WH EREAS, th e Englewood Estates Subdivisio n is a vaca nt parce l of approximate ly 1.19
acre s locat ed at 1296 West Quincy A venue; and
WHEREA S, Englewood Estat es is loca ted in an area bou nded by West Quincy Avenue on the
nort h, West Radcliff Avenue on the so uth, South Lipan S1 ree t on the cast, and Sout h Navajo
Street on the west; and
WHEREAS, adjacent properties to the north , cast and south arc zo ned R-1-C Sing le-Fami ly

W EREAS, City Co un cil adopted a Bill for an Ordinance approving the Englewood Estates

A ugust 2, 2004 City Coun cil meeting. This pro pose d reso luti o n ap prove s th e fin al pl at of the

PREVIOUS PLANNING COMMISSIO'i ACTION
The Pl ann ing and Zoni ng Comm issi on co nsidered th e Pre lim inary Pl at of th e Englewood Es tates
Subdivision under Titl e 10 Lan d Subdivisions of the form er Zonin g Ordina:,ce on Febru ary 6, 2004
at a Public H earing in conjun cti on wi th the Englewoo d Es tates Planned Uni t Deve lopment. Th e
Commission voted to fo rwa rd th e Fina l Plat to City Counci l w ith a reco mm end ati on fo r approval.
The vote was 9 to 0.

Th e subject pro per ty is a vacant pa rcel of appro ximate ly 1.1 9 acres located at 1296 W est Q uincy
Ave nu e. Th e site is loc ated in an area bounded by Wes t Q uin cy Avenue on th e north, W es t Radcliff
Ave nu e on th e so uth , So uth Lip an St ree t on th e east, and So uth Nava jo Str eet on ti 1e wes t.
Adjacent pro p~rlies to the north, eas t, and so uth are zoned R-1-C Sin gle-Fa mily Res idence Dist rict,
an d co nt ain sin gle.fa mi ly homes. Adjacent prop erti es to th e west are zon ed 1-1 and are use d as

ali gnment w ith Li pa n Stree t to th e north w ith o ut ser io usly impacti ng th e b uil dability o f Lo ts 1
and 2 o f th is subdivisio n .
By m ovin g th e in bound p o rti o n o f W est Q uin cy Circl e 160 fee t fro m So uth Li pan Strt c , all
ingress conflic t po ints are m ove d away fr o m th e Q uincy/Sru th Lipan Stree t in tersect ion. In
ma ny resp ects, Wes t Quincy Ci rcle is merely a dri ve way acces s fo r th ese seve n homes .

bicyclists.

M un ,c ipa l Code w hich was th e predecesso r t o th e U nifi ed Development Code (UDC) Ttle 10. Titl e

more th an thr ee (3) lots we re crea ted or when dedication of public ri ght-of-way was required .
The subject pro perty is a singl e, vaca nt resid ential pa rcel con tai nin g or 1. 19 ac res. The sub di visi on
propos es to create seve n (7) res id ential bu iiding lots . The la yo ut of th e lots is co nsi stent w ith th e
Englewood Estates Pl ann ed Unit D eve lopm en t (PUD).
Th e proposed lo ts w ill rang e fr o m 5,116 squ are fee t !o 6,75 0 square feet. Th e ave rage lot siz e of
th e PUD is 5,784 square fe et, w hi ch is co mparabl e to th e adja cen t R-1-C Single-Family Residence
Dis tri ct w hi ch requires a minimum 6,000 square foot lot. Th e propose d height of stru ctures is 32
feet, w hi ch is th e sa me as the max imum allowed in th e U nified D eve lopm ent Code (UDC).
Se tbacks are estab lish ed by development envelopes speci fi c to eac h lot as shown on th e PUD
Di strict Pl an. In addition to th e developm ent envelopes, a provisio n th at requi res ga ra ge doors to
be set back a minimum of twenty-four (24) fee t fr om the edge o f W es t Quincy Circle has also bee n
added. West Q uin cy Circle , id entifi ed as Trac t A, wi ll b e owned and maintain ed by th e
I :o meow ner Associa ti on .
Th e seven City departm ents an d divisi ons con1pris ing the De ve lopment Rev iew Team rev iewed th e
p roposed subdivision . A ll identi fie d deve lopment issues of th e proposed subdivisi on have bee n
reso lved. Water and sani tary sew er serv ice is avai lab le to th e si te. El ectr ic, gas an d co mmun ica ti on
utiliti es are availabl e to th e si te and utility ease ment s have be en provided on th e plat.
Th e prop ose d subdi visio n is co nsistent w ith th e zoning standards es tab lishe d in th e En glewood
Es tates Plann ed Unit D ev el op ment and w ith th e Comp renensive Pl an, which id entifies th e site as
part of a res id entia l area .

After conside ring the statements of the w itnesses, and reviewi ng the pertinent documents,
the members of the City Pl anning and Zoning Commis sion made the following Findings
and Co nclu sions.

INDINGS CF FACT
t. THAT the appl k a ,on for approva l of the Englewood Estates Subdivision was filed by
Distinctive Builders, LLC , owne r of property addressed as 1296 West Quincy
Avenue, Englewood, Colorado .
2. THAT Publi c Noti ce of th e Pu b li c Hearing was given by publication in the
Englewood Herald on Decemb er 26, 2003 ; certified lette rs we re also mailed to
adjacent property owners notifyin g them of the date, time , and location of the
Public Hearing .
3. UlAT Planner Fruchtl tes tified that the propo se d Englewood Estate s Subdivision
di vide s the site commonly addr essed as 1296 West Quinry Avenue into se ven
single-famil y building sites, and establishes a private one-way street, known as West
Quincy Circle, to provi de acce,ss to ,he proposed de,elop ment that it is being built
to se rve.
CONCLUSIONS
1. TH AT the application fo r En glew ood Estates Sub division was , , by Distin cti ve
Buil de rs, LLC.
2. THAT proper no tifi ca tion of the date . tim e, and place of the Public Hearing w as
gi ven by publication in the officia l City news pape r, and by personal letter to
adjacent pr :.>pe rty owners of re co rd mailed via certified mailed , USPS.
3. THAT the proposed Eng lewood Estate s Sub division Prelim inary Pl at is in
co nformance with Tit le 10, Land Subdivisions, of the Engl ewood M uni cipa l Code,
and that a Final Plat is to be prepared and referred to En glewood City Council for
approval.
DECISION
THEREFORE , it is th e decision of the City Planning and Zoni ng Com,nission that the
Prelim ina ry Plat of the Uni ve rsity Homes Subrlivision is in conformance w ith Title 10, Land
Subdi visi ons, of tre En glewood Municipal Cod e. The applicant is directed to prepare a
Final Plat, and said Final Plat of Engl ewood Estates Subdivision shall be referred to
Engl ewood City Coun ci l fo r approval.
The decisi on was reached upon a vote on a motion made at th e meeting of the City
Planning and Zonin g Commission February 23, 2004, which rr.otion states :
