(a) Mayor's Choice
(1) Mayor Van Dyke announced the b1 -110nthly ••t1ng of the Waste
ManagMent Task Force (Thursday, May 24) at which I proposal wtll be presented

concerning a grant application to the Office of Energy Conservation. There is
a strong possibility that the City of Englewood could receive a portion of
those funds for its pilot recycling progr111 now under consideration. She
shared additional Information with other members of the Task Force (Counc11
Members Habenicht, Clayton, and Hathaway).
(H) She shared information with City Manager Fraser concerning
the Sister City Program, explaining that Englewood and lake City are Sister
Cities. She was hopeful that the Information would help improve our relation-
ship with lake City. The Idea of the Sister City program ts to help make the
entire State of Colorado more economically viable.
(111) She proudly announced that In the June Issue of the National
Gengraphtc there ts coverage of Englewood's greenway, colTIIIIOnly referred to as
The Plaza and the Little Dry Creek Improvements.
(Iv) Mayor Van Dyke offered a resolution In support of youth pro•
gra■s In the City, explaining that at a previous meeting a resolution support-
Ing Teen Leisure Center had been tabled because some Council Members did not
feel they had sufficient lnfonnation to support the resolution. H0111ever, Ms.
Van Dyke felt adequate infonnation had now been provided. The resolution was
assigned a number and read in Its entirety by the City Clerk.
RESOLUTION NO. 45, SER!ES OF 1990
A RESOLUTION SUPPORTING YOUTH PROGRAMS.
NAVOR VAN DYKE MOVED, AND IT WAS SECONDED, TO APPROVE RESOLUTION NO. 46,
SERIES OF 1990.
Council Member Bullock stated that as I former member of the Board (Teen Lei-
sure Center, Inc .), he would be abstaining.
Council Member Clayton stated he would support Resolution No. 46, however, he
urged that recreation programs already offered by the schools and City be uti-
lized as auch as possible.
Mr. Bullock's reason for abstllning was discussed; Council Member Hath•wa,y
advised that she Is a current member of the Board (Teen Leisure Center, Inc.)
and did not feel It necessary to abstain. City Attorney DeWitt concurred it
was not necessary for her to abstain.
Council Member Habenicht stated that she would support Resolution No. 46 as it
is a very generic resolution in support of youth programs; however, she did
not want her support to be interpreted that she was giving support to any par-
ticular program or programs. She expressed concern about previously published
Information that Identified the Teen leisure Center, Inc. as being spOn$ored
and supported by the City of Englewood, and she wished to clarify that
~lsrepresentation.

Motion carried. Council Member Hathaway referred to Section 1 of Resolution
No. 47 which urges that citizens of Englewood contact their legislators (Sena-
tor Armstrong, Senator Wirth, and Representative Schaefer) expressing opposi-
tion to this proposal.
(111) Council llember Hathaway stated that in view of the progress
made by the Fire Services Delivery Task Force and in light of colllll8nts aade by
citizens representing the total community, she would like to offer a motion as
follows:

Mayor Van Oyke suggested that the rules be suspended to permit citizens to

Motion carried. The following citizens addressed Council:
(a) Ken Waechter, 3127 West Tufts Avenue, reminded Council of his long-
term tnvol ·,ement with this issue . He urged that extra staffing be accom -
plished to keep the Federal Fire Station open and both rescue units available;
he does not feel that responses from tho prlvJte ambulance services have been
satisfactory.
(b) Betty Newton, 3079 West Stanford Avenue, concurred with Hr. Waech-
ter's comments .
(c) Kathleen Eubank, 335S West Monmouth Avenue, stated her concerns
about the safety of the lives of the citizens In the Centennial area. She
explained her history as a citizen of this area had always made her feel a
part of Englewood, but recently it seems that the area Is no longer treated
like part of the conmunlty. She conrnented that if this continues, she would
support annexation to Littleton. Ms . Eubank was urged to attend and observe a
meeting of the Fire Service Delivery Task Force, which are held every other
Thursday In the Community Room at 6:45 p.m. It was explained that Council
will be weighing carefully the recommendations of the Task force In making it·r,
decision for what Is best for the Centennial area as well as for the rest l •f
the City.
(d) Bi 11 Melcher. 5088 South Hooker, asked how many t Imes do the
clt1zens of Centennial have to tell Englewood that they want the fire station
kept open.
(e) Tom Weems, 3034 West Tufts Avenue, stated the real Issue about the
way citizens of Centennial feel Is be.Ing tagged "the Federal Fire Station.•
What Is really being talked about, however, 1s total fire protect1on for the
City. He thinks the citizens are very interested In returning to full fire
protection. The citizens are asking Council to budget the f1re department to
protect the entire c1ty, staff It as necessary, and move on to other issues.

Council Member Clayton cor,~'!lented that it Is important to note that a repor.
from the Executivo Officer of Safety Services indicates that during the three
110nth period (Fetruary 2 through May 14) there were only nine occasions where
a private ambulance was used for transport. He believes the City still needs
to look at private ambulance service as an alternative.

Council Member Hathaway co111111ented that neither Districts II nor Ill has a fir,
station with1n their boundaries; part of the real Issue Is to start looking at
thts as 1 •city proble11, not Centennial 's probltll versus the rest of the
city.• She explained that the reason the Fire Service Delivery Task Force was
created was to look at the Issue from that perspective.
Council Me11ber Bullock stressed to the citizens that he shared their concerns,
further that he intends to put a lot of weight on the recollllM!ndations of the
Fire Services Delivery Task Force. He encouraged the citizens to be in touch
with the Fire Services Delivery Task Force to make their voices heard.
Council Member Habenicht stated she was pleased that Council Member Hathaway
had changed her previous position and had offered a substitute motion; she
felt the Fire Service Delivery Connittee should be given enough time to
thuroughly research the situation.

(iv) A resolution concerning the establishment of a City Council
Policy Procedure was considered. Council Member Clayton, who served as chair-
man of the Council Po11cy Subconmittee, advised that the connittee has been
working for some time to develop a method for the adoption of Council philoso-
phy for policy procedures. The resolution was assigned a number and read by

Council Healber Bullock stated the resolution lacked "backbone• as there was no
accountability required. He noted at the Town Meeting citizens had expressed
anger at spending 1110ney to send council members to conventions and ineetlngs.

Lengthy discussion ensued regarding publication procedure, expense, etc .
Council Me11ber Van Dyke suggested publishing the notice of proposed travel
expenditures 1n the Citizen Instead of the Sentinel ; It's mailed to every ad -
dress in the City of Englewood and It "doesn't cost any extra money.•
Council Member Hathaway felt further clarification was needed.

The motion died for lack of a second.
Further discussion ensued.
Council Ne11ber Koltay felt it would be sufficient to simply publish City Coun-
cil's expenditure report from "t1me to time.•
Council He11ber Bullock stated he appreciated Hr . Koltay's conment, but felt it
would "dilute" the amendtnent.
Council Member Wiggins stated he has never seen a travel request turned down.
He expressed hts frustration over the lack of accountab111ty.
Mayor Van Dyke stated In 1980 the travel budget was $12,000; they spent 1110re
than that. Last year City Council spent $5,000.
Council Member Bullock called for the question .
Council Member Habenicht expressed concern over the wording; she felt the pro-
cess would prove to be too "cumbersome.• She also felt certain Issues should
be clarified.

Mayor ¥an Dyke noted that rumor has it ttu1.t al 1 counc11 members wtl 1 be
traveling to Canada . She stated "emphatically that that is not true.• Ms.
Yan Dyke explained she ts a member .:if the Governor's lntegratld Solid Waste
Management Task Force and has expended "ti11e , effort, and expense " In an at -
tempt to develop an Integrated solid waste program in the City of Englewood .
She stated economic development and solid waste management were her major con -
cerns. She felt the projected expense of less than $1,000, to attend the
Intern ational Integrated Waste Management Conference being held in Canada this
month, ts just i fied.
Counc11 Member Habenicht ag r eed that Council should be accountable to the
public for all expenditures. However, she disagreed with Council Member Bull ·
ock 's position that travel ts a "perk " and that she would not participate In
an y travel as a "perk ." She noted Council has cut travel In half In an effort
to economize . Ms . Habenicht stated she felt the Informat i on gathered from
attending conferences has been very valuable .

6bvi(l) -Counc i l Member Hathaway presented awards and plaques to
winners of the Earth Day "Every Day Trash to Treasure " contest. Present were
the Tabatha Maher, the first place practical winner; and Jllffl\Y Hiltz, the
second pl ace creative winner . Tabitha also rece i ved a S50 check for her entry
and both were presented with letters from Governor ROl!ler and Congress1111n
Schaefer . Tabatha and Jilllll,Y expla i ned their creations and were given a round
of app l ause. Other winners who were not present were Shelia Martinez, first
place creative, and Gladys Meredith, second place practical.

6bv11(l) -Council Member Wiggins requested that the Uti11t1es De-
partment Investigate a situation existing w1th "old meters" In the Industrial
area of the City. Mr. Wiggins stated It had been reported to hlm that some of
the meters were Inoperable a"d therefore costing the City loss of revenue.
6bvl1(2) -Council Member Wiggins asked that 1110re effort be made to
give advance warn ·I ng when the Uti lit I es Department undertakes flush Ing of the
hydrants. He suggested that the warning be published 1n the Sentinel.
6bv11 (3) -Council Member Wiggins provided Information on the re-
pairs done to the train track and trestle at Belleview Park. He also ex-
plained the need for additional repair work to the other trestle, which will
necessitate approval of additional funds. He announced the Lions Club Train
was ready to co11111ence its su11111er runs on Saturday, Hay 26th.
6bvlil -Council Member Habenicht complimented Council Member Clay-
ton for his efforts to amend CML Policy with regard to recycling.
6bix(l) -Council Member Clayton further explained that he had been
successful In having the CML Policy Manual "Environmental Quality• amended by
adding the phrase, •to support munic i pal and intergovernmental agreements In -
cluding programs for purchasing recycled products.•
6blx(2) -Council Me11ber Clayton, referring to other CML actlv1-
tl11s, suggested that Assistant City Manager Hartin be instructed to follow tha
l n:tiat1ve being proposed by th0 National Federation of Independent Businesses
r'1garding taxes. He felt the tax proposal If approved would seriously limit
Englewood's ability as a home rule city to collect a number of small tues
whi ch we now collect.

(a) Bill Hamilton, representing the Englewood Lions Club, briefly ex-
plained there were additional re p lrs needed on the trestle In Belleview Park,
rpec1f1ca1 l y to Include solid decking and repairs to the banisters . He stated
that the work would cost approximately Sl,600 in addition to the funds pre-
viously appropriated by Council .

OF $1,600 FOR ADDITIONAL WORK IN BELLEVIEW PARK, Council Member Wiggins ex -
plained that If the repairs cost more than the estimated $1,600, the Englewood
Lions Club will pay the difference.
(b) Jason Densmer, 1290 East Dartmouth, representing Boy Scout Troop
No. 92, requested permission of the City Council to use Centennial Park Lake
for water training purposes. He assured Council that all Scouts would be re-
quired to wear life jackets during their training and to follow all prescribed
canoeing safety rules.

(c) Gary Kozacek, 1260 West Oxford Avenue, thanked Council for passing
Resolution No . 46, even though 1t was In a •generic" form. Mr. Kozacek re-
ferred to Council Member Habenicht 's corrment concerning prev i ously published
Information Indicat i ng the Teen Leisure Center, Inc. was being sponsored and
supported by the City of Englewood . He stated they have no i dea who sent the
press release to the RockY Mountain News. Mr. Kozacek noted they are seeking
the City's cooperation In an effort to coordinate their youth project with
various City departments .

12. Ordinances, Resolutions Jnd Notions
(1) City Manager Fraser presented a reconmendation to adopt a bill for
an ordinance amending the Englewood Municipal Code to reflect the changes that
have taken plate within the City's organizational structure. Hr . Fraser fur-
ther explained that these changes had reduced the nulllber of Directors from ten
to seven and also had consolidated manning throughout the City. Ha reco-n-
ded approval. Mr. Fraser responded to various questions ~oncerning the con-
solidation, the Inclusion of the section referring to the Volunteer Fire De-
partment, pension funds, and cost savings.

Council Member Habenicht explained that she has difficulties with two aspects

She understood the arrangement has been very successful In larger cities, but
not particularly •appropriate " in smaller cities. She stated she hasn't been
convinced this is the best organization for the City of E~glewood.
Council Member Bullock felt the City Manager should be 'given free reign to
run the ship In the way that he'd like to run it until it's shown to our det-

Survey Joint Funding Agree11111nt for the operation and maintenance of a stream
flow gauging station on the South Platte River at Union Avenue . Hr. Fonda
explained that th1s is a continuation of an agreement approved by Council last
year . The cost to the City 1s S3,050 representing one-hllf of the total
costs .

tem Maintenance Agreement with Sher idan . Under the proposed agreement, Engle-
wood would provide maintenance for a portion of a sewer line in Sheridan's
Santa Fe Industrial Park . Mr. Fonda explained Sheridan wil l pay a surcharge
for the use of Englewood's flushing truck . The agreement can be voided wit h
six months notice.
Discussion ensued regarding surcharge rates.

(d) Director Waggoner presented a racoirmendatton from the Public Works
Departaent to approve by motion the replacement of the Servicenter fuel tanks.
Solle upgrad i ng of the service 11nes and associated equ1p111ent was approved
during the 1990 budget process, but not tank replacement. He explained that
the fuel storage tanks at the Servicenter are 19 years old and the associated
piping system is very badly corroded and leaking. The installation would
bring the storage tanks and associated piping into compliance with all of the
new regulations on underground storage tanks.
Council Member Koltay quest i oned the advisab111ty of privatizing fuel
acquisilion.
Council Member Clayton questioned wh ich city vehicles use the pulll)s and how
much they are charged.
City Manager Fraser stated he had requested the purchasing staff evaluate the
alternatives In terms of contract i ng for these serv i ces as opposed t o replac-
ing the tanks . The estimated cost varied between z~i and 33i more for us to
do this service outside of the service facility. When that cost is added to
the inconvenience and difficulty of dealing with other service providers it
would not be cost effective or practical.
Council Member Hathaway questioned the liability on the tanks if new regula -
tions are put Into effect .
City Manag e. !"raser noted if they change the regulations to something other
than what Is applicable today the City would be responsible.
Council Member Hathaway stated that in the last two years the State l egisla-
ture has reviewed regulations for underground storage tanks. They have not
passed, but in the future they might.

3. City Manager's Report
(a) City Manager Fraser transmitted copies of two letters received pro-
testing the usessments for Paving District No . 33. He reminded Council of
the Public Hearing scheduled for May 31, 1990 at 7:30 p .111. concerning the
Paving District No . 33 assessments .
(b) City Manager Fraser provided Information concerning the upco•ing
Fourth of July celebration. He advised Council of the cooperative efforts of
the group working on this project . He Informed Council that a letter equest-
ing donations will be mailed this week to some of the larger busine sses 1n
Englewood . He also advised Council that Cherry Hills Village and Greenwood
Village have both indicatect a willingness to join us in this effort; Sheridan,
Li ttleton, and South Suburban have all c011111itted to participate.
(c) City Manager Fraser advised Council that the collective bargaining
process had commenced; he requested that, after conclusion of the regular ses-
sion, Council adjourn to Executive Session for a briefing.

City of Littleton on the Lowry Insurance Litigation. The Littleton City At-
torney has proposed the sharing of a data base . At the present time the ini-
tial indications are tnat this i s quite expensive; we've declined to partici-
pate to date. Hr. DeWitt stated he is asking the Littleton City Attorney for
documentation in order to establish some benchmarks for proceeding.
