(1} Mayor I.Ian Dyke shared that the City of Eng l ewoc,d ts cur-
rently app l ying for an Off i ce of Energy Conservation Grant of 1pproxt111at1l y
$200,000 to Implement a pilot program In Inte grated solid waste management.
She hopes the City will be successful 1n rece1v ,ng those funds and, if so, the
c1t1zens of Englewood can expect to see some type of project tmplenented
within the next stx months .

Director Wanush provided background information concerning the proposed amend-
11ent to the existing hous i ng code of the City. He expla i ned thts would reduce
the requirement of all ceiling heights 1n habitable rooms located 1n basement
areas, from 7' to 6'8" 1n previously constructed homes .
Upon questioning, Ctty Attorney DeWitt stated the document did not appear con-
tradictory , that the provisions found in the operative part of the ordinance
are safety issues. Director Wanush agreed.

(2) Counc i l Hember Koltay requested that the Code Enforcement
Divis i on be advised to check for code violations on the property owned by the
City, t.e., Quincy Ftre Statton . Mr. Koltay has received numerous complaints
about the property. He requested the property be cleaned up ; and tn addit i on,
he suggested that possible uses for the bu il ding be considered or that tt be
marketed.

support. Ms. Haben1cht informed Council that if elected, no out-of-state
travel is involved . Concerning the Colorado Municipal league confere .~ce,
there was di scuss1on about Ms. Habenicht' s overn1ght expenses for her pa;·-
t1c1pat 1on as President of Women In Mun1cipal Government. Ms. Habenicht ex-
plained the need for her overnight stay, but assured Council that 1f alterna-
tives d1d not work out, she would stand the expense herself. Delaying a vote
on this matter was suggested; it was explained that to delay the vote to June
18th wo1.1ld jeop1rdize registration. Council Hember Hathaway called for the

four City of Englewood employees for their outstanding contributions to the
operations of the City. City Hanager Fraser intr oduced the four Employees of
the Month -David Knight (Malley Center); Hahendra Patel (Bl-City Wastewater
Plant); Carolyn Leibner, {Switchboard Operator/Finance Department); and Eric
"Rick " G1ezen (Public Works/Parks).

Council Member Habenicht explained she had withdrawn the item fl'OII the Consent
Ag1nda for further discussion; she suggested It be continued until November to
allow the City Manager time to present a comprehensive report evaluating the
organizational changes. She expressed concerns about the financial i111p1cts
these changes may have had at the 11td-mana9ement level; about organizational
1110r1:1e; and the 1v11labtltty of an administrative personnel employment pool
with cross education and training . She also wishes to see a review of the
experiences of munictpal1t1es of comparable size and scope that have tried
this organization. She did not feel that delaying this action would interrupt
or interfere with the C1ty 's operation.

Upon quest1on1ng, Mr. Fraser confirmed for Council Member Koltay that no fur-
ther changes were anticipated between now and November. Mr. Fraser also ad-
vised Council that the bas lcs of the reorganizat 1on generated a savings of
app :·oximately $200,000 and had been docull!tnted to Council 1n various
11aterlals. This was reflected in the adoption of the 1990 budget in which
several positions which previously existed in the administration where either
changed in a downgrading or were eliminated.
Council Member Hathaway c011111ented that it ts time to realize who manages the
City and that certain managers require a degree of f lexibility. She too was
skeptical about the combination of Ltbrary and Recreation, as well as Police
and Fire; however, daring the past year and a half nothing has indicated to
her that the changes were inappropriate. She feels that the reorganization
has produced cost savings and also personnel effectiveness
Council Member Habenicht responded to Mr . Fraser's conments, stating she is
aware of the report reflecting the $200,000 savings as I result of reducing
the top administrative posit i ons from ten to seven; however, she has not seen
a report that indicates what the impacts of the reorganization have been to
the mid-management level. She added that she feels Council has given its ap-
proval to this reorganization on a tentative basis, and that to postpone for-
mal action until that information Is rece i ved and reviewed, makes sense. She
responded to Council Member Hathaway stating she felt th1s was a policy deci-
ston or it would not be coming to Council . She feels policy decision needs
full review and an evaluation of the reorgan1zat1on would provide that.
Council Member Clayton offered that this reorganization was made with input
from Council and Initiated by Mr. Fraser. Council had indicated they wanted
the City Man ager to make effective, efficient changes, 11,d Hr. Clayton feels
this reorganization has accomplished that. He urged approval of Ordinance No.
18 to recognize Mr. Fraser's administrative decision In th i s regard.

Council Member Hathaway added that she did not naad an evaluation or addition-
al Information to approve this.
Council Haber Wiggins agreed with Hs. Habenicht, stating he would like to see
a report as to where our savings are In mid -management; however, he did not
feel that approval of Ordinance No. 18 would confine future Councils and/or
City Managers. He complimented Hr. Fraser on his efficient managenient but did
state he would like more Information on the mid-management level.
Hr. Fraser stated that 1t was 1n February 1989 when he first made the initial
recomendations concerning the reorganization. After tentative approval was
received, Hr . Fraser waited for approximately 12 months before providing Coun-
cil with a lengthy evaluation which Included con,ents from staff working In
the organization as well as comments from his perspective on how 1t was work -
In~. He agreed this ordinance does not Impact directly the m1d-11an1ge111ent
structure; however, he indicated there Is latitude within It to deal with that
level. He assured Council that every effort Is being made to mlnlniize the
amount of money dedicated to paying salaries of administrative staff. He en-
couraged Council to approve this ordinance as a reflection of their belief in
him as well as Counci l's belief in his staff.

that she does not have confidence tn Mr . Fraser and staff . She stated there
are sttl l a number of questions she has been asking for wlrlch she has not
received a clear answer; she prefers to make a dectston after all the informa-
tion ts presented, not before.
Mayor Van Oyke assured Hs. Habenicht that Council continually has the oppor-
tunity to evaluate the administrative process and that the budget retreat in
September will also provide an additional opportunity.
11 . Public Hearing
Mayor Van Dyke announced there would be a public hearing for consideration and
second reading of the bills amending various sections of the Englewood
Municipal Code regarding building and safety codes .

DlrectDr Wanush, duly sworn, presented recorrmandatlons from the Dep1rtnKtnt of
C011111unity Development. He expla i ned that six secti ons of the Code are being
revised and readopted by reference with certain exceptions, specifical l y the
1988 Edition of the Building Code and the Uniform Build i ng Standa rds; the 1988
edition of the Unifom Mechanical Code ; the 1988 Un1fonn Plumbing Code; the
1990 Edition of the National Electrical Code; the 1988 Edition of the UnifDrm
Fire Code and the 1988 Edition of the Uniform Fire Code Standards; and the
19B8 Edit1on of the Uniform Code for the Ab1te111ent of Dangerb~S Buildings.
These codes al l relate to new construction within the City of Englewood . The
codes are admini .. tered by the Code Administrative Office and the Ch1ef Build-
ing Inspector, structural inspectors, electric11l inspectors, mec hanical and
plumbing inspectors . He explained that these codes are devised by The Inter-
national Conference of Building Offici11ls; the codes are revised by committee
eve r y three years . Several local changes to the various codes have been made
reflecting the more spec i fic way the City administers the Code as opposed to
the more generic way. There are other recoll'llllndatlons relating to sprinkler
systems in mid-rise buildings, etc. Director Wanush reconmended passage of
these codes ; he advised Council that Code Administrator Groditski and Chief
Bu i lding Inspector Baker were present should Council have specific questions.
There were no questions posed . Mayor Van Dyke asked if anyone was present in
the audience who wished to speak concerning this matter; no one came forward .

(f) Director Waggoner presented a reco1111111nd1t1on fr011 the Depart111ent of
Public Works to adopt a resolution approving an agreement with the Denver and
Rio Grande Western Railroad Company and the Atchison, Topeka, and Santa Fe
Railway Company for maintena nce of the railroad grade separation for Dartmouth
at Santa Fe. Mr. Waggoner explained that this agreement would render the City
liable for any repair work below the main structure and the portion above the
main structui-e, including waterproofing, would be the responsib11ity of the
railroad companies. Hr . Waggoner recommended •~•proval of the resolution, com-
menting that In his opinion this was a good agreement and better than those In
force in other metropolitan municipal1ties . He exoh1ned the bridge was
designed for a 50-year life with a 1987 valuation of $2,000,000. Replacement
cost implications and the City's obligations were discussed.

Hr. Fraser, Hr . Waggoner and staff were complimented on their efforts on be-

Council Ne11ber Koltay suggested that a separate fund be established for 1n-
frastruct ~:r e repa1 rs to the bridge, cons i dering the unknown l hbil ity for
proper ma •,,tenance . Hr. Fraser oxplained thet t he 1991 budget will include a
long-•r1nge capital plan which will address Hr . Koltay' s concern.
Council Member Habenicht requested a legal opinion from the City Attorney
about the agreement. Hr. DeWitt responded that the agreement has been nego-
tiated between the City and the railroads; Pxtenslve efforts ha~e been 111de to
reach the agreement and Hr. DeWitt stated It is a "fair deal for both sides."

recommendation from the Bl-City Superv i sory Coirmittee to approve by motion the
purchase of one pol)'lller preparation system from Fluid Equipment Corporation.
Mr. Fonda conmended Dennis Stowe and members of the Wastewater Treatment Plant
staff for their efforts In finding the polymer system which best meets the
City's need. He fully explained the method, which has been tested In a pilot
system ; 1ts use was also discussed . He estimates there will be at least a 251
savings. Funds In the amount of $140,000 were budgeted In the 1990 approved
budget; however, the bid received from Fluid Equipt1111nt Corporation was
$122,330 . The Bl -C1 ty Supervisory Co11111l ttee recommends approval of the pur -
chase. Mr. Fonda verified that this system would be compatible with the pro -
posed 110di f1 cat 1 ons to the plant; however, he sta.ted that it would not have
1ny effect upon the odor problem.

(a) City Attorney DeWitt provided lnfonutlon Lwr.c11 rning a bill for an
ordinance ame nding sections of the Englewood Municipal t:,ae which would regu-
late skateboards, roller skates , roller blades, and roller i kls on private and
public property in the City. Mr. DeWitt stated this ordinance would allow
individual property owners to prohibit this activity on private property and
would provide penalties. He advised Council that currently the City 1s
rtcalvlng numerous complaints, and he stated the proposed legislation would
110re appropriately apply to those complaints.

Council Member Koltay stated he feels this information Is a critical part of a
d1ten1inatlon of whether or not a residency requlre11ent should be established.
He also felt the tnfonnatlon would be beneficial to Council.
Council Member Clayton pointed out that the Colorado SuprelN Court recently
ruled that prejudice to hiring residents ts legal and has a number of recog-
nizable distinct benefits; his concern centered on whether or not the report-
Ing requirements would be burdensome to staff or adversely affect the budget.
