Q2_ SERIES OF 1997 BY AUTHORITY COUNCIL BILL NO. 95 INTRODUCED BY COUNCIL MEMBER VORMITAGG AN ORDINANCE AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE U .S. GEOLOGICAL SURVEY, UNITED STATES DEPARTMENT OF THE INTERIOR AND THE CITY OF ENGLEWOOD, COLORADO ENTITLED "U .S. DEPARTMENT OF THE INTERIOR U .S . GEOLOGICAL SURVEY JOINT FUNDING AGREEMENT FOR WATER RESOURCES INVESTIGATIONS." WHEREAS, a stream flow gage located at Union Avenue and the South Platte River, is operated and maintained by the U.S. Geological Survey and has been in operation since 1990; and WHEREAS, the Englewood City Council authorized a "Joint Funding Agreement For Water resources Investigations" in 1996 which pr ovided for funding for this project and allowed for renewals by mutual agreemen t; and WHEREAS , the data provided by the gaging station is required by the State Water Commissioner in order to make releases from Chatfield Reservoir during low flow situations in which insufficient water is available to meet pumping demands at Union Avenue Pump Station; and WHEREAS, the Englewood Utilities Department shares in the annual cost of operating and maintaining the station on a 50/50 basis, with the U.S.G.S.; and WHEREAS, this Ordinance will renew the "Joint Funding Agreement For Water Resources Investigations" in the amount of $4,250.00 from each party and authorizes new joint funding for the period of October 1, 1997 through September 30, 1998; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS : Section 1. The intergovernmental agreement "U.S. Department Of The Interior U .S. Geological Survey Joint Funding Agreement For Water Resources Investigations", for the period of October 1, 1997 to September 30, 1998, attached hereto as "Exhibit A," is hereby accepted and approved by the Englewood City Council. -1- 10 bi Section 2. The Mayor is authorized to execute and the City Clerk to attest and seal the Intergovernmental Joint Funding Agreement For Water Sources Investigations for and on behalf of the City of Englewood, Colorado. Agreement No. C098086 Customer No. COlOS Water Resources lnvest1gat1ons e THIS AGREEMENT is entered into as of the 1st day of October 1997 by the U.S. GEOLOGICAL SURVEY, UNITED STATES DEPARTMENT OF THE INTERIOR, party of the first part, and the City of Englewood, party of the second part. 1. The parties hereto agree that subject to the availability of appropriations and in accordance with their respective authorities there shall be maintained in cooperation operation and maintenance of the streamflow gaging station, South Platte River at Union Avenue, hereinafter called the program. 2. The following amounts shall be contributed to cover all of the cost of the necessary field and analytical work directly related to this program. (a) $4,250.00 by the party of the first part during the period October 1, 1997 to September 30, 1998 (b) $4,250.00 by the party of the second part during the period October 1, 1997 to September 30, 1998 (c) Additional or reduced amounts by each party during the above period or succeeding periods as may be determined by mutual agreement and set forth in an exchange of letters between the parties. 3. The costs of this program may be paid by either party in conformity with the laws and regulations respectively governing each party. 4. The field and analytical work pertaining to this program shall be under the direction of or subject to periodic review by an authorized representative of the party of the first part. A 5. The areas to be included in the program shall be determined by mutual agreement between the parties hereto or their W authorized representatives. The methods employed in the field and office shall be those adopted by the party of the first part to insure the required standards of accuracy subject to modification by mutual agreement. 6. During the course of this program, all field and analytical work of either party pertaining to this program shall be open to the inspection of the other party, and if the work is not being carried on in a mutually satisfactory manner, either party may terminate this agreement upon 60 days written notice to the other party. 7. The original records resulting from this program will be deposited in the office of origin of those records. Upon request, copies of the original records will be provided to the office of the other party. 8. The maps, records or reports resulting from this program shall be made available to the public as promptly as possible. The maps, records or reports normally will be published by the party of the first part. However, the party of the second part reserves the right to publish the results of this program and, if already published by the party of the first part shall , upon request, be furnished by the party of the first part, at cost, impressions suitable for purposes of reproduction similar to that for which the original copy was prepared . The maps, records or reports published by either party shall contain a statement of the cooperative relations between the parties. 9. Billing for this agreement will be rendered annually . Payments of bills are due within 60 days after the billing date. If not paid by the due date, interest will be charged at the current Treasury rate for each 30 day period, or portion thereof, that the payment is delayed beyond t he due date. Fonda, Director of Utilities COUNCIL GOAL AND PREVIOUS COUNCIL ACTION Council Bill No. 57 was passed by Council October 21, 1996 approving a Joint Funding Agreement. RECOMMENDED ACTION Approval of the proposed Joint Funding Agreement between the City of Englewood and the U.S. Geological Survey for October 1, 1997 to September 30, 1998. BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED A stream flow gauge, operated and maintained by the United States Geological Survey (USGS), has been in operation since 1990 at Union Avenue and the South Platte River. The information from the gauge is critical during low flow periods to determine if water must be released from Chatfield Reservoir. The data provided by the gauging station is required by the State Water Commissioner in order to make releases from Chatfield Reservoir during low flow situations in which insufficient water is available to meet pumping dem~_~ds at Union Avenue Pump Station. The Utilities Department shares in the annual cost of operating and maintaining the station on a 50% basis, with the remaining 50% contributed by the USGS. FINANCIAL IMPACT The cost of funding this agreement will be approximately $20,000 to $25,000 over the next five years. This portion is for 1997-1998 and is $4,250.00 The funds are included in the 1997 budget.
