The Pledge of Allegiance was led by Mayor Van Dyke. Roll was called. Present: Absent : Council Members Koltay, Wiggins , Clayton, Habenicht, Van Dyke Council Members Hathaway, Bullock Note -Council Member Hathaway entered the tneetln\J at 7:29 p.m. A quorum was present. Mayor Van Dyke announced the purpose of the hearing was to provide an opportunity for ci tizens who have been assessed for improvements made within Paving District No . 33, to speak to Council about their concerns. She explained that prior to receiving citizen input , staff would be making a presentation relative to assessment data. Ms. Van Dyke stated that City Englnee~ Ragland would co11111ence the staff presentation . All staff members and citizens testifying during the hearing were duly sworn by the Deputy City Clerk. City Engineer Ragland gave background lnfo;-mat1on concerning Paving District No. 33, which was created by ordinance on November 21, 1988 to provide for the reconstruction of 21 blocks of streets In the City of Englewood. She expla i ned the final assessment data and the costs of the paving district. Costs which are assessable to the homeowner total $441,606.84. The costs to be borne by the City total $424,735.50 . She Informed Council that the interest rate on the bonds to be charged on the assessable costs was 7.5~. -1 - Ms. Ragland stated that 308 property owners were advised of this Public Hearing by registered mail; 299 were received; seven letters were unclaimed; and two were un deliverable. In addition the Englewood Sentinel published notice of this Public Hearing three consecutive weeks as required; proof of publication was entered into the record . Ms. Ragland stated the final reading of the ordinance assessing costs will be considered on Monday, Ju l y 2, 1990, and If approved the ordinance will go into effect Friday, August 3, 1990. The 5lll discount for payment of assessments prior to August 3, 1990 was explained. She noted there Is a Deferral Assessment Program which ts available to quallft~d ~t tlzens. Office Engineer Kahm, also the Project Engineer for Paving District No. 33, advised Cou11c1l there will be an amendment to the Council 8111 to be considered on Monday, June 18, 1990. Mr Kahm stated property owned by the Englewood Housing Authority had been assessed, and they had just been advised that according to State Statute the Housing Authority property Is exempt from assessments for paving districts. Mr. Kahm discussed the discovery of hazardous materia l on West Wesley; the Ctty ts working with the State Health Department on the clean -up. He explained In detail the computation of assessments for the various work done within the District and provided the breakdown of untt prices In the project. Mr. Kahm explained the various methods of payment. He Introduced Rcyce Smith, a local Rea l Estate Broker and Appraiser, and noted Mr. Royce would be addressing the specif i c benefits of the completed pavtng district for the property owners. Royce Smith stated he has been In real estate 22 years and involved In seven of the City of Englewood paving districts. He has i nspected the properties prior to the paving district and after to d~termlne if there has been a significant improvement in property value. He noted he ts considered an expert appraiser In every County Court tn the State and has served t · an Urban Renewal Authority Conmlsstoner. Mayor Yan Dyke invited concerned property owners to address Council relative to their assess111ents. Tony 8aca , 8420 Dawson Drive (property at 2030 West Warren), questioned whether Public Serv i ~e had pa i d for the removal of the telephone polls. He was assured they had. Judy Covert, 3073 South Fraser Street (property at 3551 South Bannock), questioned why the paving district costs were not taken out of property taxes. City Engineer Ragland reviewed the history of paving districts and also advised Ms. Covert that the property owner, by city ordinance, is r ~sponstble for the concrete, sidewalk, curb and gutter. Ms . Rag l and noted that onca a street has been In a paving district the City assumes responsibility for ma i ntenance which Includes patching and sealing. Ms. Ragland reviewed the various methods of payments . Arlene Erickson, 4097 South Bannock (property under the name of Arlene Frazier), questioned whether the paving distri ct Included the sidewalks as well as the streets. She was assured that tt covered boti,. Ms . Erickson requested more Information on the Deferral Program. City Engineer Ragland advised Ms. Erickson to contact Dave Henderson, Public Works Depart111ent , to -2 - obtain an application, and Janet Grlffllllett, Housing Authority, would assist her in filling out the form. Ms. Ragland noted the deadline to sublntt the application is September 4, 1990. Robert L. Mestas, 3371 South Clay Street, stated he owned the property at West Hillside and Zuni (the corner lot). There Is no address as It Is a vacant lot. Hr. Mestas que,tloned the amoant of the assessment as there is no house on the lot. City Engineer Ragland explained that the assessment was based on lot size. The Mayor offered to have the Department of Public Works do a recalculation of the assessment . Mr. Mestas was agreeable to that. Discussion ensued . Lawrence A. Blazer, Blazer Auto, 371B South Broadway, questioned why he was paying for paving on East Kenyon. Office Engineer Kahm advised Hr. Blazer that he had 100 foot of frontage. Discussion ensued. Hr. Blazer requested a recalculation of his assessment. Mr. Kah■ agreed to verify the figures. Council Member Habenicht ask ~d that the Department of Public Works follow-up on the concern expressed at a previous City Council Meeting from Gary Kozacek on behalf of Hr. Binetti. The following letters were Identified as having been received In protest to the assessments: 1. Letter fr011 D. Williams, 3766 South Bannock (street Improvements In the 3700 block of South Bannock Street). 2. Letter from Patricia Rich, 2561 East Floyd Avenue (street improvements In the 1800 block of West Wesley). The letters were received Into the official record of the Public Hearing. Mayor Van Dyke asked if there were any other persons present who wished to address Council regarding the assessnents under Paving District No. 33 . No one came forward. Council Member Habenicht asked when the original estimates were made and when the property owners were apprised of the cost. Office Engineer Kahm stated the original construction estimating was done in the 'late sunrner of 1988 and the property owners were notified in the early fall of 1988. COUNCIL NENBER KOLTAY MOVED, AND IT WAS SECONDED, TO CLOSE THE PUBLIC HEARING, Ayes: Nays: Absent: Council Members Koltay, Hathaway, Wiggins, Clayton, Habenicht , Van Dyke None Council Member Bullock The Mayor declared the motion carried and the Public Hearing closed. Mayor Van Dyke advised the citizens that staff woula be responding to their concerns and would also follow-up on the two letters of protest. -3 - 3.
