requested Counc il's support and participation in a national food m·ive program
entitled "First Food Fight " which is being co-s ponso red by ,·irst Chirop,actic ,
Greater Englewood Chamb er of Commerce, and Burt T•Jyota. He requested the as -
sistance of the Police De nartment on the day of tne parade, at which time the
food , toys and c 1 othi ng wi 11 be co 11 ected a 1 ong South Broadway, and a 1 so as-
s istance during the neig hbo rhood canvassing. He explained that all of the
proceeds wi ll be donat ed t o the Salvation Army on Dece mber 23rd . Mayor Van
Dyke ex pr essed Council 's willingness to su pport this pro ject.

of Community Development , and the Board of Adj us t me nt and Appeal s, re lati ve to
a roofing li cen se . He sugg es t ed t hat Co un c il i s not f ull y aware o f decis i ons
mad e at the admini s trativ e level. As a r es ult of hi s pro bl ems , he asked Co un -
c il to make certain he was prov;ded with the foll owing:
I. Report from Appeal s .oard from th e mee ting of November 9 , I 98 8 .
2. Final inspection report of the la s t shingl e jo b done by Mr. Haidon.
He explained that Mr. Yod er, Building Divi s ion , had refu se d to pro -
vide him with a copy .
3. He requested a follow-up of an official co mplaint he had made to
Mr . Vargas concern i ng harassment fr om the Building Division In s pec -
tors, s tating he did not feel Mr. Va r ga s ha d pur sued the matter.
He provided Council with a copy of that complaint.
He advised Counci l that in hi s opinion Mr. Yoder i s less than truthful which
wi ll prove unfort unate for the City and cost the City considerable money in
the future . He also advised Council that at some future t i me , he would like
to discus s the subject of "se lective code enforcement."
Mr . Haidon was of the opinion that the State Constitution, the legi slative
divisi on , executive division, and judicial divi s ion all guarantee that M•.
Yoder cannot deny him his license. He felt his testimony had been ignored .
Further discussion ensued . Mr. Haidon was advi sed the materials he had re-
quested will ~e provided , and that he should make arrangements through the
City Manager 's office to address council in the future.
City Attorney DeWitt and Ac ting City Manag er Vargas ex plained briefly the
City 's position in regard to thi s matter .
(b) Betty Keena, 4801 South Kalamath , urged Council not to approve on
final reading Counc i l Bill No. 44 rel ;tive to labor relati ons. Ms . Keena pro-
vid ed Council with some ba ckg r ound informati on con ce rning th e changes that
were made to the Charte r in 1981 , the result s of whi ch i s the current Career
Service System Act. She stre ss ed that separate sec t i ons of the Act s hould not
be amended without looking at the entire se cti on. She was of th e opinion that
if the Charter were amend ed all ow ing r;areer Se r vi ce Board to modify disciplin-
ary action, the number of app eal s would be doubl ed . She s tre ssed that th e
System has stood up in Court, thdt it ha s been pro ven to be con stitution al and
legal. She urged Council to all ow the new City Manag er an opportunit.v to work
under the current labor r elation s system , per mitting him to assess the s itua -
tion and advi se Council con cerning t he matt er . Council Member Koza cek r e-
s ponded , advising Ms . Keena that by approving Counc i 1 Bi 11 No. 44 it i s not
Council 's intent to support the Charter change , but to avoid, if possible, th e
necessity for a special election. He further felt the matter should be de-
e i ded by the people . Ms . Keena reiterated her pas it ion of th e need to l oak at

th e entire labor relations system as a whol e , not to i solate on e paragrap h
based on complair s. She was of a s trong opinion that to unanimou s ly approv e
Council Bill No . 14 would s how Cou nc il 's suppor t regarding t ~e iss ue of
modi fi cation of di sc .• lin e . Council Mem ber Habe nicht s tated her r 0 asons for I
s upporting thi s ordi nance an d Charter am en dm ent , exp 1 a in i ng there i s a percep -
ti on in th e comm unity that th e matter wa $ not clarifi ed at the time of the
la st Charter amendment s (March, 1981 election). Ms. Habenicht f ell th e i ss ue
shoul d be cl eared up an d decided by t he voter s. Ms. Kee na sl ated t hat to put
t his question on t he ba ll ot volu ntar il y wou l d se parate management from em -
pl oyees an d would be divisive and ca use many problems for the new City
Manager .
(c) Michael Gruninger , Pre s ident of Englewo od Firefighters Ass ociation
(EFFA), addre ss ed Cou ncil concerning Ms. Kee na 's comme nt s . He di s put ed some
of the statements made by Ms . Keena . He wa s of the , ;rm op in ion that cha nging
t he Charter to a 11 ow Career Ser vi ce Board to modi f y d i sci p 1 i nary action wou ld
be nefit and unite t he C: ty and "wi 11 give every e!11p 1 oyee, every man ag er, and
eve rybody on thi s Cou ncil an even shake ." He further informed Council th at if
Counc i l Bill No . 44 is voted down, the matter will gc to a special el ection.
(d ) Gordon Madonna , President of Englewood Police Benefit Association
(EPBA ), informe d Coun cil and Ms. Keena that all three unio ns (E PBA, EFFA , and
[EA ) are un ited behin d the proposed Charter cha nge. He f urther st ated that
all th ree union s were of th e s ame opin i on t hey had bee n mi s l ed and t hey wa nt
th e mat ter r ec tifi ed .

ry and Confidential employees. He ex plained that a 1.75% wag e increase for

( e) Acting City Manager Vargas presented a recommendation for Counc i 1
t o approve an Addendum to the 1988 -1989-1990 Coll ec tive Bargaining Contract
betw een the City and Englewood Employee s Association (EEA). Mr. Vargas ad -
v ised Council that the wage adjustment would call for a 1.75% increas e for the
year 1989.

(f) Acting City Manager Vargas present ed a recommendation from the
Parks and Rec re at ion Department to adopt a Res o 1 ut ion approving the Go 1f
Course Concessionaire Agreement. Mr . Vargas adv i sed Council that an assess-
ment committee had reviewed the proposals and con~ur,·ed that the best suited
vendor was Woody 's Cl u~ (Anderson -Ma 11 oy, Inc.) . He exp 1 a i ned that Woody's
C 1 ub was currently operating under an interim agreement pending She ridan 's
approval of the liquor license. The agreement under consideration would be-
come effective when the 1 i quo r Ii cense is granted.

MAYOR VAN DYKE MOVED, COUNCIL MEMBER KOZACEK SECONDED, TO APPROVE RESOLUTION
NO. 91, SERIES OF 1988. Before calling for the vote , Mayor Van Dyk e entered
into t he record a prepared statement relative to the hiring of the new City
Manager, as follows:
'The se lection procesi for hiring a new City Manager has been long and
arduous.
"It began in May of this year and officially came to com pl etion only la st
week. Seven months of processing occ urred , from an original po s iti Jn of
Cou ncil doing all the leg work , to the hiring of a profes s ional firm to
assist us in our search . Over 130 i ndividual s from throughou t the U.S.,
formally applied for this position. With the help of Jerry Oldani , from
Jensen and Oldani & As soci ates, we were able to reduce our list of appli -
cants down to six. Thi s list of s ix final ca ndida tes was deemed to be
be st -cream which rose to the top -after inte nsive searching and i nt er-
viewing performed by Mr . Oldan ;. Not one of t hese ca ndida tes was put on
t he final l ist withou t passing the criteria set fort h by both Cou nci l and
Mr . Oldan i.
"The final pha se of our searc h :ulminated in an intensive two day inter -
view, which he 1 ped us as a group to become better acquainted with a 11 of
the finalists. Early i nto this final process, it became appa rent to me
at least that each and every one of the six final candidates were indeed
highly qualified to fill the post. Each candidate had special talent s

and unique acco n, shment s which would have inev it able benefit to the
City of Englewood.
"Selection of th e final one person to of -.'er the po s ition to was most dif -I
ficult. As varied as our individual persona li ties arc in the make -up of
thi s Council, I think I can safe l y say that each of us had a different
id ea of whi ch cand idate would do the be s t job . Th erefore , s election of
our new City manager , Mr. Roger Fra se r , was the result of an agreed upon
conse nsus.
"I am looking forwar o with great antic ip at ion to the opportunity to work
with Mr. Fraser. I am confident t hat he will inde ed bring a great deal
of expertise to thi s City and provide leadership and management ski ll s to
all , which will lead t o i l'lo ending and long la sting acc omplishments.
"I fee 1 that this City a.-.; its sev en member Cou nc il holds a deep debt of
gratitude to Acting Ci t y Mana ger Pete r Varg as. He boldly accepted the
challenge of Acting City Mana ger and without hesitation addressed every
concern put before him by this Council. He in s till ed several new manage -
ment i nn ovations during his seve n month internship, and reinstituted the
Insider and t he weekly Council newsletter, two very succes s ful internal
communiques . We have gained much by hi s efforts , personall y and co 11 ec-
t ively as he was i nd eed the magnet which has carried th e City forward
during this diff i cult time of transition of managers . Pet er in my
opinion is an excell ent City manager . Selfishly, I hope he stay; on in
Englewood, because he can continue to be a very competent cont ri but or in
the Assistant Manager 's role. However, when and if he chooses to move
on , I can onl y give him my best, becau se he undoubtedly is capable of
becoming a full -fledged City manager in hi s own right."
Mayor Van Dyke concluded by thanking Mr . Varga s s tating, "We couldn 't have
done it without you."

cil's ) appreciation for the admir able performance of Peter Va rgas in the
position of Actiny .ity Manag er.

stitution of the Insid er , a mont hl y employee new s letter, and through a
weekly newsletter keepi ng Coun ci l Members inform ed about eve nt s , pr ogress
and work with the variou s departments of the City .
"He worked with a reduced staff 1 eve 1 in th e City Manag er 's office , and
was directly involved in th e ~r epa r i'ti on of the City ~-1dget , mindful of
Council's direction and intent.
"Peter 's stea dy leade rs hip through ei ght month s of tra11 s ition has pro-
vided continuity and stabi 1 ity t o the emp 1 oyees and a continued hi gh
level of service to the City through a commitment to service to the
citizens of Englewood . He has provided information and support to the
