WHEREAS , the City of Englewood City Council authorized an intergovernmental agreement which would all ow the tranafer of water service between the City of Eng 1ewood and the Denver Water Board by 1he passage of Ordinam :e No . 59 , Series of2001 ; and WHEREAS, ORIX Prime Wes!, the owner of2270 and 2275 West Chenango Avenue has submilled a request for Englewood to tranafer responaibilily for 1he waler service of this location 10 1he D.mver Water Board; and WHEREAS, the ln1ergovemmental Agreement of Ordinance No . 59 , Series of 2001 , S1ipula1ed thal "the 1ransfer must be approved by Englewood's Cily Council or their designaled representative ... "however; no rcpresen1a1ive has been designated; and WHEREAS , the passage of this Resolu1ion will transfer the responsibility for water service to 2270 and 2275 West Chenango Av,nue from Englewood lo lhe Denver Water Board ; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, THAT: ~-The City Council of the Cily of Englewood, Colorado hercoy authorizes the transfer of water service for 2270 and 2275 Wesl Chenango A venue lo Denver . ~-The Director of U1ilities shall be aulhorized lo sign future water lransfer agreements in order to expedite waler transfers for both parties. Fonda , Director of Utilities COUNCIL GOAL AND PREVIOUS COUNCIL ACTION The original Intergovernmental Agreement for Transfers of Wate r Serv ice between the City of Denver and the City of Englewood was passed by Council Octobe r 1, 2001. RECOMMENDED ACTION The Engle wood Water and Sewer Board, at th eir August 14, 2007 meeting, recommended Council approve by Resoluti on use of the existing Intergove rnme ntal Agreement for the Transfer of Water Services 10 allow the Santa Fe Drive Busin ess C•nter loca ted at 2270 and 2275 West Chenango Avenue (approximately 4900 South Santa Fe Drive) to connect to Den ver Water. The Water an d Sewer Board also recommended that the Di rec tor of Utilities be appointed to sign such transfers in the future to stream line 1h e pr ocess . BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED ORIX Prime Wes~ owners of 2270 West Ch enango Avenue, Building E and 2275 West Chenango Avenue, Building D, are requestin g (\iat Englewood allow Denver Water to provide water service lo these two buildings located in Engiewo,. :' The maj ority of thi; develop ment is in the City of Littleton, already served by Denve ; Nater. Attached is a letter dated July 31 , 2007 from ORIX Prime West req uesting to connect to Denver Water, a letter dated October 21 , 200 5 from City of Englewo od to Den ver Water requesting .Jenver lo serve this site under the existing agreement a letter dated July 24, 2007 from Denver Water to Englewood agreeing to serve water to the entire site, per the existing Intergovernmental Agreement for Tr,1nsfers of Water Service between the City of Denver and the City of En ulewood and a memo dated July 31, 2007 from Nancy Reid, Ass istant City Attorney that discusses appointing a representative to sign future water tran sfe r agreements. In the original "Intergovernmental Agreement -Transfers of Water Service," It is stipulated In the agreement "the transfer must be approve d by Englewood 's City Council or their designated representative ..... ." It Is requested that City Council allow the Director of Utilities be allowed to sign these agreements lo exp•~lte tap transfers for both parties In future, simila r situations . Barry: The City of Englewood Development Review Team is currently in the process of reviewing the above planned development that will require water and sewer service to the buildings within the project. This commercial site is to be situated on the west side of the 4900 block of Santa Fe Dr. which is south ofW. Chenango Ave . and nonh of the future Lowes project off of Belleview Ave . (Please refer to the attached map) The referenced site is divided between the City of Englewood and the City of Littleton . Sewer will be provided to the development by the Littleton Interceptor Sewer Line . It i~ the City of Englewood Utilities Depanment's position that either the entire location be provided water by the Denver Water Dcpanment or by the City ofEnglewood; not panially by Denver and panially by Englewood . Given the fact that the bulk of this site lies within the City of Littleton boundaries, Englewood is requc.~:i.i,; that Denver assume the responsibility for being the water purveyor for this entire development project. There is no evidence 1ha1 the Englewood City Co uncil has designaled someone lo sign !hose transfers inslcad of the C;ly Council ilself. Therefore ii is recommended !hat this go lo Council. There also does nol appear Iha! a form has been developed for such transfers. If you feel that this process would be slrcamlined by havi ng a designated representalive appoinled to do such transfers in the fulure . I would recommend !hat you include that in your Counc il Communicalion so thal the Ordinance as states would approve this transfer and to appoint someone, either the Ci ty Manager or the Utilities Director lo sign these agreements in the future.
