Coun c il Memb~r Brads haw stated that she Wds asking Council to
recon!;ider this, as six citizens had contacted her regarding th e
problems they hav e had trying to use th e pa~k she lters .
Counci I ~e mber Van Dyke que stioned if there had been any addition s
or changes to Resol ution No . 18 as origi nally presented. Ms. Brad -
shaw sta ted t hat it wa s the same.
Council Member Bradshaw respon ded to questions from the Council
members. The Counc 11 Members voiced the same co nce •ns they had at
the June I, 1987 meeting.
Council Member Bilo stated he had no t received ca ll s on this
re solution , pro or con , and would like to hear data to substantiate
the need for this resolution. He noted that as long as day care
facilities paid S200 .00 then the bus loads could still come in, so
the resolution as prese nted did not really addre ss the problem of
park usage.
Director of Park s and Recreation Kuhn pre se nted the Information
g,athered from monitoring the number of day care facilities using
the parks . He noted thal th e Parks and Recreation Oepartment per -
so nnel woul d be responsibi e for enf,rci~g the Resolution and the
Police Department ha s agreed to ass st in the event of a confronta-
tion. Mr. Kuhn slated th ere are fo,1r or fl ve group, who use the
parks during the course of the year who create the problems. They
bring in school bus loads at a tim,; with perhap s two s upervisors
who are not really watching the kids. He noted I.hat the nu mber
could be as hi gh as twenty groups t hat will ~e 11sing the faciliti es I
this surrvner. Mr. Kuhn not ed that the Co 1 or ado Revised Statute s
identifies a child day care center as any facll ity that cares f or
more than five chi 1 dren who are not re 1 a led t 1 the per so n taking
cire of them.

Council Mem be r Van Dyke made the following s tatement : 'Our role as
legislature s is lo respon sibly address and rectify se rious City
concerns . ln order lo accomplish this task, equitably and effi -
ciently, we mus t be provided with adequate information In which Lo
verify, beyond a shado w of a doubt, the need lo imp ose new 1 aws.
In the case of thi s Parks and Recreation recommendation, to impose
a fee f or th e us e of City Park s by profes s ional day care center s ,
substantial and in depth information i s woefully lacking. Add to
that, the fact th at there's a serious lack of manpower available to
effectively enforce a requirement for permit s, lead~ me once again
lo take a s tand in opposition of this motion. Wh en it comes to
Implementing what i s mandated, we as responsible community leaders ,
mu s t be able lo budgel th e ne cess ary personn el and/or funds for
enforceme nt of new law s. Otherwise, we find our se lves in the act
of legislating empty and meaningless laws . 1 strongly f eel the
intent of thi s legi s lation need s to be studied . However, 1 do not
fee l the additional re searc h at this t imes Is s ufficient in nature
lo warrant the passage of this legislation in its present s late ."
Mayor Olis s tated he would s upport thi s resolution, but he noted he
did not feel the flat foe of $200 .00 wa s equitable. lie noted that
Sec tion two gives the Parks and Recreation Department the respon -
sibility of notifying users, charging the fees and determining how
the enforcement would be handled. Thi s appears to give t he m a lot
of leeway. He suggested that the Park s and Recreation Department
could come back lo Council with a s ugge s tion for a s l id i ng fee
schedule, charging up t o $20 0.00 a year . He felt it would be very
difficult to put anything like this in effect by July 1st or even thi s summer .
Council Member Bradshaw questioned Mr. Kuhn about the difficulty of
putting thi s resolution Into effect. Mr . Kuhn s lated that they do
require a permit at this lime, but there i s no charge . He felt
they could adverll se in the paper and inform the groups as they
come into the Parks that they would need to pay a fee before using
the facilit.ies the next lime . Mr. Kuhn also addressed a concern
raised at the June 1s t meeting, as to how th ey would really know
which groups were there. He s t ated the permit s would be numbered,
which would help with monilorin•J the user s and the record keep i ng .
Counci 1 Member Van Dyke reque s ted that the Parks and Re c r e at ion
Department have s la ti s ti cs prepa red for City Counc i 1 at the end of
summer, as to how man y day care centers were approached and charged, etc.
Mr. Kuhn slated the Parks and Recre ation Departm ent staff had in -
tended lo do that initially, as group s are us ing the parks in
l arger numbers and more consistently.

The Co un c i 1 amended the Reso 1 ut 1 on as fo 11 ows : Change • a fl at rate
f ee of S200 pe r year" to read "a fee up to S200 per year• (two
places) and in Sec tion 2, "charging the fees• to read "c ha rging and
determining the fee s".
