7 . Non-scheduled Y1s1tors
(a) Fred Hawley, 3024 South Corona, co11111ented that it seemed the only
groups in favor of the concrete district were the lllljority of City Council,
City staff, and concrete contractors. He et111hastzed the hardship the assess-
ment will place on citizens with restricted discretionary income. Mr . Hawley
felt there was considerable support for change In the syste■.
(b) Darryl Begordis, 559 East Pennwood Circle, felt the deterioration
of his concrete was I result of poor drainage. Under the circ1111stances he
felt the City should be held responsible for at least half of his assessinent .
Discussion ensue regarding the drainage problems.
(c) Melvin Dills , 3205 South Williams, stated he had voluntarily par -
ticipated i n last year's district, for which he has not yet been assessed . He
questioned if he would be given the same discount for administrative costs as
this year's district. Discussion ensued .
(d) Four students from Flood Middle School: Kelly Montoya, Brooke
Shroyer, Briana Mej i a, and Trisha Murrain, requested permis sion to plant t r ees
in the Flood/Ory Creek Drainage area . City Manager Fraser stated the C lty
would be glad to work with them .

(e) Al Zinn, l190 West Radcliff, stated he appreciated the City 's
acknowledgment of you t h partic i pation . He complimented the City on it s cu s -
tomer relations. He stated Linda Wilks and Ray Creighton of the Pu bli c Works
Department had been particularl y helpful. Hr . Zi nn expressed in t ere st in
vo l unteer in g for the concrete program .
(f) Ha r k Thomas , 4700 South Delaware, stated he owns three ho mes in
Englew ood . He fel t i t wa s on l y equ i ta ble that the Ci ty s hould er som e of the
fina nc i al r espons i bi lit i es of th e concret e as s es sments . In the event Coun cil
were to ap prove this district he wanted to know what he wou l d need to do t o
pe t i t io n for the is s ue to be on th e ballot. Dis c us s ion ens ue d .
(g) Ida Valdez, 3050 South Marion Street, noted she 1s not i n t his
year 's district, but felt she would be sooner or later. She wanted to know i f
t he Task Force would continue to look at the concrete replacement i ssue .
Mayor Wiggins stated the Task Force would st udy all the alternat i ve s. Ms .
Valdez encouraged Council to adv i se citizens, 1n language they can understand ,
of their options .
(h) Ted Eaton, 4546 South Wash i ngton, contended his sidewalk i s not bad
enough to be replaced and he asked to be excluded from the distri ct.
(I) Rick Bicknell, 795 West N1ss1u Way, asked to be excluded from th is
year's concrete district. He supported a mill levy increase to fund the pro -
gram and he stated he would like to see it put on the ba l lot.

(b) With regard to Council 81 11 No. 16.l creating Concrete Replacement
District No. 1992, Council Member Gulley stated she is in agreement with the
comments made by Hr. Hawley. She stated she does not see any viabl e reason t o
not put this off for one year.
Council Member Waggoner stated he had talked to several people since th e last
meeting and felt there was a lot of concern. Some of the comments were they
wanted more time to get the concrete work completed under the permit sy stem.
There is also concern that the est ima tes from pr iv ate contractors is much less
than the cost the City's quoting, even though the City should be ab l e to take
advantage of a "quantity arrangement ." Also , those who volunteered last year
want to take advantage of the d i scou nt that was approved in this year 's con -
crete d i strict . He stated he would vote no on the passage of the ord i na nce.

Council Member Haben icht stated she feels it is appropriate at this time to
postpone the concrete di strict. She pointed out that the Concrete Task Force
ha s been charged wi th studying the alternatives and she agreed wi th Mr. Haw -
ley's conrnents.
COUNCIL HEMBER HATHAWAY MOVED, AND IT WAS SECONDED, TO APPROVE ON SECOND READ-
ING COUNCIL BILL NO. 16.1, ENTITLED:
AN ORDINANCE CREATING CONCRETE REPLACEMENT DISTRICT NO. 1992, IN THE CITY OF
ENGLEWOOD, COLORADO; ORDERING THE REMOVAL AND REPLACEMENT OF SUB-STANDARr,
CURB, &UTTER, AND SIDEWALK, TOGETHER WITH NECESSARY INCIDENTALS; AND SETTING
FORTH OTHER DETAILS IN CONNECTION WITH THE DISTRICT.
Council Member Van Dyke stated she feels It Is the responsibility of the
citizens of Englewood to address the badly deteriorated concrete that has been
identified. Ms . Van Dyke contended it would be inappropriate to delay the
repairs.
Council He111ber Hathaway noted the i ssue could not be put to a vote of the peo -
ple until next year. She feels it ls approprl1te to proceed with the concrete
district this year because a good portion of the district is comprised of
residents who were notified last year, lnfore the task force was created .
She considers it a disservice to those residents wtlo have objected to the pro-
gram. Ms. Hathaway noted she is a h011eowner tn the district and pointed out
she has received five different letters of notification advising of all the
options available regarding pa,Y111nt plans, a 11st of licensed contractors,
hearing dates, and council members phone numbers. She stated she appreciates
the co .... nts -frOII the cithens and the work the Task Force 1s doing . Ms.
Hathaway does not believe there is auch that can be done to aaend the district
and does not feel the Task Force would coae up with that many different reco111-
mendatlons. She also feels th1t since assessments have not been Issued on
last year's district , the Task Force can continue to look at rebating those
ad~intstrative costs.

II. Ordinances, Resolut i Jns and Notions
(a) Walt Gro d its ki, Fire Harshal, presented a recorrrnendation from the
Department of Saf e ty Services to adopt a r esolut i on autho riz i ng fees for im-
plementation of the Hazardou s Mater ial s Perm it Program . Und er the provisions
of Article 80 of the 1988 Uni form Fi re Code, wh i ch reg ulates hazardous
mate r ials, the City is author ized to im plement a pe rmit program to guarantee
or at least to insure s afe s t orage and use of th e mater i al s. He discussed the

par t i cu l ars of the program . He noted the recommendation i s to c harge an an -
nu al perm it fee of SSO . 00 per each catego r y of hazardous mater i al s and a

Mr. Gro d l tsk1 explained staff would be conducting the i nspec tions on t his pe r -

Council He11ber Habenicht expressed concern over the additional burden being
placed on the bus i ness c01111unity . Council He11ber Bullock concurred and sug•
gested there should be other alternatives to achieve the objectives of the
progra• without assessing the fees.
Council Member Hathaway countered that the proposed progr• would assist the
businesses to confon1 to necessary standards and fede~al regulations.
Further discussion ensued about the pemtt fees ind the consulting fee .
Hr. Groclitskl responded to vartous concerns expressed by Council . He stressed
the importance and need for a progra to reduce hazardous dangers to the busi -
nesses, their et11Ployees, neighbors and firefighters.
City Manager Fraser pointed out that in a number of instances there is a dis -
proport i onate amount of time expended by staff and he collllM!nted the consu l ting
f e ~ i s proposed to cover, at a minimum, that kind of service. He collllll!nted on
the addit i onal and extraordinary expense the City has experienced in train i ng
staff to deal with hazardous materials . Hr . Fraser re i terated that this per •

(b) Director Hayes, presented a recoaendatton froa the Departaent of
Financial Services to adopt a resolution 111endtng the 1992 Annual Budget and
transferring appropriated 110ntes between departaents and divisions. She noted
this resolution would transfer -,ney that hu 1lready been appropriated fron
the General Fund, General Govenwent Depart11ent into the appropriate depart -
ments and divisions within the General Fund i:i order to allocate the 110nies
that were budgeted in one lu11p sua for future salary increases . She explained
that, when the proposed budget was drawn up, the 1110unt of the contract in-
creases had not been deter11tned. The resolution would also reallocate monies
between the department and divisions In order top~ for Workers COflllensation
for this year. She advised this represents a savings of S92,000 over what was
budgeted, and reallocates based on the amount of the actual bi lling .

Hr. Black advised the City wil l trade tn 20 golf carts and i n turn purchase 12
E-Z Go golf carts. The City will then acquire eight add it i onal carts on lease
purchase or th rough donations from various manufacturer s and perform a two -
year ma intenance study on the di f ferent types of carts. The maintenance study
will assist staff in the future direction of the go l f fleet . Discussion
ensued.

City Manager Fraser pointed out that two carts have been donated for two years
from Ya111aha.
(d) Director Esterly presented a rec011111ndation from the Ol!part111nt of
Public Works to buy two new Howard Price Turf Mowers fl"OII Colorado General
Equipment In the a1110unt of $31,256.80. He noted this h1pl111ents a program
that replaces four 110•rs/four aower operators with a program that uses two
mowers/two 110wer -operators.
Council Member Bullock felt th i s was one of the areas considered for
privatization. Mr. Esterly stated he has not done an evaluation of privatiz-
i ng mowing servtces, nor has It been set as a goal.

(e) Director Fonda presented a recomendation from the Utilit ies De-
partment to approve a contract for two additions at the All en Filter Plant.
He noted this is the th i rd time th ,s has gone out to bid. He adv is ed of
ar i ous problems encountered dur i ng the bid process. Mr. Fonda noted the in-
creased number of water meters i n the Englewood system requires addit io nal
sp ace in the meter shop area . The other add ition Is for a proposed training

and an ar ea where the non -smoking employees can have their l unchroom.

Fraser explained that the circumstances at the water plant require the op era -
tors to remain on site to monitor the equipment.

amount not to exceed $71,500. Mr . Fonda pointed out that the contri bution
will count toward our final settleaent.

(111) Council Member Waggoner inqu ired 1bout the status of the
DRCOG Fl ashing Light Study . City Manager Fraser agreed to prov i de Hr . Wag-
goner with a copy of the study.

be approaching Council at a later date requesting thefr support .
3. She reported she had attended a Neighborhood Watch Captains Meet i ng and
was very impressed . She encouraged other Council Members to attend a meeting .

2 . She noted environmental month in the City of Englewood was very success-
ful. She e~pressed her appreciation to the youth groups, such as the group
from Flood Middle School , that continue to be involved in environmental
is sues.
(vi) Council Member Van Dyke requested the Pol ice Department ad-
dress speeders on Floyd Avenue. She felt the pol ice should be out "randomly"
at least twice a month at that location. Council Member Hathaway pointed out
with the concrete construction on Eutman Avenue, Floyd Avenue would become
more of a problem. Discussion ensued.
(v i i) Council Member Bulloc k :
l. Requested Council's support to attend the CNL convention in Fort Collins.
He also encouraged Kayor Wiggins to attend the CML convention. It was deter-
atned Nr. Bullock needed to COllply with Council's travel policy and submit a
request prior to Council considering his request for travel expenditures.
Discussion ensued.
2. He understood Council l«IVld be studying traffic around elementary
schools. He asked the City fllnager to plac• the tssue on the next study ses-
sion agenda. Discussion ensued regarding lftlrktng with the schools on the
safety issues. City Nanager Fraser noted the City has been participating
wi th all of the schools .and their various representatives in the development
of a safety plan. Council will receive a report fr011 the School Safety Com -
mittee at the next study session.
13. City Nanager's Report
(a) Mr . Fraser reminded Council of the Tri-Cities Meeting Thursday, May
7, 1992 at 7 :00 p.r,, .. at the Ctty of Sheridan. Council Hember Habenicht noted
a conflict exists, as that ts the night of the District III assembly.
(b) He reminded Council of their regular meet1n~ with Swedish at 8:00
a.m. Friday morning, May 8, 1992 .
14 . City ~ttorney's Report
I
(a) Mr. DeWitt stated he would have more to report regarding the EPA I
negotiations at the next meeting, and that an executive session is unnecessary
at this time.
