Pre-scheduled Visitors Englewood C1ty Council M1nutes October 15, 1990 -Page 2 (a) Ron Beck, President of Englewood Police Benefit Association, speak- ing on behalf of the unifonn personnel and the non-uniform personnel, present- ed information concerning the proposed scheduling changes in the Police Divi- sion, Safety Services. He enumerated the concerns of the employees, and he countered some of the data which had bee~ ~rovided Council on this issue. He strongly urged that Council direct thP. City Manager to advise the Director of Safety Services not to institute the proposed change in shifts, Hayor Van Dyke informed Officer Beck that this is not a Council issue, but rather an administrative issue. She stated that the information Officer Beck offered provides Council with additional Insights . After additional discussion, It was suggested that Council might wish to review this matter further. (b) Michael Lindsay, 1429 Cook Street, Denver, a psychologist with Abu- sive Hen Exploring New Directions, shared his concerns about the domestic vio- lence program being shifted from Hunic1pal Court to Arapahoe County Court In 1991. He stressed the need for speedy resolution of domestic violence cases, explaining that delays are inevitable when the cases are filed in County Court . He enumerated what the consequences might be to the victims if the switch to County Court is effected. When the cases go to trial, because of economic crl ses and fi sea lly-dri ven programs, they are often pushed through and plea bargained down. Mr. Lindsay warned the end result will be "the death of someone in your co11111unity". He urged that Council consider the ramifica- tions of moving the cases to the County Court. He suggested Council work with the Community Task Force, which ~rates In Arapahoe County in conjunction with the Criminal Justice System Council Member Bullock countered many of the co11111ents made by Mr. Lindsay, stating he could not distinguish a "qualita- tive" difference between the two courts. Additionally, Mr. Bullock stated there is high duplication of efforts resulting in Englewood citizens paying tax for services provided at both levels, that the cost ($25,000) does not reflect other costs indirectly incurred by the City. Hr . Lindsay agreed the program is expensive, and he concluded by stating the last twr homicides he reviewed involved harassment charges. 7. No.,-scheduled Visitors (a) ~orma Wier, 4870 South Cherokee, stated she has been a member of the Victims Assistance Program for two years and her son had been killed because of a domestic violence related i ncident . Ms . Wier stated she Is disappointed with Council's decision to move domestic violence from Municipal Court to County Court . She stated the program has four volunteers on call twenty-four hours a day who can work with the victims within five to twenty 0 minutes of their t ragedies. She emphasized the program can help protect our officers and cut down on the number of repeat offenders. Ms . Wier noted t he program operates on "virtually nothing " and she requested an opportunity at a Counc il study session to show Council more about this program in the hope Council would reconsider Its decision. C~uncil Member Clayton noted the Victims Assistance Program had not been eliminated and it was Council's intention to continue the Victims Assistance Program In any event. Ms. Wier noted the problems the volunteers will incur by mov i ng th1s to County Co urt - extra trave l time, the resultant danger to the victim and the volunteer when Englewood City Council "inutes October 15, 1990 -Page 3 the perpetrator is not l11111edlately sent to jail, etc. Council M11111ber BullocK debated some of the connents made by Ms. Wier. Council Member :fathaway pointed out the possible danger to the volunteers as well as the victims, due to the di fferences in bonding procedures of the County versus tne City. Ms. Hathaway explained the Importance of the victim dealing with th4 situation as soon as possible to eliminate the time In which the perpetrator can pers uade the victim to drop charges. Discussion ensued regarding the time frame involved in cases handled at County Court versus Municipal Court level. (b) Barbara Findlay , 4540 South Kalamath, po i nted out the importance of dealing with domestic violence cases i11111edlately, based on her personal experiences. Ms. Findlay expressed appreciation for the support she had received from Susan McDonne l l and Carol Hartung. (c) Judy Smith, 1888 South Jackson, Denver, stated she works in Englewood , has been a volunteer with EVAC for almost four years, and previous to that she worked with the County . She disagreed with Council Member Bullock's content i on that everything can be handled comparably at the County level . Ms. Smith stated the County domestic assistance volunteers respond to the victim by telephone . She stressed the importance of talking to the victim "eye to eye" instead of discussing the matter over the phone . Ms. Smith stated the Englewood Victim Assistance volunteers remain with the victim the whole way and do not need to change jurisdictions in mid-stream. Council Member Habenicht conrnented there seems to be a lot more to this Issue than "statistics and dollars" and requested time be set aside by Council to study and debate this issue prior to November 5, 1990. (d) Pam Pakmis, 3600 South Pearl, stated she has worked professionally in a battered women's shelter, and has been a victim of spouse abuse. She stated the stress normally associated with domestic violence situations is magnified by the lack of a phone, car, et c., a situat \on with which the victim may have to cope. She stressed the importance of the victim being able to walk to the police department and court. (e) Chris Rotello, a former resident of Engl~wood, advised Council of the time frame involved in pursuing hr • case thr~ugh County Court, pointing out there was a time lag from 1986 (first court appearance) to 1988 (conviction). She stressed the Importance of the perpetrator being given real consequences for his action, explaining that, in her own situation the first two t im es in County Court the perpetrator, with convict i ons, had no consequence in sentencing, so her family continued t~ experience abuse; however, in a later conviction the perpetrator served time and received treatment, and now her family no longer deals with phys i cal abuse. (f) Nancy Lantz, 8000 East Prentice, stated she has worked five and a half years with male perpetrators, and she has worked with the Aurora Police Department . She stressed the importance of getting the perpetrator Into treatment as soo n as poss i ble. Ms. Lantz stated that the longer it takes to get perpetrators into treatment, the harder it is to break the denial . In her experience a person may be involved in three or fov-repeat incidents before the case is heard i n County Court. Englewood City Council Minutes October 15, 1990 • Page 4 8. Council Member Haben i cht stated she had been informed by a citizen of the Cen- tennial area of a memo which had been posted at the Fire Department which in- dicated the City would respond to a call outside the Englewood city limits In conjunction with any mutual or automatic aid agreements even If only one unit was available. Executive Officer Olson, Safety Services, acknowledged the memo, but stated it was an internal memo, not a general order and not one which 1s being followed. He explained the memo had been written when only three stations were in operation as an interim solution . When the Federa l station again became operational the memo was no longer In effect. He men- tioned the new agreements would cover this s i tuation. Council Member Habenicht posed the question of whether the City of Englewood would respond to calls, between now and when the new agreements become effec- tive, leaving the citizens of Englewood without fire fighting and paramedic ass1stance. Hr. Olson responded that they would not, that generally there is at least one unit available within the city limits. He noted the Tejon sta- tion Is not conrnitted to auto~atic aid at this time. Mr . Olson further point- ed out that at the present time paramedic assistance is not part of the agreement. Council Member Habenicht stated she Is very supportive of mutual and automatic aid and governmental cooperations whenever possible; however, she feels we need to protect our own interest and ensure that all the agreements are con- sistent, and she is uncomfortable approving the agreement. City Attorney DeWitt requested that Mr. Olson explain the "call-up" procedure which may answer Ms. Habenicht's concern. Mr. Olson explained it is a stan- dard procedure where the City would request assistance from another jurisdic- tion to actually move its equipment Into one of our stations to cover calls when all of our equipment Is on response . Mr. Olson also offered an explana- tion on the difference between automatic aid and mutual aid. In response t o a question posed by Council Member Koltay, Hr . Olson stated he would feel uncomfortable denying another jurisdiction assistance tn the event of a major fire even if it would leave the City without its own protect i on. He pointed out that there are 17 jurisdictions Involved and in the case of a majo r f ire, departments are calling to offer their assistance. With this additional information, Council Mefflber Habenicht stated her co ncerns had been addressed. However, she requested staff to provide Councl~ with a policy statement outlining the procedures they follow in an emergency ~ 1tuat ion. Ordinances, Resolutions and Notions (a) Directo r Fonda presented a recommenct.i.tion from the Water and Sewer Board to adopt a bill for an ordinance approv i ng an agreement between Engle- wood, Thornton, and Westminster regarding the Standley Lake Water Rights . Mr . Fonda provided bac kground informat i on relat i ve to this matter informing Coun- c11 that the attorneys for both cit i es are i n agreement and that the matter will be presented to Thornton and Westminster City Councils prior to November 1st. Hr. Fon•fa explain ed the advantages for Englewood and st'l1.~d. if approved by all three c i ties , a lot of litigation will be avoided . Council Member Haben i cht added that the Water and Sewer Board ""': s tudied this Issue in depth and are in favor of the proposed Counc i l Bill. (c) Director Stanley presented a reconrnendatlon from the Depart111tnt of Safety Services to adopt a bill for an ordinance approv i ng the contract between the Englewood Department of Safety Services and the Colorado Depart- ment of Highways , Di vision of Highway Safety for Law Enforcement Assistance Funds (LEAF). This federal grant funding wou l d allow the Safety Services Police Div i slon to incr11se and t111prove the enforcement of alcohol ind drug related traffi c offenses wltti1n the City. The grant ts for S25,000 and the funds will basical l y be used for overtime for additional patrols for the night shift and to defray overtime costs for court appearances. City Attorney DeWitt concurred. Council Member Koltay explained hi s "n ay• vote, cornnent 1ng he would have preferred to have the matter discussed with Senator Owens, Senator Considine, and Representative Kaufmann before Council took a position concern- ing Amendment No . 1. (if) Council Member Wiggins proposed a resolution concerning the mill levy tax being proposed by the School Board . The resolution was assigned a number and read by title: RESOLUTION NO. 84, SER I ES OF 1990 A RESOLUTION SUPPORTING THE 1990 ENGLEWOOD SCHOOLS HILL LEVY ELECTION. COUHCIL ME"BER WIGGINS MOVED, AND IT WAS SECONDED, TO APPROVE RESOLUTION NO, 84, SERIES OF 1990, Council Member Clayton expressed in his opinion it Is inappropriate for City Council to pass a resolution concerning the school board mill levy, even though he was personally in favor of the mill levy increase proposed by the School Board. Englewood City Council "lnutes October 15, 1990 -Page g Council Member Habenicht stated she feels it is appropriate, that historically the City and the School Board have supported each other, c i ting the Urban Re- newal projects . Council Member Hathaway concurred with Mr. Clayton that it is inapproprtata and would set a precedence for similar action for the other school districts located wi thin the city l i mits of Englewood. Council Member Clayton advised he would be abstain i ng as he feels he has a financial interest in the outcome of ttie election as a property taxpayer to the School District. Council Members Koltay, Wiggins, Bullock, Habenicht Council Members Hathaway, Van Dyke Council Member Clayton (11 1) With reference to the bookmobile and fire services , Council Member Bullock stressed the need to keep the various citizens' cormnittees and advisory boards apprised of interim steps and/or decisions relating to budget matters about which those comm i ttees have made reconnendations t o Council. (iv) Council Member Clayton requested that a letter be sent to the School Board for its meet i ng Tuesday, October 16, setting forth the City's position on the issue of the Union Avenue/Tufts Avenue/Santa Fe Drive intersection . COUNCIL MEMBER CLAYTON NOVEO, AND IT VAS SECOlllED, THAT A LETTER SITTING FORTH THE CITY'S POSITION CONCERNING UNION AVEMIE/TUFTS AVEIIIE/SANTA FE DRIVE BE DELIVERED TO THE SCHOOL BOARD FOR ITS MEETING ON OCTOBER 16, 1990. Before voting, Council Member Habenicht co11111ented she was not pleased with the way things were being handled, that the procedures being followed were causing loss of credibility amongst Council members and as a Council body. She read a statement Into the record concerning the Union/Tufts/Santa Fe issue and in- formed Council concern Ing the State Highway Co11111i ssi oner meeting which she attended with Council Member Wigg i ns, at wh i ch Council Member Clayton present - ed a position wh i ch differed from her understanding of Counc il's ori ginal position . Ms. Haben i cht took Issue with Council changing its position by resolution without proper notice and Input from the School Board and affected citizens . The Union/Tufts /Santa Fe intersection has been a Counctl i ssue during that period of time. He expla i ned the reason he proposed the resolution, which he presented at the State Highway Conm1ssion meet i ng, was to be certain it was the opinion of the ma j or i ty of Counc il to pursue the Issue . He commented there i s no certainty we will get State fu nd i ng for the intersec- tion but 1f "we don't ask, we won 't ." Hr. Clayton reminded Council of his recen t r:onvers.it ion with the School Board Superintendent, during which Dr . Englewood City Council "lnutes October 15, 1990 • Page 10 Davidson stated he did not be 11 eve the Schoo 1 Board was aware of Counc 11 's majority posit i on to not support the Intersection unless "It was paid for by State funds " and unless "it adequately deals wi th intrusion of traffic of the residential area ." Mr. Clayton stated he was attempting to communicate that posit i on by propos i ng a letter be delivered to the School Board at its meeting on October 16. Hr. Clayton called for the question. (v) Counc il Member Habenicht related the events which led up to the recent lay-offs in the City, as she perceived them. Ms . Habenicht stated she had been fielding Inquir i es from the press and citizens , attempting to correct misconcept i ons; however, she stated she Is very confused and feels the contunlty 1s also confused about the Issue. She expressed her dismay at the "i nsensitive and ind i gnant manner " in which the lay-offs were handled . Hs. Habenicht was of the opin i on these decisions were to be part of the budgetary process; fu r ther, that decis i ons are not made in executive session . [vi) Council Member Wigg Ins requested an account Ing of expenses Incurred by Ci ty Manager Fr aser in hi s move to Englewood. (vii) Council Member Koltay requested staff to notify the resi - dents of the 3900 block of South Logan that he intends to make a motion at the November 5th Council meeting to include that block In the "parking by permit" area. Mr. Koltay addressed the issue brought forth prev i ously by Council Me11ber Habenicht (see 12 b(v)). He commented that In his op i nion the City Manager had conducted the layo f fs, wh i ch were a result of budget constraints, in an appropriate manner. He also stated he believes that Council's full endorse- ment was behi nd the reduct i ons 1n administrative staff . Council Member Clayton reinforced Hr . Koltay's conrnents , stating he recalls the Ci ty Manager informing Council of his intent i ons and the manner ln which Englewood Ctty Counc11 Minutes October 15, 1990 -Page 11 they would be implemented, further, he does not recall anyone present at that meeting voic i ng any objections to any of the proposed actions. 13 . Ctty Manager's Report (a) Mr. Fraser provided a sunrnary of the 1991 budget decisions; J however, he requested clar i fication on matters concerning additional changes. Lengthy discussion ensued concerning matte r s which need to be resolved before the 1991 budget ordinance can be introduced on November 5, 1990 , i.e ., book- mobile , domestic violence , fire services. Hr . Fraser advised Counctl that a study session has been set for October 22 to discuss some of these matters. Counc il Member Bullock stressed again the importance of "co-oping • the fire Service Delivery Conmittee Into the budget process . Council Member Clayton agreed it is important to keep them advised , but he pointed out problems with consulting with a conrnittee wh i ch has never taken a conclusive vote . Counc i l Member Hathaway pointed out that Council has made the general consensus to consult with the Library Board, it has made the general consensus to consult fu r ther about domest i c violence, and that Council ought to do them all or not do any . Council Member Habenicht stated that meeting with the fire Service Delivery Corrmittee is appropriate as ~he would like to ascertain if what ts being proposed actually meets their reco11111endation. COUNCIL MEMBER BULLOCK MOVED, ANO IT WAS SECONDED, TD EXTEND AN INVITATION TO MEMBERS OF THE FIRE SERVICE DELIVERY CONNITTEE TO BE PRESENT AT THE NEXT DIS- CUSSION OF THE ISSUE . Ayes: Council Members Koltay, Hathaway , Wiggins, Bullock, Clayton, Habenicht , Yan Dyke Nays: None Motion carried. Mayor Van Dyke offered that if there 1s any way to reach bet- ter consensus on these issues before November 5th that Council should take advantage of that opportunity, even if it requires mo r e than one study ses- sion. Mr. Fraser suggested, and Council concurred, to set a study session for October 29, 1990, for the meeting with the Fire Service Delivery Conmittee. 14. City Attorney's Report (a) Mr. DeWitt transmitted an offer from Commercial Union, etal, advis- ing Counc il that the matter has been reviewed by Director Fonda.
