HomeMy WebLinkAbout1979-04-02 (Regular) Meeting MinutesREGULAR MEETING: COUNCIL CHAMBERS CITY OF ENGLEWOOD, COLORADO April 2, 1979 The City Council of the City of Englewood, Arapahoe County, Colorado, met in regular session on April 2, 1979 at 7:30 p.m. The invocation was given by Father Francis Kappas, All Souls Catholic Church, 4950 South Logan Street. The Pledge of Allegiance was led by Mayor Taylor. Mayor Taylor asked for roll call. Upon a call of the roll, the following were present: Council Members Williams, Weber, Smith, Harper, Clayton, Mann, Taylor. Absent: None. The Mayor declared a quorum present. * * * * * * Also present were: City Manager Mccown Assistant City Manager Curnes City Attorney Berardini Director of Public Works Waggoner Director of Engineering Services Diede Director of Libraries Winkle Director of Finance/ex officio City Clerk James Deputy City Clerk Watkins * * * * * * Councilman Williams noted a correction in the minutes of March 19, 1979, page 6 next to the last line of the first paragraph. Mr. Williams stated the wording should state "making the many finan- cially obligated for the few". COUNCILMAN SMITH MOVED TO APPROVE THE MINUTES OF THE I REGULAR MEETING OF MARCH 19, 1979, WITH THE CORRECTION NOTED BY COUNCILMAN WILLIAMS. Councilman Weber seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Nays: Council Members Weber, Smith, Harper, Clayton, Mann, Williams. None. April 2, 1979 Page 2 Abstain: Mayor Taylor. The Mayor declared the motion carried. * * * * * * COUNCILMAN HARPER MOVED TO APPROVE THE MINUTES OF THE SPECIAL MEETING OF MARCH 26, 1979. Councilman Weber seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Nays: Abstain: Council Members Weber, Harper, Clayton, Mann, Williams. None. Council Members Smith, Taylor. The Mayor declared the motion carried. * * * * * * In the absence of pre-scheduled visitor Dr. John Simon, Mr. Val Hoyt appeared before Council as a representative of the Englewood Lions Club. Mr. Hoyt requested a special events permit for 3.2 beer for an event the Lions Club has planned for May 5th. COUNCILMAN HARPER MOVED TO SET A PUBLIC HEARING TO HEAR THE ENGLEWOOD LIONS CLUB'S REQUEST ON APRIL 16, 1979 AT 7:30 P.M. Councilman Weber seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Nays: Council Members Weber, Smith, Harper, Clayton, Mann, Williams, Taylor. None. The Mayor declared the motion carried. * * * * * * The following pre-scheduled visitors were present and discussed individually a request for additional aid to the Conununity Arts Symphony. Mr. Dhority submitted a letter from the Nielsen Investment Coq>any written in support of the Colllllllnity Arts Symphony. Mayor Taylor thanked the people for coming to the meeting and informed them Council would take their request into consideration at their study session on April 16, 1979. The Mayor then asked for those people in favor of the Conmunity Arts Symphony's request to stand. Approximately 30 people stood up. * * * * * * Pre-scheduled visitor Les Jenkins, Chairman of the Retail Task Force of the Englewood/Littleton Suburban Chamber of Con111erce was present. Mr. Jenkins requested that Council pass a proclamation declaring the week of April 16th as "Downtown Clean-Up Week" in Englewood. Mr. Jenkins submitted proposed wording for this pro- clamation. Councilman Mann requested that Mr. Jenkins and the City Attorney be dismissed in order to prepare the proclamation and pre- sent it to Council before the meeting adjourned. * * * * * * Pre-scheduled visitor Mark Van Loucks, Vice President of Marketing for Mountain Stated Video was present. Mr. Van Loucks discussed the coq>any'a plane to construct a cable television system in Englewood. * * * * * * Pre-scheduled visitor Gilbert Vocate, 1660 South Albion 1520, Denver, Colorado, Acting Agent for Alsum Brothers, Inc., was present. Mr. Vocate discussed his plans for the Timber Lea Planned Development to be located between Clarkson/Emerson alley extended and Ogden/Emerson alley. COUNCILMAN WILLIAMS K>VED TO BRING FOWARD AGENDA ITEM 6B THE MEK>RANDUM FROM THE PLANNING AND ZONING COMMISSION MEETING OF MARCH 20, 1979 CONCERNING THE TIMBER LEA PLANNED DEVELOPMENT. Coun- cilman Clayton seconded the motion. 'nle Mayor declared the motion carried. COUNCILMAN SMITH t«>VED TO APPROVE THE RECOMMENDATION FROM THE PLANNING AND ZONING COltfiSSION REGARDING THE TIMBER LEA PLANNED DEVELOPMENT. Councilman Hann seconded the motion. Councilman Weber stated he thought Council needed to review the rules and by-laws of the corporation before rendering approval of the development. Councilman Smith withdrew his motion and Councilman Hann withdrew his second to the motion. COUNCILMAN SMITH t«>VED TO POSTPONE THE DECISION ON THE TIMBER LEA PLANNED DEVELOPMENT UNTIL THE NEXT REGULAR COUNCIL MEETING AND THAT ALL THE PROVISIONS UNDER SPECIAL AGREEMENTS OF THE CORPORATION BE PROVIDED FOR THE MEETING. Councilman Weber seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Nays: Council Members Weber, Smith, Harper, Clayton, Taylor. Council Members Williams, Mann. The Mayor declared the motion carried. * * * * * * Pre-scheduled visitors William F. and Harriet A.W. Davis, 105 West Jefferson were present. Mr. Davis discussed his request that Council vacate property located at Acoma Street north of West Jefferson Avenue. Mr. Davis submitted an aerial map of the subject property. Mr. Davis stated he had no specific plans for the property at the present time. COUNCILMAN SMITH K>VED THAT CITY COUNCIL APPROVE THE STREET VACATION OF PROPERTY UNDER CASE 8-79 THAT HAS BEEN HEARD BEFORE THE PLANNING AND ZONING COtlilSSION. Councilman Mann seconded the motion. April 2 , 1979 Page 5 COUNCILMAN WILLIAMS !«>VED TO INSTRUCT THE CITY ATTORNEY TO PREPARE AN ORDINANCE VACATING THE PROPERTY LOCATED AT SOUTH ACOMA STREET NORTH OF WEST JEFFERSON AVENUE. Councilman Mann seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Nays: Council Members Weber, Smith, Harper, Clayton, Mann, Williama, Taylor. None. The Mayor declared the motion carried. * * * * * * Pre-scheduled visitor Jack Patterson, 3587 South Ogden Street was present. Mr. Patterson presented a petition to vacate the council position in Council District 12, namely, the position held by Donald Weber on the grounds that Mr. Weber was not a quali- fied elector of the City when he ran for the office of Council. Mr. Patterson proposed that a qualified elector must be a registered voter and he contended that Mr. Weber was not a qualified elector at the time he ran for Council. City Attorney Berardini offered comnents in response to Mr. Patterson's petition. Mr. Berardini stated the definitions for a qualified elector and qualified registered voter are different; and that a person does not have to be a registered voter to run for Council but that person DI.lat be a qualified elector. Mr. Patterson then submitted an alternative question con- cerning -in the event of a recall petition being circulated -what is a qualified elector and Ill.1st one be a registered voter to be a qualified elector. Mr. Patterson requested a written opinion from the City Attorney in reply to this question. Mr. Berardini affirmed he would do so. * * * * * * Mayor Taylor introduced Ma. Mayor Taylor read the proclamation. COUNCILMAN HANN K>VED TO APPROVE THE PROCLAMATION. Council- man Smith seconded the motion. Mayor Taylor presented the proclamation to Mr. Jenkins who in turn thanked the Council. * * * * * * Mayor Taylor asked if there were any other visitors wish- ing to be heard at this time. No one responded. * * * * * * COUNCILMAN WILLIAMS MOVED TO OPEN THE PUBLIC HEARING TO CONSIDER A SPECIAL EVENTS PERMIT FOR BEER, WINE AND LIQUOR FOR ALL SOULS CATHOLIC CHURCH, 4900 SOUTH LOGAN STREET FOR APRIL 21 -22, 1979. Councilman Clayton seconded the motion. Upon a call of the roll, the vote resulted as follows: Ayes: Nays: Council Members Weber, Smith, Harper, Clayton, Mann, Williams, Taylor. None. The Mayor declared the motion carried. Mayor Taylor asked if any one present wanted to speak in favor of the permit. James Sprinkle, 500 East Grand Avenue, appeared as a re- presentative of All Souls Catholic Church. Mr. Sprinkle submitted a photograph for proof that the notice was posted and requested that Council grant the permit. Mayor Taylor asked if there was any one else wishing to speak in favor. The Mayor declared the motion carried. * * * * * * COUNCILMAN WEBER K>VED TO OPEN THE PUBLIC HEARING TO CONSIDER AN ORDINANCE CREATING PAVING DISTRICT NO. 26 IN THE CITY OF ENGLE~D, ORDERING THE CONSTRUCTION AND INSTALLATION OF STREET PAVING, CURB AND GUTl'ER AND SIDEWALK IMPROVEMENTS; PROVIDING FOR THE ISSUANCE OF BOHDS IN PAYMENT FOR SAID IMPROVEMENTS; AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE CITY AND COUNTY OF DENVER AND THE CITY OF SHERIDAN CONCERNING THE CONSTRUCTION WORK; AND SETTING FORTH OTHER DETAILS IN CONNECTION WITH THE DISTRICT. The Mayor declared the motion carried. City Manager McCown stated presentations from the staff concerning Paving District #26 had been made at the public hearing on March 13, 1979. Mr. Mccown stated the Director of Public Works and the Director of Engineering Services were present to answer any question. April 2, 1979 Page 8 There were no questions from Council. Mayor Taylor asked if any one in the audience wished to speak in favor of Paving District 126. No one responded. Mayor Taylor asked if any one in the audience wished to speak against it. The Mayor declared the motion carried. Councilman Williams stated he was against some agencies receiving more than others, and that all agencies should share equally. COUNCILMAN MANN K>VED TO AMEND THE MOTION BY INCREASING THE AK>UNT TO COMMUNITY ARTS SYMPHONY TO $9,000. Councilman Smith seconded the motion. Councilman Harper stated he favored the allocation and saw no need to delay action even though a study session has been set for April 16th to discuss this matter. The Mayor declared the motion carried. Councilman Mann asked Councilman Weber to explain his rea- sons for abstaining. Councilman Weber reiterated his previous remarks wherein he felt there was a conflict of interest on his part since he represented one of the district• that was to be realigned. Councilman Mann asked for a ruling on whether or not Coun- cilman Weber should be required to vote for or against the motion. Mayor Taylor ruled that Councilman Weber must vote. Councilman Weber stated he voted yes contrary to his con- scious and to the ruling of the Chair. * * * * * * April 2, 1979 Page 13 City Attorney Berardini presented Council Bill No. 14 which would amend the City Code prohibiting the use of welding machines to thaw frozen water service pipes. COUNCILMAN MANN K>VED TO POSTPONE COUNCIL BILL NO. 14 UNTIL THE FIRST REGULAR COUNCIL MEETING IN MAY. Councilman Clayton seconded the motion. Council discussed Council Bill No. 14 at length. City Manager Mccown stated the use of welding equipment is still being studied by staff. Mr. Mccown stated that staff would provide re- comnendations in a few months and requested that Council wait for the report after which Council could modify any recoDlllendations and direct the City Attorney to prepare an ordinance. Councilman Mann withdrew his motion and Councilman Smith withdrew his second. COUNCILMAN MANN K>VED TO TABLE COUNCIL BILL NO. 14. Coun- cilman Clayton seconded the motion. Mr. Mccown stated as a matter of protocol the City is required to hold another public hearing on the assistance plan.
