Acting Dire ctor Romans was sworn i n. Mr s. Romans sub n,itted t he affidavit
of the Notice of Public Hear ing publ is hed May 20, 1987 . She stated that
th ere were five sections of the Comp rehe ns ive Zoning Ordinance being con -
s id ered for amendment during thi s Public Hearing, Section s 16.4 -1
(R es trictions), 16.4-16 (Flood Plain Regulations), 16 .5 (General Regula -
tion s ), 16 .7-4 (Violat i on and Penalty), and 16 .8 (Definit i on s ). She not -
ed that each section would be considered separately.
Mr s . Romans requested that they be allowed to show som e ~l ides reveal Ing
some of the problems and concern s of the citizens . Mr s . Romans
submitted her copies of complaints that she ha s pers on ally recei ved from
th e ci tizens regarding derelict vehicles. She noted that most of the
co mplaint s are filed directl y with the Zoning or Code Enforcem ent Off i cer.
Af ter the s l Ide pr esentation , Mrs . Roman s introduced Susan Hirsch, Senior Planner.

cil wou ld not be addressing the Landscape Ordinance during the Public
Hear ing as it has bee n remand ed back to Planning and Zoning Commi ssi on . I

that a provision be made r egard in g a ti me limit , su ch as 2,1 hour s, to

SECT ION 16 .4 -16 (FLOOD PLAIN REGULATluN S):
Harold Sti lt, City Planner II, duly sworn, s tated th e Ci ty o f Engl ewood
had received notificati on from th e Feder a 1 Eme rgency Management Agency,
t hat there were certain amendments and revi sions to t he Flood Plain Or-
dinance that were mandat ed by Federal Regulation . Th e changes are neces -
s ary Lo bring the local ordinance into compliance with the Federal Reg -
ulation s and as suc h, in one se nse, th ese r eg ula ti on s are mandatory . We
ha ve until September 25, 1987 to hav e thi s ordinance adopted and for -
warded to Wa shington for their revi ew. Th e Co 1 or ado Wat er Conservation
Board ha s r eviewe d and approv ed these ame ndme nt s . He further s t ated th at
the proposed am e ndm ent s are nec ess ary so we ca n maintain the Flo od In -
s uranc e Program within the City of Englewood . If th e amendm e nt s are not
approv ed, we ri sk lo si ng that in s ur ance program .
SE CT!O li 16 .5 (GENERAL REGULATIONS):
Joseph B. Plizga, City Traffic Engin eer, duly sworn , d iscussed am endment s
proposed to thi s Section of the Comprehensive Zoning Ordinance. He pres -
ented slides showing the logi stic s of the pr oposed amendments, which
would improve sight distances at intersect ions and decrea se accidents .
He respond ed to question s of variou s Co un ci lmemb er s ; it wa s suggested
that thi s sec ti on of the am e ndm e nt s s hould be reviewed furth e r in s tudy
sess ion . Discussion ensued conce rning othe r changes to Section 16 .5 .

SECT ION 16 .7-4 (VIOLATIONS AND PENALTY):
Mr s. Romans stated that because there were so many conflict s in the
Mun icipal Code on the violations and penalty sections we are attempting
to reference everyt hing to Title 1.4 -1 which s ays that any violation of
the zoning ordi nance would come under th e general penalty section of the
Muni ci pal Code.
SECT!ON 16 .8 (DEFINITIONS}:
Marj Nickem, owner of property at 3470 South Broadway, duly sworn que s -
tioned the intent of Section 16 .5-2. She wanted to have this c lar ified
as she felt it co uld be an inva s ion of privacy . Ma yor Otis stated that
thi s wa s directed to reside nt ial areas only. Mrs . Romans stated that the
intent wa s to try and keep commercial vehicle s out of the residential
di s trict. Ms. Ni cke m felt that "commercial vehicle " as defined in th is
sect ion should be clarified. Mrs . Romans stated that all of the defini -
tion s that relate to ca r s are taken from the Model Tr a ffi c Code. It wa s
also pointed out by Council Mem ber Kozacek that the definition pro vided
in Section 16.8-1 for "commercial vehicle" states that it is any motor
vehicle licensed by the State of Colorado as a commer c · vehicle.
