Council Member Waggoner asked ,.,t,y. under R-1-A SINGLE-FAMILY RESIDENCE DISTRICT, th e
line. "and to prohibit arthities of• commercial nature within lhc District". has been deleted . Mr. Still

Mayor Gulley felt the issue should be addressed at the public hearing. for, if home occupation s arc not
nllowcd in R•l·A. the City will OC\"Cr have the conditions that the statement addresses . Discu ss ion
ensued.
Cou ncil Member Habenicht qucstionai whether the proposed amendment addresses th e co ncern brought
up by some members of the Board or Adjustment and Appeals. as to whether the definiti on of garage
should be amended to eliminate the r-..:(crcncc to storage of motor vehicle). fl.tr. Stitt ndviscd 1hat the
conce rn was referred back to the Planning and Zoning Commission . They rcviC\\ed the infonnation and
dctennincd that, due to the limited number of situations invoked , th e requests shou ld be referred to 1h e
Bo.ud of Adjustment and Appeals as that is the proper procodurc .
Council Member Habenicht stated she understood some members of the Board of Adjustment and Appc.i ls
indicated, because oflanguagc in the proposed ordinance, they would find it diffi cult or impossib le to
gra nt some variances. Mr. Stitt stated he feel s the Board has the abilit y 10 grant a varinncc in situa1io ns
where lhc applicant meets the appropriate criteria.
Counc il Member Hathaway commented that the original question w;is what really constitu tes a gamge
versus another type of accessory structure. She staled that, as the Pt :i nning and Zoning Commi ss ion fee ls
1berc is n01 a problem "ilh the definition of garage , she .. is "illing to li\'c with it ."
In response to Council Member Habcnichl Mr. Stitt confirmed 1h.11 any existing structure in comp li :mcc
\\ith the Code is not affected by these proposed regulations .
