ORDINANCE NO.IJ SERIES OF 1997 BY AUTHORITY COUNCIL BILL NO. 87 INTRODUCED BY COUNCIL MEMBER VORMITTAG AN ORDINANCE REPEALING TITLE 7, CHAPTER lB , AND ENACTING A NEW TITLE 5, CHAPTER 25, OF THE ENGLEWOOD MUNICIPAL CODE WHICH PERTAINS TO HOBBY BREEDERS . WHEREAS, the current Hobby Breeders Licensing provisions are located in Title 7, Chapter lB; and WHEREAS, this Ordinance moves the Hobby Breeders licensing provision into Title 5 with the rest of the City's miscellaneous license provisions ; and WHEREAS, this Ordinance will establish license provisions which fit the format of the other licenses in Title 5; and WHEREAS , the Hobby Breeders License was established as a result of concerns regarding the health and safety of citizens and animals in the City of Englewood; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS : Section 1. The City Council of the City of Englewood hereby repeals Title 7, Chapter lB and enacts a new Title 5 , Chapter 25, entitled Hobby Breeders, which shall read as follows: SECTION: 5-25-1 : Definitions 5-25-2: License Required CHAPTER25 HOBBY BREEDERS 5-25-3: Special Application Requirements 5-25-4 : Special License Requirements 5-25-1: DEFINITIONS: For the purposes of this Chapter the following d efinitions apply: HOBBY BREEDER: ANY PERSON WHO , OUTSIDE OF HIS REGULAR COURSE OF EMPLOYMENT , IS BREEDING PUREBRED DOGS OR CATS IN AN ATTEMPT TO IMPROVE THE BREED THROUGH CONTROLLED PROPAGATION, THUS ACHIEVING CAREFULLY DESIRED QUALITIES AND TRAITS. -1- 10 bi i 5-25-2: LICENSE REQUIBED: IT SHALL BE UNLAWFUL TO BE A HOBBY BREEDER IN THE CITY OF ENGLEWOOD WITHOUT FIRST OBTAINING A LICENSE PURSUANT TO THIS CHAPTER. 5-25-3: SPECIAL APPLICATION REQUIBEMENTS: IN ADDITION TO APPLICATION PROVISIONS IN TITLE 5, CHAPTER 1, APPLICANTS FOR A HOBBY BREEDERS LICENSE SHALL ALSO COMPLY WITH THE FOLLOWING: A. AN AFFIDAVIT FROM EACH ADJOINING LANDOWNER EXPRESSING CONSENT AND ACKNOWLEDGING THAT THEY HA VE NO OBJECTION TO THE ISSUANCE OF THE LICENSE; AND B. ANY ADDITIONAL INFORMATION REQUIRED BY THE LICENSING OFFICER CONCERNING THE PHYSICAL FACILITIES AND EQUIPMENT ON THE LICENSED PREMISES. 5-25-4: SPECIAL LICENSE REQUIBEMENTS: IN ADDITION TO ALL OTHER REQUIREMENTS OF CHAPTER 1 OF THIS TITLE THE FOLLOWING SPECIAL LICENSE REQUIREMENTS APPLY: A. THE LICENSE HOLDER MAY NOT MAINTAIN MORE THAN FIVE (5) DOGS OR CATS OVER SIX (6) MONTHS OF AGE , NOR MORE THAN TWENTY (20 ) PUPPIES WHELPED NOR MORE THAN TWENTY (20 ) KITTENS WEANED AND TRANSFERRED IN ANY TWELVE (12 ) MONTH PERIOD. B. THE LICENSED PREMISES MUST BE MAINTAINED IN CLEAN AND SANITARY CONDITION IN ACCORDANCE WITH THE LAWS OF THE CITY OF ENGLEWOOD, ARAPAHOE COUNTY, OR THE TRI-COUNTY HEALTH DEPARTMENT OR THE STATE OF COLORADO . C. ALL ANIMAL WASTE MUST BE DISPOSED OF IN ACCORDANCE WITH COLORADO STATE DEPARTMENT OF HEALTH REGULATIONS . D. ADEQUATE VENTILATION FOR THE FACILITIES MUST BE MAINTAINED AT ALL TIMES . E . ADEQUATE NUTRITION AND HUMANE CARE AND TREATMENT MUST BE PROVIDED TO ALL ANIMALS ON THE LICENSED PREMISES . F. THE LICENSED PREMISES AND RECORDS MUST BE OPEN FOR INSPECTION BY AUTHORIZED CITY OF ENGLEWOOD PERSONNEL AT ANY REASONABLE TIME . Date Agenda Item Subject Bill for an ordinance establishing a Hobby Breeders September 15, 1997 10 a i License in Title 5 of the City Code Initiated By Staff Source Department of Financial Services Frank Gryglewicz, Director COUNCIL GOAL AND PREVIOUS COUNCIL ACTION This proposed bill for an ordinance creates a new Chapter 26 (Hobby Breeders) in Title 5 of the City Code. This license previously existed in Title 7 of the Code. This license was established as a result of concerns regarding the health and safety of the citizens and animals in the City of Englewood. City Council discussed this license with staff at the study session held on August 4, 1997. RECOMMENDED ACTION Staff recommends City Council approve this bill for an ordil')ance. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED Currently, the City licenses hobby breeding through provisions in Title 7, Chapter 1 B of the City Code. This action moves the license into Title 5 with the rest of the City's miscellaneous license provisions. This action makes only minor changes to the established license to fit the format of the other licenses in Title 5.
