WHEREAS , th e Englewood/Mclellan Re servo ir Fo und ati on (E MRF) was fo rm ed to oversee the deve lopment of th e Mclell an Reservoir prope rt y; and WH EREAS , upon th e completion ofC-470 , Shea Homes (Mi ss ion Viejo) wa s left with a Pl an ning Arca, known as Planning Area 86 , north of C-470, south of County Line Road, wi th oct acc ess from publi c Right-of-Way; and WHEREAS, Pl annin g Arca 86, is east of propert y owne d by the City of Englcll'ood consisting of 27.89 ac re s; an d WHEREAS , ap pro ximately 7 years ago, a storm water pond wa s constructed on Planning Area 84, des igned to accept drainage from Highlands Ranch Business Park whi ch include s 40 acres owned by the City of Englewood ; and WHEREAS, the storm water pond facility ;1as build in an exis ting drainage area and ·nnstm ction was paid for by Highlands Ran ch Metro Di strict; and WHEREAS , th e edge of the drainage area was de signed to accommodate a roadway which would eventually access the Shea parce l (P lanning Area 86); and WHEREAS , Shea Homes has propo sed building a road to serve Pl anning Area 86 entirely at Shea's expense ; and WHEREAS, the road wi ll be built to Douglas Co unty stanrl ,r,ls and Douglas Co unty wo uld accept maintenan ce of such road ; and WHEKEAS , the propo sed ro ad wi ll provide access to Eng lewood property; NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNC IL OF THE CITY OF ENG LEWOOD, COLORADO , THAT : Section l. The City Counci l of the City of En glew ood, Co lorado. hereby support s the dedication of land by the Engl ewood/McC lellan Re se rv oir Foundati on to Shea Home s to build a road to srrvc Pl anning Area 86, attac hed hereto as "Exhibit A" and sub stanti all y in conform ance with the terms prese nted at the Cou ncil Study Se ss ion of June 6, 2005: Shea Home s wi ll build a road to serv e Planning Area 86 entirely at Shea's expense , with curb cut s to provide access to City owne r property . • The road will be built to Douglas County standards and Dougl as Co unty would accep t maintenance of such road . Shea Homes and the City will resolve access issues on the City 's properties so uth ofC- 470. Shea Hom es will support a high-den sity, transit-oriented de ve lopment of the City's fift y- fi ve (5 5) ac re parcel so uth of C-0470 where the future RTD Light Ra il line wi ll terminate. Section 2. Thi s re so lution of su rport in no way waives or delegates the City 's reg ul ato ry powers, duties and respo nsibiliti es with res pec t to zoning and gove rnm ental issues . This property, known as Planning Area 86, is east of property owned by the Cty of Englewood (27 .89 acr@S} and Planning Area 84, soutl1 of land awned by the Rainbow Foundadon. Approximately 7 years ago, a storm water pond was ccnstructed on Planning Area 84, designed to accept drainage from Highlands Ranch Business Par1< (which lndud<!S 40 aaes owned by the Qty of Englewood. This facility was bu ilt in an existing drainage area , and construction was pa id for by Highlands Ranch Metro District. The edge of the drainage area was designed to accommodm a roadway wh ich wou ld eventually access the Shea parcel (Planning Area 86). A sewer li ne serving the Englewood property was also installed in this area . Shea would install the road to Doug las C:iunty standards, and Douglas CountV would accept maintenanC? of the road . The road will provide access tD the Englewood prope,ty. Shea is also seeking a Sign easement at the comer of th is new road and Lu=t Boulevard f'Or construction of a 15' -a• monument sign to accommodate 5 user panels, 2 for the Shea property, and 3 for ttl e Englewood property .
