HomeMy WebLinkAbout1988 Ordinance No. 016ORDINANCE NO. _/_ft2 SERIES OF 1988 BY AUTHORITY COUNCIL BILL NO. 16 INTRODUCED BY COUNCIL MEMBER KOZACEK AN ORDINANCE APPROVING '.I'HE JOINT FUNDING AGREEMENT BE'l.WEEN THE CITY OF ENGLEWOOD BI-CITY WASTEWATER TREATMENT PLANT AND THE U.S. GEOLOGICAL SURVEY FOR THE OPERATION AND MAINTENANCE OF A STREAM-GAGING STATION LOCATED ON THE SOUTH PLATTE RIVER AT ENGLEWOOD. WHEREAS, the Bi-City Wastewater Treatment Plant entered an agreement in 1985 with the U.S. Geological Survey (USGS) whereby the Bi-City Plant would fund the construction of a river gaging station and pay 50% of the operating costs while the USGS performed the operation and maintenance of the station; and 'NHEREAS, the flow in the South Platte River is a key pararreter of the discharge perm.it issued to the Bi-City Treatment Plant, and measurement is needed to efficiently meet permit requirements; v*IF.RF.AS, the period of the agreement is October 1, 1987 to September 30 1 1988 with USGS paying $1,275 and the City of Englewood paying $1,275 as a contribution to cover the cost of the necessary field and office work directly related to this program; Na;,if, THlfilEFORE, BE IT ORDAINED BY TI-IE CITY COUNCIL OF THE CITY OF ENGLEWOOD I COLORADO I THAT: Section 1. The agreement between the City of F..nglewood, Colorado, and the U.S. Geological Survey, United States Department of Interior, for operation and maintenance of a stream gaging station located on the South Platte River at Englewood is hereby approved. A copy of the agreement is attached hereto and incorporated herein by reference. Section 2. The City Manager is hereby authorized to sign for and on behalf of the City of Englewood. Introduced, read in full, and passed on first reading on the 2nd day of May, 1988. Published as a Bill for an Ordinance on the 4th day of May, 1988. Water Resources Investigation AGREEMENT is entered into as of the 1st day of October 19 87 by the GEOLOGICAL SURVEY, ~Ni rED STATES DEPARTMENT OF THE INTERIOR, party of tt1e first part, and the CITY OF ENGLEWOOD party of the second part. 1. The parties tiereto agree that subject to the availability of appropriations and in accordance with their respective authorities there slv.111 be main_tained in cooperation operation and maintenance of stream-gaging station located on the South Platte River at Englewood hereinafter called the program. 2. The following A.mounts shall be contributed to cover all of the cost of the necessary field and office work directly related to this program, but excluding any bureau level general administrative or accounting worl~ in the office of either party. (a) $ 1,275. oo by the party of the first part during the period October l, 1987 ~ September 30, 1988 (b) $ 1,275. oo by the party of the second part during the period October 1,. 1987 to September 30, 1988 (c) Additional amounts by each party during the above period or succeeding periods as may be determined by mutual agreement and set forth in an exchange of letters between the parties. 3. Expenses incurred in the performance of this program may be paid by either party in conformity with the k,ws and regulations respectively governing each party, provided that so far as may be mutually agreeable all expenses shall be paid in the first instance by the party of the first part with appropriate reimbursement thereafter by the party of tho second r • Each party shall furnish to the other party such statements or reports of expenditures as may be needed to satisfy requirements . . , , ne field and office work pertaining to thi,; program shall be under the direction of or subject to periodic review by an authorized representative of the party of the first part. 5. 1 The areas to be included in the program shall be cleterminod by mutur1I agreement between the parties hereto or their authorized representatives. The methocls employed in the field and office shall be those adopted by the party of the first part to insuro the required standards of accuracy subject to modification by mutual agreement. 6. During the progress of the work all operations of either party pertaining to this program shall be open to the inspection of the other party, and if the work is not being carried on in a mutually satisfactory rnannor, either party, may terminate this agreement upon GO clays written notice to the other party. 7. The original records resulting from this program will be deposited in the office of origin of those records. Upon request, copies of the original records will be provided to the of lice of the other party. 8. The maps, rncords or reports resulting him this program shall bu m,de nvailable to the public as promptly as possible. The maps, records or reports normally will be published by the party of tho fi131 part. However, the party of the second part reserves the right to publish the results of this program and, if already published by the party of the fir::,! part r;hall, upon request, be furnished by the party of the first part, ,\t cost., impressions sui':able for purposes of reproduction similar to that for which the original copy was prepared. The maps, records or reports published by either party shall contain a statement of the cooperative relations between tho parties. 9. Billing for this agreement will be rendered October 198B . BACKGROUND The flow in the South Platte River is a key parameter of the discharge permit issued to the Bi-City Treatment Plant. Measurement at the plant is, there- fore, needed to efficiently meet permit requirements. The Bi-City Plant en- tered an agreement in 1985 with the USGS whereby the Bi-City Plant would fund the construction of a river gaging station and pay 50 per cent of the operat- ing costs while the USGS performed the operation and maintenance of the sta- tion. This contract covers the expenses for 1988. FINANCIAL The Bi-City share of the cost is $1,275 and is 50 per cent of the total esti- mated cost for 1988. RECOMMENDATION City Council approve Ordinance# __ , Series of 1988 authorizing the City Man- ager to sign the Joint Funding Agreement with the U.S. Department of the Inte- rior Geological Survey for a river gaging Station at the Littleton/Englewood Bi-City Wastewater Treatment Plant. ,,,)I: ·,. .
