A RESO LUT ION DECLARING THE INTENT OF THE CITY OF ENGLEWOOD,
COLORA DO TO SIGN THE METRO MAYORS ' CAUCUS 2004 REGIONAL
MEMORANDUM OF UN DER STAN DI NG ON WATER.
WHEREAS, th e Cit y o· · Engl ewood , Co lorado (the "C ity"), is a home rule city; nnd
WH EREAS , Co lorado is a sc mi •a rid climate whe re wa ter is a finit e and va luab le re source; and
WHEREAS, the Den ver metropolit an area is Co lorado's population center and econo mi c
"engine" and thu s mu st reduce its potentfal vulnerability to drou ght through co nservation an d
water suppl y projects; and
WHEREAS , elected officia ls in the Denver metropolitan area want 10 build on the spirit llf
conse nsus, cooperati on and essentia l praf!matism about Co lorado's water supp ly; and
WHEREAS , loca l government s in the Den ve r metropo litan area in drafting the Metro Mayors'
Caucus 2004 Reg iona l Memorandum of Understanding on Wat er have vo lunta rily and
co ll aborat ively se t resources within their individu al and overlapping juri sdi ction s and the re gio n
as a who le .
NOW, THEREFORE , BE IT RESOLVED BY TH E CITY COUNCIL OF THE CITY OF
ENGLEWOOD, COLORADO, THAT :
Section I. The City Co uncil of th e City of Englewood hereby au thori zes the Ma yo r of th e
City of Engl ewood, Co lorado to sign the Metro Mayors' Ca ucu s 2004 Regiona l Mem ora ndum of
Understanding on Water. A copy of sa id Water Co mmitte e Memorandum of Understanding is
att ac hed heret o as "Exhibit I" and incorpo rated herein by reference.

THIS MEMORANDUM OF UNDERSTANDING is made and entered into this
_ day of ___ 2004, by and among the lo ca l go vemments in the Denver, Co lorado
metropo litan area, bodies politi c orga nized under and e.risting by virt ue of the laws of the
State of Colorado .
Whereas, Co lorado is a se mi -a rid climate whe re water is a finite and va luab le resource ;
and
Whereas, wa ter has important environmental, eco nomic , political and socia l impacts; and
Whereas, historically, Colorado 's precipitation patterns have included inevitable and
cyclical periods of drought; and
Whereas, Colorado's natural environme nt and recreational opportunities, a primary draw
for visitors, new residents and relocating businesses, require a reasonable degree of
minimum stream flows; and
Whereas, the Denver metropolitan area is Co lorado's popul at ion cen ter and econo m,c
"engine" and thu s must reduce its potential vulnerability to drought through conservation
and water supply projects; and
Whereas, elected officia ls in the Denver metropolitan area want to build on the spirit of
co nsensus , cooperation and essential pragmatism abo ut Colorado's water supply ; and ,
Whereas, the Denver metro politan area is projected to add an additional I million
residents between 2000 and 2025, primarily through births by existing residents and in-
migrant s 1; and
Wl,ereas, regional and lo ca l differences exis t in water quality , quantity, and usage and
each local government or water provider must tailor its water effic iency pro gram to reach
conservation goa ls; and
W/1ereas, man y local governments in the Denver metropolitan area have developed
extensive water wise management systems and practices; and
Whereas, local governments in the Denver metropolitan area have vo luntarily and
collaboratively set forth the principles defined herein that illu strate their comm itm ent to
wise management and steward ship of vita l water resou rces within their indi vidual and
ove rl apping jurisdictions and the re gion as a who le.
NOW THEREFORE, th e wulersigned cities and towns (he reinafter referred to as
we) agree as follows:
I. £,,tent of Agreemet1,. This agreement is intended to set forth principle , th .t illustrat e
our commitment to ,,ise mana ge ment and steward ship of vi tal water rgsources and
actions that we individuall y or co llectivel y might 1ake to carr y out that stewards hip .
N ' :ng in this agreement shall confer rights on third parties or creat e ob li gations in
favor of third parties .

2. Best Ma11agenre111 Practices. Thoughtful modification of direct and indirect re so urce
management practices can improve efficiency and reduce demand. Man y
communities have already adopted best management practices , so me have not and
some that have been adopted could be improved. Towards that end, we will use our
bes'. efforts to co ntin~e to identify and adopt, or urge the water utilities that serve us
lo adopt , bes t management practices that achieve efficient wa ler use through
conservation , reuse, and/or new technologies.
3. New Tec/1110/ogies. New technologies that have the potential to reduce demand for
both potable and non-potable water are being deve loped every day . We will co ntinue
to strive to implement new teclu .d ogies whose benefits are demonstrable and cost
effective.
4. Coordi11a1io11. We acknowledge that as members ofa region and of the State of
Colorado, we share a common challenge in providing a safe, stable supply of
affordable water to our customers, both prese nt and prospecti ve. We will use our best
efforts lo find areas of cooperation between water systems at the regional and
subregional levels that will result in more efficient use of our water reso urces .
5. Education. The consumer benefits from knowing how the public sector is working to
reduce consumption , increase efficiency and provide stable futute •::ater supplies .
Further, an educated consumer can make informed decisions about his or her own
consumption . We will continue to work together to coordinate public education in the
Denver metropolitan area to convey the importance of water and to increase
awareness of the need lo conserve, manage and plan for current and future water
needs.
6. Protect Providers. As consumers reduce consumption, thi s may have the unint end ed
consequence of jeopardizing the current an d future financial viability of water
providers . We will continue to evaluate our fee structures to look for ways to deter
wasteful use of water while still protecting the public's investment in water supplies
and infrastructure.
1. Address Impacts. Reducing consumption is only a partial answer lo providing for th e
future needs of the growing Denver metropolitan area. In future water suppl y
proj ec ts, we will encourage jurisdictions to wo rk tog ether lo meet the nee ds of a
growing population and to address the economic and environmental impacts of water
supply development projects and transfers of water from its historic place and type of
use. When a water supply development project involves the tra nsfer of agricultural
we :--outside of a local government's planning area, water suppliers are encouraged
to use leases or interruptible water supply contracts . Water suppliers should work
with local governments representing affe ct ed communities and provide them
oppc,rtunities lo assist in identifying project impacts and possible offsetting measures .
8. Lead by Example. We understand that individuals look to th eir community leaders to
set an example for the public and that actions speak louder than words. We will

continue to consider and encourage water conservation principles in our planning ,
construction, maintenanc e and redevelopment of public spaces .
9. Commit to Future Stewardship. Though upon signing we have be en ex perie ncing
long-term drought , we recognize that the current drought will come to an end.
However, Co lorado will continue to be a semi-arid climate and demands on our water
supplies will grow with our state's popul ation, making our commitm ent to the wise
stewardship of water just as important in times of abundance.
10. Execution in Counterparts. This agreement may be executed in counterparts , eac h
of which sha ll be effective and which together shall constitute one and the same
instrument.
