Invocation The Invocation was given by Council Member Bullock . 3. Pledge of Allegtanc:e The Pledge of Allegiance WIS led by Mayor Wiggins. 4. Roll Call Present : Absent: A quorllffl was present. Evidence exists of the required Publication of Notice of Public Hearing whi ch appured In the Englewood Henld on February 6, 1992 1 February 13, 1992 and February 20, 1992. Director Esterly stated that all affected property owners had been not ifi ed of the lown Meeting, Public Hearing, and proposed schedule, and had been provided with information concerning the District. He presented the proposed schedule for Paving District No. 35. He provided general background information on Englewood 's Paving District Program. lhe City of Englewood originally ini- tiated paving districts in 1956 In an effort to upgrade all of the City streets to Cl'ty standards. Co uncil Member Van Dyke requested Hr. Esterly to explain a typical Englewood ind us t rial paving section. Mr. Esterly reviewed the procedure and noted the improve ments on Navajo and Windermere will be constructed by the State Highway Department. Council Member Hathaway requested Hr. Esterly to expl1in the reason a sidewalk will not be constructed on the west side be tw een Oxford and Quincy. He stated the City has not obtained the required right-of-way . Ns. Hathaway noted it would allow easier access for the existing businesses . Mayor Wiggins Invited those present to speak concerning the proposed paving district . Charles Renaud , President and General "anager of Renaud Excavating, 4390 South Winder11ere, objected to the paving district. He expressed displeasure that the State would be purchasing property from him and he would be financially responsible for the paving and curb and gutter . Addit i onally, the closing of Tufts and Quincy will make access to his business more difficult . He noted that the back portion of his prop e rty, which is to be divided, will become useless to him. Walter Schoefberger, S55 West Lake, Littleton, owner of property at the corner of lufts and Navajo, stated he bought tt,e property in order to expand his busin ess. He contended that as the City "is taking a corner away, this piece of property is worthless" and it is not fair that he has to pay for th e c urb. I Marv i n Vette, 4545 South Osage , stated he owns two pieces of property in the de sign ated area. He stated one pi ere of property is like a "flagpole" and the other has access of 30 plus feet o West Tufts . He noted the street has been I paved for a long time and he feels the City should pay for an y improvements . He suggested a different rou te which in his opinion wo uld be less disr up tive. Mr. Vette stated It is unfair for the City to ask the businesses t o pay for a frontage road. Mr. Yette responded to Counci 1 Member Hathaway 's quest i on regarding his actual location . I I Engl.wood City Council Ntnutes Narch 9, 1992 -Page 3 Ken Vancil, 6495 Happy Canyon, Denv er, stated he owns property at Navajo & Quincy. He maintained he would be losing 30 feet of his property which will "completely disable" his trucking busine~s. Discussion ensued regard Ing ac - cess to his business. Di:--ector Esterly noted that access on Santa Fe is being restricted by the State Highway Department and the Publ i c Utilities Commission. There will no longer be at-grade railroad crossings along Santa Fe . The reconstruction is to accommodate the underpasses which will alter the elevation of Santa Fe . This leaves the City in the position of negotiating with the State Department of Transportation for suitable alternatives . Mr. Esterly encouraged anyone who wants more information on the opportunities and options available to call his office . He also offered the City's assistance with negotiations with the State Highway Oepartinent. Council Member Gulley asked for clarification of the reason they will be using Navajo on the "off-take" from Windennere. Engineering Manager Kahm, noted the Navajo alignment w1s addressed in 1974 by the Planning Co111nission . It has been a part of the Master Street Plan since that time. Additionally, this aligninent was addressed in 1983 with the ten- year paving plan, and the adjacent owners were notified at that time of the intent to include Navajo in a future paving district . Council Member Gulley questioned the justification for the Navajo alignment. City Manager Fraser explained the problems encountered in attempting to lessen the impact as much as possible and still provide a frontage road that would handle truck traffic with a minimum of sharp turns. Council Member Hathaway noted the alternative would have been to construct a "fly -over" at Oxford which would be cost prohibitive. Mayor Wigg;ns asked for a motion to close the public hearing. COUNCIL MEMBER HATHAWAY MOVED, AND IT WAS SECONDED, TO CLOSE THE PUBLIC HEARING. Ayes : Nay s : Absent : Motion carried .
