The regular 111eettng of the Englewood City Council was called t.o order by Mayor
Van Dyke at 7:40 p.a .
2. Invocation
The Invocation was given by Council Member Koltay.

later in the aeeting; however, Mr. Hess later addressed City Council , thanking

them for efforts to improve the safety conditions in and around Bishop Elemen-
tary School . He presented murals and various compositions of the first grade
students expressing their appreciation for the stop 1 ight and other safety
measures. A letter of appreciation fro111 Paa Hillegas, Chairperson of the
Parent Advisory Team, was also given to City Council.
(b) Judy Flynn, President, Business and Professional W<>Mn, was present
to receive a proclamation.

A COUNCIL SILL FOR AN ORDINANCE APPROVING AN AGREEMENT GRANTING AN ENCROACH -
MENT FOR A STRUCTURE INTO AN UNIMPROVED PORTION OF RIGHT -OF-WAY IN THE 3200
BLOCK OF SOUTH WYANDOT STREET EXTENDED IN THE CITY OF ENGLEWOOD.
Council Me•ber Habenicht Inquired if infomatton fro• the area property owners
had been received; also she wondered If there was any way the City could fa-
cil itate an agreement which would be a vacation rather than an encroa~hment .
City Manager Fraser confirMed that the ad j oining property owner had been con-
tacted; however, that owner d i d not object to the procedure being followed ,
also that he had no Interest 1n pursuing any other alternative.

(a) City Manager Fraser presented a rec011mendatlon from the Department
of Community Development to adopt a bill for an ordinance granting an en-
croachment for an existing building at 3653 South Inca Street, which en-
croaches less than one foot i nto the publ le right-of-way for both So uth ' ,
Street and the Inca/Juen alley. He .;tated staff had reviewed the reques t .,d
reconnends it be approved .
The City Clerk read Council Bil l No . 34, introduced by Council Member Hath-
away, entitled:
A BILL FOR AN ORDINANCE APPROVING AN ENCROACHMENT OF A PORTION OF A MASONRY
BUILDING AT 3653 SOUTH INCA STREET, ENGLEWOOD , COLORADO .
COUNCIL MEMBER HATHAIIAY NOVED, AND IT WAS SECONDED, TO APPROVE ON FIRST READ-
ING COUNCIL BILL NO. 34, SERIES OF 11189. Council Member Habenicht suggested
that staff look 1nto this type of agreement -encroach•ent versus vacation .

(b) Ci ty Manager Fraser requested that Agenda Itea ll(b), a bill for an
ordinance amending se~tions of the Code pertaining to Food Delivery Vehicles
and Food Vendors be tabled . He stated additional aniendments are appropriate .

(c) Director Waggoner, presented a rec-ndation frOIII the Public Works
Department to adopt a resolution a11ending Resolution No. 41, Serles of 1989,
concerning the lease of the City greenhouse property. Mr. Waggoner eKplained
that the amendment provided for a deposit nf escrow 110n1es u a performance
guarantee rather than a performance bond . He assured Council the total amount
of the deposit over a one -ye ar period -S7,BOO, would adequately protect the
City. The Resolut i on was assigned a number and read by title :

the North Reservoir . Mr . Fonda explained the bid differences and recollllltnded
the bid be awarded to Env1roqu1p, Inc., in the amount of $157 ,000 .

(it) Council 11ember Habenicht announced she had accoMpanied Police
Officer Swan on his Uednesday, Septeniber 27th shift and that It had been ex •
tr1111ly hectic duty. She expreued pride for the officers of the Englewood
Police Department and for the experience she shared with Officer SWiln . She
stated she supports the City Manager's propou.l to review the procedure of
employee compensation ar,d adnr,ceaent schedules. She also stated she stands

by her public stat-nt recently published In the Englewood Sent1nel; however,
at the SIN ti• she wants It known that she supports the Career Service Board's pos i tion, and she supports the Police.
(111) Counc i l Member Clayton offered appreciation to City Manager
fruer and Finance Director Fre••n for the excellent budget present~tlon at
the recent budget retreat. He c~nted that ft was refreshing to go Into the
retreat with a balanced budget affording Council ti111e to discuss other issues
of 1•portance. He expressed confidence t n the outc011t of the budget results.
(iv) Council Metlber Kozacek echoed Mr . Clayton's COtllllents concern -
ing the budget, stating each dep1rt111ent head had done a tremendous job of com-
Ing in • · h budg,t cuts . He stri•ngly suggested that considention be given to
conductl 11g the budget retrut focally next year, wh i ch would save thg City considerable funds.
