Register that WJS approved in February. Mr. Long has put a lot of work into the application process for the
Skcrrin House, she said. and the whole historic preservation effort .
Mayor Burns said 1' was his great pleasure to prcscn1 Mr. Long with this ccrtific:uc designating the fil"ll
historic property in Eh~lcwood . He thanked him for all lhc work he has done on this. He offered his
congriuulations.
Mr. Long expressed his apprcciuion for the honor . and thanked Council ior their support. He also thmkcd
Ms . Danncmillcr for all the work she h35 done . He said he was plcllSCd to accept this on bcha:f 1Jf the City ,
and that this was a first step toward preserving the history of the City of Engkwood .

County about its history, adding that they were very impressed with whal counties had done in this area .

Ms . Bclcf said there arc five people in the group. which was fo rmed l:m foll. She said they were still in the
fact finding stage. g:uhcring inform:uion from all the different entities. counties . cities . special dillricts and
so on . She said they did 001wan110 reinvent the wheel. and what has 1,1,'0rked successrully for others , might
be incorporated intu a plan for Arapahoe County. since we are one of the last counties to get this kind of
program together . So for , she said . we have had presentations from Jefferson County, Douglas County,
Boulder County and a rew cities in the area . On the l 7dl, we had an open he;iring for f>Ubli c input. she
advised. She said one of the items >he gave to Council ww; the fonn lencr they had b ·nded out, several of
which they have received back . She sold they would be compiling all the informaric-11 tog, tan idea how
the public reels about this . We are :aJso in the process of putting together a RUVCY where .ney will sample
about four hundred households to sec what the reeling is about an open space program . she advised . It •

and untouched, while 01hcrs feel it should be a network of trails, or soccer fields. golf courses, or thlnp
like tha1. So we need to tind what the public consensus , on that Thal is basically where we are , she said,
still fact finding. and we arc going to make a rccommcoJ.ilion 10 the commissioners sometime around
August . once we have goncn the results of our surveys ond leners . We have received quire ii bit of
information already. she said. At the hearing, we were presented with three hundred and eleven post cards
that were collected by members of the Sicrr:1 Club, which ga,·c us some additional information.

the co unt y and will be 1.lking ,mother 1our funher cast The issue that we arc all most co ncerned with will
be addre ssed a1 our ncx1 briefing , which is the fiscal aspect or an open space plan in the coun1y. He
recogn ized that it is of wide concern and was an issue tha1 there had not been a briefing on, so 1hcre have
been no discussions on how it would be paid for. We are meeting 1wo nights a month, he advised. from
three to f,,11.: hours , including the re1rea1 that is coming up in two weeks. to consolida1e all of our notes and
then p•!~ · 'Jr recommendations together.
Mayor Bums said he: thought South Suburban Parks and.Recreation was going 10 have a ballot issue for
open space acquisition. He asked Ms . Bclcf and Mr. Rosser if 1hey work outside of their boundary, or if
the y coordinate with South Suburban . Mr . Rosser said they arc outside of their boundaries. Council
Member Bradshaw said there is Aurora Parks and Recreation , also.
Ms . Belef said they had a presentation from South Suburban to obtain infonmuion when they were in their
fact -finding mode. Mr. Rosser said they also h11d a presentation from the Aurora Parks and Recreation
people. He said they ha\'e coordinated with them and he reall y apprec.iates the opportunity to spend time
with Englewood . to Sivc a briefing. He said he wished they had somcthing'more exciting to tell them , but
they arc still in the study st.age . He thanked Council for the invit1.tion, and said they would be back.
Mayor Bums said Council appreciates all the good work they arc doing, and agreed that it was long
overdue. Mr. Rosser said that seems 10 be a popular sentiment Mayor Bums said. at the presentation at
the Metro Mayors' Caucus. they said that people suppon these issues . He wished them good luck with the
funding issue.
Ms . Belef invited Council to sit in on their meclings on the second and founh Wednesdays at the County
Bu ilding on Prince Street. She said they ahema1e between tha1 and the Justice Center on Potomac . The

said Code Enforcement Officer Parsons has been by 1wi ce and is just delightful. She said she really likes
Ms. Parso ns . She a.gain thanked the City for what they have done .

appeared in the Engle wood Herald on April 7, 2000 . She advised that staff is rec ommend ing amendments
to the Englewood Mun ici pal Cude . whic h will provide iln opportuni ty for unique and crutivc signagc
al ong Broad way in the 8 -1 and 8 -2 Business Zones . Input for the proposed amendment has been gathered
from other City departrr!nts, from the So uth Broadway Merchants' Committee. the Greater Englewood
Chamber of Commerce. Englewood Downtown Development Authority and the Englewood Planning and
Zoning Comm issi on, she said . Th is nmcndment will create a process where busines ses. with input from a
special re vi ew 1eam. will propose new signage . characterizing specific criteria in order to gain area , height .
loca1ion or size bonuses for unique busine ss sig nagc. she advised . Specific cri teria guiding the signage will
be provi ded from u policy crca1ed by the City Manage r in order to guide the review process . The criteria
:ire lis1ed in 1he Council Communic a1ion. she added , and were di scussed wi lh Council al previous meetings .
S1aff belie ves the proposed Jlmendmcnt will allow for the strengthening or the co mmercial signage along
1he corridor, as well as provi de an en fo rcc.i.ble ord inance for staff 10 implemen1 in cooperation with the
business community, she said. Rather than going through , :1 the specifics or the changes. which arc quite
length y. she sa id she wo uld like 10 spea k about three specific areas that co uld ch:mge with this ordinance .

comminee. a new sign cou ld gain an area bonus , mean ing the y would ha ve more signage area in order to
loca te 1hcse creative signs, she said, but s1ill wi 1hin the signable area . There still is no change to where you
can pUI a sig n. but additional area bonuses could be received . For eumplc, she sa.id , if yo u now have one
hundred square feet of signablc area. if you ha ve a creative sign proposed. yo u could go to as much as one

As you gel more frontage . you get additional square footage with that. The way it was initially inlerl)rcled.
was that the firsl one hundred feel would be one hundred and fifty square feet of signagc, so from one
hundred and one to two hundred and fifty is an additional one foot of square footage for that second amount
of frontage .

Bill Clayton. 958 East Cornell Avenue. advised that he is co-chairman of the Greater Englewood Chamber
of Commerce, and was speaking on behalf of the Chamber, in suppon of these cha nges to the Sign Code .
He noted that we would not be speaking to 1he basic sign code. but it wo uld be an attempt to add .111 overlay
di strict He said we could probably debn1e whether the Sign Code itself is a good idea or not. However. he
said, a good sign is not jus1 utilitarian or informalional, but attracts your anention and invites you. evokes
memories. entices you. informs you :md gives you a reason to slop at 11 business . He said, as he was driving
down here tonight. he drove by the Gothic Theatre, and noticed all the new chrome, and the way the
marquee has been redone. He said he could remember when he was a child at the Gothic, and he felt good
sig ns do that sort of thing . He said he also drove by the new Hollywood Video sign. which he feels is one
of 1he mosl exciting signs in the Denver metro area. He said he can oot help but wish we bad more exciting
signs like that in Englewood. and fewer signs that arc just the business name painted on board. hidden
behind a trc:e. Personally, havi ng been a businessperson for about thirty years, and owned business with
signs. he sai d he felt this was one of the most exciting ordinances that has come before Council in a long
time . He personally urged Counci l·s support, and he felt the Chamber of Commerce and the businesse s in
Englewood would also urge their support . It gives more opportunities fat creative, innovative and
aurac 1h ·e signs. We can find lot.s of things we would like to cha11ge . he allowed, but lhe bottom line is that
ii gives more opportunities for businesses to be creative. Mr . Clayton said. if yo u tum loose the creative
minds of designers an,:! sign companies and individual businesses. you \\'OUld just haven wonderful
ple1hora of new signs. He urged CoWlCil, once they sec how successfu l this is. to revisit it and extend it to
lhe other business areas in Englewood. This is only along Soulh Broadway , he said, and docs not do
anything for Hampden. and there are a lot of businesses west of Broadway on Hampden. he said. It docs
nol do anything for the businesses over at Federal and Belleview, they are in Englewood, too. He repeated

would establish vested rights for Trammell Crow Rcsident i1I in the CityCcn1cr Englewood. He submitted
Proof of Publication of the Notice of Public Hc:i.ring . which was prinled in the Englewood Herald on
April 7, 2000. Mr. Simpson recoiled 1h01 Council considen:d lhe si1e plan on April 3. 2000, and, 11 lh11
meeting , approved the site plan and supponing design rev iew . Also . th:11 snmc C\'cning. the vested rights
time frames were considered for Trammell Crow Residential. Those vested righls and the site plan were
appro ved by lhe Englewood EnvironmenlDI Foundolion , as well os by Trammell Crow Reaiden1lal, he said.
§24•68 of Colorado Revised Statutes provides for vesting of ccnain development approvals 111 certain
po ints in the development process . What we arc saying here . he said. is that vesting 1s simply providing
assurance of stability and that ongoing conditions that arc approved at this time will continue for a
designated period of time for the developer. It provides stability that is the bottom line . Within this vested
rights resolution. we have a three year vesting provision, he advised. that is provided by State Statutes .
Ves1ing is not somelhing lhe Ciiy of Englewood has 1ypically done , allhough ii is nol an :inusual process.
It is very common with development projects: of this kind of magnitude . Since we a.re talking a fifty
million dolla.r project . it would be expected to have a requcs1 for on-going assurances of development
approvals. There are no changes from April 3"'. this simply is I procedure that is in accordance with State
Suuutes, he said. and this fonnalizes what you have already approved on April 3n1, Mr. Simpson said the
Englewood Environmental Foundation urges Cc,uncil's approval of this vesting right.
City Anomey Brotzman Jid thi s is an unusual circumstance and we a.re still working the kink.I out . This is
a new State Statute. he said . The ordinance is actually on first rending this evening under the Consent
Agenda, he advised .
Mayor Bums said the statute states that a vested poperty right is established with respect to propeny upon
approval or conditional approval of a site-specific development plan foll owi ng public hearing and notice by
the local government. He asked if the si te plan has been approved . City Attorney Brotzman responded
affinnativcly . Mr. Simpson said it was approved on April 3"'.

Council Member Wolosyn said she did not have questions, it was just something that she ~Id like to hear
read into the record . It shows that we arc cooperating with the business community. she said. This could
have been a condemnation, but it was a cooperative solution, and she thought that was grut.
Mr. Simpson agreed that :1 was a positive process . Staffha.s been trying to acquire right-of•way for the
extension and straightening of Englewood Parkway between Elati and Cherokee, he said. This exltmsion is
a new road that will accommodate traffic into the new CityCenlcr project. Currently. along Englewood
Parkway, it is kind of a series of curves thnt really do not fociliuuc trartic. There will be a large amount of
traffic from busses, because this will be a ponion of :i bus rou1c into the project. until it turns on Elati and
goes up 10 Floyd. The way it is currently configured. it simply would not \I.Ork. he asserted. We have been
working on this for several months. and Capital Projects Manager Ko.hm has been doing a terrific job of
negotiating with Situs. he said. Situs has been a greal property to work wi1h throughout the last several
years, he said. and they have a lot of development interes1 in this area. They own the Wells Fargo building
and the Bank One building. and there is a lot of development potential within this area. Mr. Simpson said
lhis begins 10 offord lhe Bonk One building, specificolly. n 101 of polential fulure flexibilities. The aood

(i) Mayor Bums advised that lhc South Metro Chamber of Commerce Board
stopped at the new development last Friday morning . We gave them a presentation there. be said. and they
were quite ex.cited about it They will certainly be bi.ck for the light rail opening and viewing of the Civic
Center, he said.
(ii) Mayor Bums said. regarding the growth compact that was taken up at the last
DRCOG meeting. for growth cootrol, he was advised by Don Parsoos. the new chair of tl,e Metro Mayors'
Caucus. that they met agnin on that . There were a few minor changes. and lhc City of Northglenn, which
Mr. Parsons represents. has adopted it. They arc going to send out a resolution, and they would like the
cities to stan adopting that compact. There will probably be a ballot measure on growth control. an
inillalivc, and DRCOG feels that if we can adopt this. we can get a lot of publicity to let the public koow
that there is a voluntary cffon between the cities and counties to agree on growth control measures, he said,
despite the fact that the Legislature did not pass anything on this.

(a) City Manager Sears reminded Council Oiey would be receiving infonnarion for the
Saturday ret~t from the department heads this Thursday night He said we wo uld really try lO focus on
the status ('I f the top three items tha! they are working on this year. and then review of the top I.ht ,. for next
year so we can keep our focus together at the meeting . We plan to have lunch at the Wastewater building,
he ad\'i~d. and then head over to 1he new city hall for a review of some of the issues we will be facin1, 1c
will be e,ci1ing , he said, and we hope 10 be done by 2:30 or 3:00 p.m. Mr. Sears fell the staff was propared
for where we arc going , and that there would be a good give and lake on the issues. He said staff' is looking
for direction from Council on a number of key issues.
14. City Attorney's Report
(a) City Attorney Brotzman said he had ll request for a resolution regarding purchase or
condemnation of 301 Englewood Parkway , which is Parkway Printing . He reminded Council that thei
previ ously gave authority by moiion , but it was general and did not have a spo:ifiC addrcs.5. Ii pvt four
propenies, the Situs propenies . which Council Just passed , and Parkway Prinli~g. This one spedficaliy
lists the address. he said, it is a technical issue regarding the condemnation process . We have been in
negotiations with Parkway for quite some time, he said, but the negotiations stalled. We are !)l"Oposing that
Council do this resolution and make sure we obtain possession. which is our primary factor ri ght now . The
attorney representing Parkway hllS contacted us and wants to discuss negotiations again , and we have
indicarcd that J)C)Sscssion is our primary issue at thi s point. Mr. Brotzman said he would like to go ahead
with jijs so that. :f ntsotiations stall again. we can pnx -ed. to get possession of that property.
