SERIES OF 2006 A RESOLUTION AIJ11{ORIZINO THE EXTENSION OF TRANSIT SHU'ITLE SEllVICES OPERATIONS CONTRACT BE'IWEEN LAIDLAW TRANSIT SEil ViCES, INC . AND THE CITY OF ENGLEWOOD FOR THE OPERATION OF THE ENGLEWOOD CIRCULATOR SHUTTLE FOR 2007. WHEREAS, the Englewood City Council approved an Intergovernmental Aareement between the City and the Resional Transpor14tion Di Itri ct for funding of the Englewood Circulator Shuttle for 2004-2007 by the pusage of Ordinance No. SO, Series of 2004; and WHEREAS, the passage of this proposed Resolution approves the extenaion of the Transit Shuttle Services Operations Contract and will provide for oil vehicles and operational components of the project ; and WHEREAS, the source of funds for this Contract comes from a grant from the federal government throvjlh the Congestion Mitigation and Air Quality Improvement (CMAQ) program which isjoinll\' administered by the Federal Highway Administration (FHWA) and the Federal Transit Administration (FT A) which funds projects to reduce air pollutants from transponation- related sources ; NOW, THEP..;FORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOL', COLORADO, THAT : ~-Tile Extension ofTransit Shuttle Services Operations Contract between Laidlaw Transit Services, Inc and the City of Englewood, pertaining 10 the Englewood Circulator Shuttle for 2007, attached hereto as Exhibit A, is hereby accepted and approved by the Englewood City Council. Ellis, City Clerk for~ City of Englew above is a true copy of Resolution No. I/_, Series of 2 . • • • EXHIBIT A EXTENSION OF TRANSIT SHUTTLE SERVICES OPERATIONS CONTRACT This Contract is made and entered into as of the 18th day of September, 2006 , by and between the City of Englewood , a Colorado Municipal Corporation (City) and Laidlaw Transit Services , Inc ., a Delaware Corporation (Laidlaw). WHEREAS , Ordinance No . 50 , Series of 2004, provided for funding for a shuttle service within the downtown aa a of the City of Englewood , Colorado; WHEREAS , the purpose of the project was to implement vari ous transportation services and improvements to reduce dependence on th e: single occupant automobile , facilitate movement of traffic to and within the commercial areas of the City of Englewood and to minimize traffic congestion in the ~hu rt le area ; WHEREAS , the Contract for transit shutue services operations from September 2004 to September 2005 was granted to Laidlaw Transit Services , Inc .; WHEREAS , Ordinance No . 50 , Series of2004 and L'ie original Contract dated August 2, 2004 provides for an extension for the Contract for two consecutive one year periods subject to the same term s and conditions ; WHEREAS , in the original Contract the cost of the shuttle operation for 2004-2005 was $207,538 ; WHEREAS. The cost of the shuttle operation for 2005-2006 was $213,772 . WHEREAS , the parties wish to extend this Contract for tl1e µeriod of September 2006 -2007 , with compensation to Laidlaw for the yea, in the amount of $216,868 which is consi stent with the proposed amount in the original contract NOW , THEREFORE, in consideration of the mutual covenants and stipulations provided in the original Contract and hereinafter, the parties agree to extend the Transit Shuttle Services Operations Contract of August 2, 2004 for the 2006-2007 period ending on September 6, 2007 . .,. Stitt, Community Development Manager PREVIOUS COUNCIL ACTION Coun ci l approved by Ordinance 50, Series of 2004, an Intergovernmental Agreement (IGA) between the City and the Regional Transportation District (RTD) for funding of the Englewood Circulator Shuttle for 2004-2007. Council subsequentl y approved Resolution 87 on November 21, 2005 extending the contract for 2005-2006 . RECOMMENDED ACTION Staff recommends Coun ci l adopt a Resolution authorizing an agreement between the City of Englewood and Laidlaw Transit Services , Inc. for the 2006 -2007 operation of the Circulat or Shuttle in the amount of $216,868. • BACKGROUND AND ANALYSIS • This co ntract extension will provi de for all vehicles and operational components of th e project. Fuel w ill be supplied by the City, w ith reimbursement to the appropriate fund , to eliminate state and federal gasoline taxe s, reducing fuel costs by approximately $.SO/gallon. FINANCIAL IMPACT For 2007, the Laidlaw contract is $216 ,868, which represents no increase above the original proposed contract amount. The source of funds for this contract comes from a grant from the Federal Gov ernment through the Congestion Mitigation and Air Quality Improvement (CMAQ) program . The CMAQ program, jointly administered by the Federal Highway Administration (FHWA) and the Federal Transit Admin istration (FTA), funds projects that reduce criteria air pollutants regulated from transportatioo-related sources. The three year Federal grant provides a total of $662 ,27 8 ($212,160 for 2005 ; $22 0 ,,46 for 2006 ; and $229,472 for 2007.) The Federal grant requires a 20% local match which is si•'·t equally between RTD and the City. Englewood 's required 10% match is $21,216 for 200 ~; f U ,065 for 2006; and $22,947 for 2007.
