AN ORDINANCE REPEALING AND REENACI'ING TITLE 5, CHAPTER 9, ENGLEWOOD MUNICIPAL
CODE 1985, RELATING TO TOWING SERVICES.
WHEREAS, the City Council of the City of Englewood declares that it is
in the best interests of the City of Englewood to regulate the selection and
contracting of towing and storage companies for the towing and storage of
disabled or abandoned motor vehicles; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEvilOOD, COLORADO, THAT:
Section. l. Title 5, Chapter 9, Englewood Municipal Code 1985, is
hereby repealed and reenacted to read as follows:
5-9-1:
CHAPTER 9
VEHICLE WRECKER AND TOWING SERVICES
AT THE REQUEST OF CITY POLICE DEPAR'IMENT
DEFINITIONS:
VEHICLE WRECKER A VEHICLE ADAPTED TO AND DESIGNED FOR THE
TOWING AND TRANSPORTING OF OTHER VEHICLES OR
PROPER'rY.
OPERATOR
TOWING SERVICE
A PERSON OPERATING A WRECKER.
A COMPANY OR BUSINESS THAT TOWS AND STORES
VEHICLES.
5-9-2 : TOWING AUTHORIZATION: ONLY A TOWING SERVICE THAT HAS
CONTRACTED WITH THE CITY OF ENGLEWOOD IS AU'rHORIZED TO TOW MOTOR
VEHICLES, TRAILERS OR OI'HER PROPERTY, AS PROVIDED FOR IN C.R.S.
42-4-1601 ET SEQ., APPLICABLE TO "DISABLED MOI'OR VEHICLES" AND
ABANDONED VEHICLES THAT THE CITY CANNOT OTHERWISE TOW TO THE
CITY POUND WITH A CITY WRECKER.
5-9-3: NO LIMITATION UPON BUSINESS OF P.U.C. AUTHORIZED TOWING SERVICE:
NOTHING HEREIN CONTAINED SHALL RESTRICT, OR BE TAKEN TO
RESTRICT, THE RIGHT AND AUTHORITY OF A TOWING SERVICE, PROPERLY
LICENSED BY THE PUBLIC UTILITIES COMMISSION OF THE STATE OF
COLORADO, TO PROVIDE TOWING SERVICES TO PERSONS orI-lER THAN THE
CITY OF ENGLEvilOOD. ·

Adopt a bill for an ordinance amending Title 5, Chapter 9,
of the Englewood Municipal Code, 1985, entitled "Vehicle Wrecker and Towing
Services"
INTRODUCTION
Englewood Municipal Code Title 5, Chapter 9, Section 5, does not allow for a con-
tractual agreement for towing and storage service of disabled motor vehicles and
abandoned vehicle towing. The police department recommends amending the existing
ordinance in order to contract for towing and storage service. The contractor would
be selected on a bid basis to assure adequate service capability, appropriate charg-
es, and protection of the citizenry. Under the existing ordinance, with numerous
eligible towing companies allowed to be on the towing list, the policing of these
companies and their storage lots is neither cost effective nor efficient for the
city.
BACKGROUND
CRS 42-4-1601, 1986, provides for the removal, storage, and disposal of abandoned
and illegally parked motor vehicles. It allows towing and storage companies to ap-
ply for title of abandoned vehicles stored on their lots, and for vehicles towed to
their lots that become abandoned on their lots, and provides for disposal of same.
Under municipal ordinance 5-9-1, the Englewood Police Department maintains a towing
list of eligible towing companies that tow disabled and abandoned vehicles. In or-
der to be included on the towing list, a company must be licensed and police depart-
ment background investigations completed on their employees. Storage lots, com-
munication capabilities, and equipment of each company also have to be checked by
police department personnel prior to licensing, requiring excessive man-hour costs.
Therefore, it seems appropriate for the city to contract with one company in order
to reduce these costs.

FINANCIAL CONSIDERATIONS
The passing of this ordinance will decrease costs to the city and provide for a man~
ageable number of towing and storage companies for the police department to
regulate.
LEGAL OPINION
The city attorney has reviewed this proposed amendment.
CONCLUSIONS AND RECOMMENDATIONS
Recommend that the ordinance be passed and approved.
