pla i ned that the Career Ser vice Board believe s that their right to modify di s-
c i p 1 i ne is an important protection for C ily emp 1 oy ees. Copies of new spaper
ar tic les which appeared in the Englewood Sentinel in May , 1984, were di sc ussed
and given to the Cl erk l o include In the record . Mr . Fleenor co ne l uded by
s la ling that the Career Se rvice Board serve s as an es scnl i al pro tee ti on to
emp loye e rig ht s and that the Board nee ds to continue lo be abl e to decide
whether di scip line is appropriate or excessive. The neutra lity of the Chair-
man was que s tioned and d iscu s sed .
(b) Officer Ga ry Ka ss on , Pre s ident of the Eng l ewood Po li ce Ben e fit As-
sociation , e.,pressed opposition to the pa ssage of Co uncil Bill No . 67 amending
the Career Service Board's rights to modify di sciplinary action s of the City
admini s tr•tion . He expres se d the di s appointment and confu s ion felt by the
members of EPBA as a resu lt of this matter being reconsid ered since the As-
soc iation had been of t he opinion the ordinance had bee n de feated on Oc Lober
19 . He further stated he had been approached by staff in an effort to strike
a comprom i se, but t hat th e Ass ociation had not agreed lo ne got iations towar d a
compromise even though he had agreed to discuss the matt er further with staff.
li e s tated that 1f this ordinance i s approved, it will de s troy one of the
checks and ba 1 ances provid ed the emp 1 oyees, it wi 11 result in increased expen -
ses for both the City and emp loye es to re solve future appeals . He concluded
by ~cque s ting Council lo bring thi s item forward for a decision rather than
hold it until later in t he meeti ng . Council agreed but other vi sitors wishing
t o disc uss the sa me s ubje ct we r e heard f irs t.
7. Non-sch ed uled Visitors
(a) Mi ke Grunning er, President of th e Engl ewood Firef '~hters Associ a-
tion, s tated the Firefi ghter s Ass ociation wer e al so oppo sed to the ordinanc e
and planned to attend th e public hearing to s tate their po s ition. He stated
the fir e fight er s would be wi lling to negotiate a compromise, but they sup-
ported t he Career Se rvi ce System and its right to modify di scipline.
Mayor Oti s called for a rece ss at 8 :54 p.m. to receive in forma tion from the
City Attorney; the mee ting r econvened at 9 :07 p.m.

A quorum was present. Mayor Otis asked if anyone else wi shed to speak to
Cou nci l on the matter of the Career Service System.
Non-scheduled Visitors (continued)
(b) Pete Juenemann, Pre side nt of the Englewood Employees Association
and an emp 1 oyee of the Bi -C lty Wastewater Treatment Pl ant, questioned the vote
on October 19 . It was explained that the October 19th 3-3 vote was not a de-
feat by Council but considered a "defeat by rules of Council." Mr . Juenemann
s lated the Employee s Asso ci ation hop ed thi s matter would be se ttled by de feat -
in g lhe ordi nance, that the As soc iation perceived th e Caree r Service System as
f unc lion i ng the way it wa s intende d , t.o change it lhe way this ordinance is
written would be a serious loss to the organizatior .
(c ) Janet Kerzic, 4790 South Lipan, returned to the podium to i nform
Counci l that the judge hearing the Leyden case had stated he had to give the
dec i s ion some real thought because it would affect th e Career Service Board in
lhe future .
(d) Don Smith, 3165 South Sherman Street, addressed Council with regard
to Coun c il Bill No. 67, warning Council that if the intent and purpos e of the
ordinanc e was in con flict with the Charter, it would be illegal and end up in
Co urt.
(e) Roy Swanson, Bu si ne ss Agent for Englewood Employees Association,
notified Council that the State Council is opposing the ordinance, sup porting
the Career Service Board 100% with a nationwide effort on behalf of the Career
Service Board .

tax further t ho se bu sinesses whi ch RTD would determine woul d benefi t fro:n r~p-
id tran s it. He requ es ted that Council pass a resolut i on opposing thi s
legis l ation.
2. He s ta ted it wou l d be wiser to se nd incumbents as r epresentat ives
lo National League of Cities rather tha n outgoing Cou nci l me mb ers. He wa s of
lhe opi nion th at at tend an ce at NLC i s wort hwhile but s tressed the need to send
a re pre se ntative who would sti ll be on Co uncil during th e next two yea rs.
