ ous six
month s of moratorium ha ve no1 been that productivt:. Whil e I appreciate 1he Ci1y's consideration of th e
permanent use-by -right that we proposed, I realize that thi s, ultimatel y. is a poo r deci sion as it se ts lim its on
oiher businesses u1ili zi ng th eir properties for a fr ee enterpri se and a diversity 1ha1 co uld popula te the Sout h
Bro:idwa y Corrid or. In addition. the Auto Use Commin ee sugges 1ed so me sort of busine ss equalization lax
or fee asse ssed on the auto co mmunity , to make up the alleged sa les tax reve nue deficit . whic h was the
basi s fo r the first moratorium ... 01hcr than 1he fact that Mayor Brad shaw, nt 1he time , th ought there were too
many car dea lers on South Broadway . I want lhe Council to know that I will co ntinue to wor k with the
Planning and De velopment Dcpanment. It appears that we finally have a proposed plan of ac tm n as
ou tlin ed in the leller that we received on February l l lh, That was sent 10 th e who le dea ler community . Th e
Au to Use Commillee is a volunteer group . We take time out of our workda y 10 meet wi th Cit y staff. Time
that cou ld be spc nl managing OI''" own businesses. but we feel it is in our best interest and the interest of the
dealer comm unit y 10 be well imormed of the zo ning changes and design sla nd ards th at the South Broadway
Plan co ntain s. I feel privileged to panicipate. by srrvi ng on this Commi ttee. However, I don 't fee l th:11 a
mora1orium is need ed to accomp li sh 1his review. Ii is as if 1he Cit y feel s they need to impose a time lim it
on us ... the Auto Use Committ ce ... to force us to review and com ment on the Plan . Think about how
continuing 1he moralorium places undue slrain on the al ready strained ec onomy here in the Englewood

at one po im when we met wilh the m in a Study Se ss ion. sugges ted that perhaps a permanent use-by-right
cou ld be ex te nd ed lo au1 omobil e dea lers . We thought that wo uld be accep tab le to ou r deal ers. That wo uld
be prett y good if we co uld have ou r au to propenics th at are operating as th at ri ght now, be lea.sed fo r so me
other use and if, for ex ample , we ha ve a situati on such as Mr . Ruybal just disc ussed, where all of a sudden
we need to aband on th at use and go back to th e auto use. th at we wo uld alway s have 1he right to do that.
We ap preci ate the tho ught that we nt int o that. We thought that was a good id ea at the time and we wou ld
probab ly be willin g to acce pt th at. But, in principle, we rea ll y ca n't do th at beca use , you know, what we
would be taking for o urse lves, wo uld be taking from other dealers. It just wouldn 't be ri ght and fair to give
'JS an advantage over other dealers. So, we are opposed to th at. We would take that de al if we co uld get it ,
but we arc opposed to it j ust because we don't thi nk it is fair for the who le Ci 1y. So that was a sugges ti on
yo u mad e to us , and we appreciate that. We made the suggestio n to Ci ty staff and Cou ncil th at if indeed
there is a short fall or reve nue s. we would be willing to di sc uss what that was. If dealers arcn'r co ll ect in g
th eir fair share or sa les 1a xes rela 1ed to oth er businesses, we wo uld do som ething to 1ry to make up that
short fall. We ce rtainl y wo uld co ntinue to do th u.1. That wou ld be ope n fo r di sc uss ion. But I do n'! think
thi s who le idea of th e moratorium ever rea ll y had a pl an be hind it. Wh at we re we go in g to do once we had
a moratorium '! We were go in g to establi sh appearance stand ards, we we re go in g 10 estab lis h revenue
standard s and we were told that we we re unattractive and th at we re all y we ren 't wa nt ed here. So. at thi s
po int . we want to work with yo u and tr y 10 overcome so me of th ose lhin gs, but th e stand ard s thal Mr .
Grah am has mentio ned to us , th at co uld be sta nd ard s thal we would app ly to aut o uses in 1hc fu1ure, they
are ha ving a ve ry diffi c ult lime coming up wi 1h 1hese standards and I think 1 know th e rea so n. A lot of
muni ci palitie s across the co untry are tryi ng to limit aut o use in th eir areas wha e the y ca n't share in the
re venue . and they are doing that by putting limit s on th e minimum size of the prope rties. One and a half or
1wo acre s we have read abo ut. .. across the country. Well, wi th th e one and a half or two acre site minimum.

com muniti es. I mean that works with any size property . You can do 1hosc thin gs . But, in Englewood, we
arc landloc kcd ... we arc a Ci1 y th at ha s no room 10 grow . Ou r properties are onl y 125 fee t deep and a lot of
our dealers don't wa nt 10 ex pand . We wan t to stay small and bout !que-i sh a nd th ere rea ll y isn't anyway for
us 10 establ ish, in my mind , any kind or viab le cr i1 eri on for car dea ler s 11 ·he future 10 opera te und er. if yo u
are try ing 1-1 use big propcny model s. So, in esse nce, we just loo k at tlm 111ora torium as a no ose around our
neck a nd I think it is bec oming a noose around the neck of othe r bu sincsse-.. l think it is rc.:a ll y going to
sti0 e 1he City Cou ncil , it is going to put a rea l wrench in a Im of peop le's plan s fo r so me de ve lop me nt here
and it is going to crca1e so me real hard fee lings be twee n us and th e Cit y th at we just dnn't think we want to
have there . We want to wo rk with you. We love worki ng in Englewood . We want to work wi th Counc il
and we arc wi llin g to do it. but wi th thi s sti ck hangin g over our head, we just do n't th ink it should be the re .

pro pert y from 49 15 thro ugh 4955 Sou1h Broadway with approxima tely 250 feet of fro nta ge. I am al so the
owner of property at 1300 West Quincy , re prese nting approx imately 200 feel of fr ontage. I mus t voice my
stro ng oppositi on to this bill . I ope ned Englewood Molars on March !, 1960 and ha ve been an Englewood
bu:,i ncs sman wo rking long, hard hours ever !;incc . An independent bu sin ess man does not ha ve n relirement
rrogro m, un le ss he crea tes one fo r him self. Land payments 1hat I have made for man y years represe nt my
reti re me nt program . I firmly believe th at cs tabJjs hed Englewood business perso ns and lan d owners should
not be fo rced into a bill that will do natl ing bu t raise ove rh ead cos ts tmd shrink our profi ts . It is my
underslnndin g that we have laws in Englewood requiri ng proper mai ntenance of both co mmerci al and •
res idential properties. I suggest th ot yo u enco urage stric1 enfo rcement of these laws, rather than pla ci ng an
extra burden on th e busines ses of 1hc Englewood area. Unfort unate ly. today many of our gove rnment
leaders fo il to use old fa shi oned busi ne ss se nse. I respcc !full y reque st th at the Englewood Cit y Co unc il use

und er the ass umpti on that it was a fa irl y qu iet nei ghborhood. The emphasis is on neigh borhood . You
know, it is not Broadway, it is not Santa Fe Drive, ii is not any of th ose. It is a re sid ent ial nei ghbor hood .
We arc not ge ttin g reside nt ia l nei ghborhood type traffi c. I have seen 18-w hec lers on our street. I have see n
ce ment trucks on our street and I have even fo llowed a co upl e of these industrial vehicles down our street
to find ou1 where the y are go ing . They are goi ng through o ur neighborhood. That's it! I have see n police
cars co min g through our neighborhood at exce ss ive speed s, without any light s. wi thout any sire ns. I
watc hed my best fr ie nd almost get hit by one. That is kind of di sturbing . The main proble m is beca use
th ere are no stop signs ... lhere is no type of limiuuion th ere, period. The po lice are n't limi ti ng it . Wh en
I've talked wi th police officers. they have si mpl y said that they arc unders taffed, und erpaid and they can't

bett er resu lts and I am glad th at they were listening to me. So I wanted to say thanks to them .
