CITY OF ENGLEWOOD, COLORADO
May 12, 1980
The City Council of the City of Enflewood, Arapahoe
County, Colorado, met in apecial ••••ion at 0:00 p.m. on May 12,
1980.
Mayor Otis preaided at the meeting.
The invocation and pledge of allegiance was dispensed
with since they were given at the preceding meeting.

Mayor Otia declared a quorum present.

Mayor Otis noted the special meeting was to hold a pu-
blic hearing to conaider a requeat for a 3.2 &eer license appli-
cation for 7-11 Store, 3900 South Broadway.

HEARING FOR THE 3.2 Biii LICENSE APPLICATION FOR 7-11 STORE,
3900 SOUTH BROAIMAY. Council Member Neal seconded the motion.
Upon a call of the roll, the vote resulted as follows:

Naya:
Council Members Higday, Neal, Fitzpatrick,
Keena, Bilo, Bradshaw, Otis.
Rone.
The Mayor declared the motion carried.

Deputy City Clerk Johannisson appeared before Council
and presented the following information:

City Exhibit B -Map of designated neighborhood.

by Oedipua, Inc.
4. City Exhibit D -S11mnary Report from Oedipus, Inc.
Mr. Johanniaaon introduced the repreaentative from Oedipus, Inc.,
the firm who conducted the aurvey of the neighborhood.
Peter Reynold•, 909 Prat Street, Longmont, Colorado,
of Oedipua, Inc., appeared before Council and gave testimony
regarding the reaulta of th• aurvey outlined in the sUD1Dary
report. Mr. Reynold• atated of thoae people eligible to parti-
cipate in the aurvey, 52.85~ indicated the needs and desires
of the neighborhood were not being met and 47.15~ indicated
the needs and deair•• were preaently being met.
There were no queationa to ask of Mr. Reynolds.
Mayor Otia aaked for the applicant's presentation.
Mr. Bob Matthewa, attorney for Southland Corporation,
appeared before Council. Mr. Matthew• called Byran Kettle for-
ward.
Byran Kettle, 1550 Youngfield, Lakewood, Colorado
appeared before Council. Under direct questioning from Mr.
Matthews, Mr. Kettle stated hie teatimony given for the out-
let for 3501 South Lofan concerning his buainess background,
Southland Corporation a policiea and training of its employees
would be identical for teatimony concerning the outlet at 3900
South Broadway. Mr. Kettle atated there was a posting of notice
in the store. Mr. Kettle stated the reason for application was
due to the number of requeata from patrons for beer.
Mr. Matthew• called Elmer Upchurch forward.
Elmer Upchurch, 4380 South Galapago, manager of the
7-11 Store, 3900 South Broadway, appeared before Council. Under
direct questioning from Mr. Matthew•, Mr. Upchurch testified that
he had taken the formal training program through Southland Cor-
poration. Mr. Upchurch alao provided information concerning his
business background. Mr. Upchurch 1tated he had received several
requests for 6eer from hie store patrons.

Mr. Matthew• submitted Applicant's Exhibit A -"7-11
Employee Awareness Form", Applicant's Exhibit B -"7-11 Employee
Work Book" which weru uaud in SouLhland Corporation's training pro-
gram, and ApplicanL'a Exhibit C -potition circulated in the store.
Hr. Matthews noted it waa proawaed the clerk at the counter wit-
nessed patrons vho aianed the petition.
Mr. Upchurch atated he waa familiar with the Appli-
cant' a Exhibit• and that he witnessed approximately one-half
of the signatures on the petition.
There were no further questions of either Mr. Kettle
or Mr. Upchurch. There waa no one else to speak in favor of
the application.
Mayor Otis asked if anyone wished to speak in opposition
to the application.
Don Sty••, 4320 South Lipan, appeared before Council.
Mr. Styes testified that the need• of the neighborhood were
presently being .. t. It waa noted that Mr. Styes lived out-
side the designated neighborhood.
Doug Adams, 3935 South Sherman, appeared before Coun-
cil. Mr. Adams testified that the needs of the neighborhood were
presently being met. Mr. Adams atated the outlet was too close to
the school to be aelling beer.
Betty Joye~. 3910 South Galapago, appeared before Coun-
cil. Mrs. Joyce testified that the need• of the neighborhood
were presently being met.
There waa no one alae to apeak in opposition.
Mr. Matthews and Mr. Kettle then answered questions
from Council concerning percentage of pedestrian-patrons and
drive-in-patrons; the concept of convenience stores; the custo-
mer traffic in the atore during the sWllDer time; and Southland
Corporation's intent to market beer at each and every store.
Mr. Matthews aave closing remarks and asked that Coun-
cil grant the application for a 3.2 beer license.
COUNCIL MEMBER HIGDAY tl)VED TO CLOSE THE PUBLIC HEAR-
ING. Council Member Fitzpatrick seconded the motion. Upon a
call of the roll, the vote resulted as follows:
Ayes: Council Members Higday, Neal, Fitzpatrick,
Keena, lilo, Brada&aw, Otis.

'nlc Mayor declared the motion carred. Mayor Otis stated
Council would make their decision in 30 days and then closed the
hearing at 10:55 p.m.
