AN ORDINANCE AUTHORIZING A GRANT OF TWO ELECTRICAL LINE
EASEMENTS BETWEEN THE CITY OF ENGLEWOOD , COLORADO AND PUBLIC
SERVICE COMPANY OF COLORADO , LOCATED IN ROMANS PARK.
WHEREAS , in 1974, the Public Service Company installed electrical lines through
Romans Park located at 1700 East Floyd Avenue; and
WHEREAS , these electrical lines now are scheduled to be upgraded by Public
Service ; and
WHEREAS , during the design for the upgrading of these electrical lines , it was
discovered that e asements had not been obtained for the initial installation ; and
WHEREAS , the Public Service Company has applied for two easements to correct
the error which was made in 1974; and
WHEREAS , with the passage of this Ordinance two electrical line easements are
hereby granted to Public Service Company, one eight feet wide and the second 10 feet
wide , through Romans Park;
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ENGLEWOOD , COLORADO, AS FOLLOWS :
Section 1. The Grant of two electrical line easements to Public Service Company of
Colorado, by the City of Englewood, Colorado, attached hereto as Exhibit 1, is hereby
accepted and approved by the Englewood City Council.
Section 2 . The Mayor is authorized to execute and the City Clerk to attest and seal
the "Public Service Company of Colorado Easements" for and on behalf of the City of
Englewood, Colorado.
Introduced , read in full , and passed on first reading on the 19th day of April, 1999 .

The undersigned Granlor hereby acknowledges receipt of good and valuable consideration from PUBLIC
SERV ICE CO . OF COLORADO (Compciny), 1225-17'" Street . Denver. Colorado , 80202-5533 . in consideration of
which Grantor(s) hereby grants unto said Company , its suc cessors and assigns . non-exclusive easement to
construct , operate. maintain, repair , and replace utility lines and all fixtures and devices , used or useful in lhe
operation of said lines , through , over , under, acros s , and along a course as said lines may be hereafter
constructed in
TRACT OF LAND,
Commonly known as ROMANS PARK ,
situated in lhe
SE 1/4 of Section --1§_, Township 4 South , Range 68 West of lhe ~ Prin cipal Meridian,
Ci ty of ENGLEWOOD , County of ARAPAHOE , Slate of Colorado,
The easement being described as follows ;
SEE EXHIBITS "A" AND "B" ATTACHED HERETO AND MADE A PART HEREOF.
The easement 8 & 10 feet in width . The side boundary lines of the easement shall be lengthened and
shortened as necessary lo encompass a continuous strip of nol less than the above widl11 at all points on
Grantor's property crossed by lhe above described easement and extending to the boundaries of adjacent
properties .
Together with the right to enter upon said premises, to survey, construct , maintain. operate . repair . replace,
control, and use said ut ility lines and related fixtures and devices. and to remove objec ts interfer ing therewith,
including lhe trimming of trees and bushes , and together with lhe right to use so much of the adjoining premises
of Grantor during surveying, co nstructio11 , maintenance , repair . remova l, or rep la cemen t of said utility lines and
re lated fixtures and devices as may be required lo permit tt1e ope rati on of sta ndard utility construction or repair
machinery . The Grantor reserves the right to use and occupy the easement for any purpose consisten t with th e
rights and privileges ab ove granted and which will not in terfere with or endanger any of the said Company's
fa cili ti es therein or use thereof. Such reservations by the Grantor shall in no event include the right to erect or
cause lo be erected any buildings or structures upon the easement granted or lo locate any mobile home or
trailer units thereon . In case of the permanent abandonment of lhe easement, all right , p·rivilege , and interest
granted shall terminate .
The work of ins talling and maintaining said lines and fixtures shall be done with care; the surface along the
easement shall be restored substantially to its original level and condition .

RECOMMENDED ACTION
Staff seeks Council approval of a Bill for an Ordinance for two (2) easements to allow the Public
Service Company of Colorado to upgrade electrical lin .ss at Romans Park.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
In 1974, the Public Service Company installed electrical lines through Romans Park, 1700 East Floyd
Avenue. The electrical lines are now scheduled to be upgraded. During the new design for upgrading,
it was discovered that easements had not been obtained for the initial installation. Public Service
Company is applying for the easements at this time to correct the error that was made in 197 4.
